Hi All, Just spoke with Perla, She informed me that the access road at the back of DJ will be completed tomorrow and they expect to receive licence from the Town Hall next week. She said that we are now eventually at the end and completions will be happening this month.
Fingers crossed that she is right this time.

Just checked my emails. Got this today from my solicitor.
Today I have been in contact with the developer, who has informed us that the road works will finish in the next week - 10 days and that completion should take place in a few weeks time. The idea of taking legal action against ARROHABITATGE should be checked carefully, due to the fact that the reason for the dealy could be because of technical problems coming from the Townhall. I will also discuss with the developer the inclusion on the deed of a clause obliging themselves to complete the roda properly once all railway works have concluded.
I will contact you in one weeks time to provide you (I hope) with further information.
(So much for Perla's tomorrow )

I'm sorry to say, but Westport is right. Perla meant 'manana' when she told you tomorrow.
We jumped in the car and had a look. There is still a lot to be done. Look at the pictures from today. We will have another look this week to judge the progress.

That's disappointing Max - I was quite looking forward to seeing Andy bending over backwards and kissing his ***! On the subject of compensation my solicitor's reply was:
I take this opportunity to inform you that from the contents of the letter the Developer has sent, they already point out that circumstances beyond their control have delayed the completion in your favor and cannot be held responsible for this. It is in view of this that even though we will ask for a compensation on your behalf, I cannot guarantee that we will be able to negotiate same.
I don't think we will be able to get compensation - and at the end of it all we want is the keys to our apartment.

Hi David,
If I remember well you would be joining Andy in the athletic efforts as new keyholders. It seems your sollicitor is convinced that the delay is in your 'favor'. Is that because of second thoughts about your exhibitionist abilities?
Seriously though, I also have doubts that we will ever get compensated.

we passed the roadblocks for a new inspection of the provisional road. The town hall is still busy with the drainage systems, but there is real progress. If al goes well and my judgement is right (but i'm hardly a qualified roadbuilder), they could be ready in a few days.
Our developer would then get his chance to tarmac this provisional road. Could be done in a few days I guess and the good news is that there was a 'tarmaccing' machine parked nearby. So if all goes well and my amateur judgement is not too far off it's thinkeable that the work could be finished before the august holidays.

Sounds a bit more hopeful. I am confused about the provisional road I take it its the one that comes down from El Hugeron restaurant but looking at your photos 26647 I & 2 I am not sure where this is? These photos show a deep crevice has this been dug out or is it being filled in? The other road you show in other photos I think is the one leading up from the railway tunnel which goes straight up at the roundabout which also leads up to a new road which must be leading out to somewhere. is this the provisional road? And is it leading in to the back of Don Juan somewhere?

What you see on these two pictures is the start of the provisional road at the roundabout. See 13 juli 23183 nr. 1, the goole earth photo near my label 3.
Most of the photos show other parts of this same road which will depart at the back of DJ (see label 2) and go to the roundabout. From there on you follow a completely finished (but still unused) dual carriageway leading to the A7.
The deep crevice you see if for the drainage pipes. It's being dugged out and will be filled in again.
Yesterday I thought that would take some time. I was both right and wrong. The Spanish are bad planners, but they compensaty by great improvisations. Today they had started laying the tarmac and they just bypassed this last crevice.
We spoke to a supervisor and he was sure they would finish the tarmac today. Tomorrow they plan to start with the road markings! Have uploaded some photos to proof it as I can imagine you will all have a hard time believing these real signs of progress after so long...

Hello all, I drove down the road from 'El Higiron' at about 4 o clock and the tarmac machine was on the back of a wagon leaving the area, so hopefully that is all complete and we finally have a place of entry to Don Juan. MARTIN

Hello All,
I met Perla on Friday and was told that the road at the back is now complete and joins the motorway. I had to see it for myself bescause I went up there the week before and it looked as though they would need another month to finish it.
I have posted some pictures (20 July 2007 - 1076) Perla said "We cannot come to an agreement with the Train company and the other developers as to the road parallel to the railway line so we had to compromise with the Town Hall and build this temporary road at the back of the development - at our cost - we will then be able to apply for the license on Monday.
The pictures if viewed 5,4,2,3,6 will take you from DJ to the final roundabout on the completed dual carrigeway from the motorway.

I notice Perla told you they would be applying for the licence on Monday. Knowing Perla as long as we do, that could be any Monday from now to the next Millennium. As for the photos of the completed new road at the back of Don Juan, it seems strange there are street lamps at the lower ground levels, yet on the high twistiing sections (photo 5, 20th July 1076 ) nothing, not even crash barriers. Thats some drop in photo 5. Having said that, I dont think health & safety means anything in Spain. It will be interesting to see what the townhall have to say. Hopefully it will get rushed through as we have booked flights for August and have no accomodation booked as we hope to stay in our apartment.

Just had the below reply from our solicitor regarding a visit to Spain we have arranged for 3-11 Aug.
So everything crossed and maybe we will be in the pool with the frogs :-)

As we have discussed in previous occasions, you will be unable to formalize the title deeds of purchase until the Licence of 1st Occupancy has been granted by the Town Hall of Fuengirola, which apparently will take approximately 2 weeks from now.
We will prepare everything for you to sign your deeds during the dates of your stay in case we reive the licence within the next 2 weeks.

Hi All,
It seems to be making good progress now. like you Westport we have booked a holiday there on the 16th of August and have no accommodation booked either I am hoping to sign when we go over. I don't mind staying in the apartment on blow up beds but we would need electric I don't know how long that would take to connect.
But hopefully we can stay in our apartment, I still have to furnish it. A lot of work to do.

Our mortgage advisor has been in touch with the developer today and they were told we have about two weeks to go . However as Spain is all but closed for business in August I wont hold my breath.

There are a few things that need to happen before the first keys are handed over:
1) The Town Hall Approves the "provisional" road with or without crash barriers
2) The Town Hall issues the licence of first occupation
3) Our respective solicitors receive notification that the LFO has been issued and request funds from us and mortgage providers
4) When funds are received they arrange completion meetings for all parties (developer\their solicitor\mortgage provider\their solicitor\us\oursolicitor and of course the obligatory notary (I am not sure if this is a complete list?)
There are a lot of potential hurdles still to be jumped before we get the keys - and given the likelihood that some of the necessary people will be on holiday in August I do not expect many of us managing to complete in August even if everything goes as Arrohabitatge hopes.
Sorry for being negative (I prefer realistic)

Hi Don Juaners, I had a quick look back through some previous posts and noticed on from me below dated July 2006. It is very concerning that we are still talking about the same old stuff : August shutdown, licences & access roads etc. This whole thing is starting to get very very boring!!
Hi All, just got back from Spain in last few days and have posted some pics on site. There is a road being constructed at the back of Don Juan that connects to the motorway. Also anyone that has purchased in phase 2 at the top of the site beware as I think that the phase 3 building could be quite high as it has 3 car park levels then 6 levels of apartments so some views could be lost. As far as tunnel is concerned not sure whats happening here I called in to see the developers and as usual they could not give me any precise information they are just not bothered about keeping their buyers informed. I know that the developer intends to apply for the licence in September with a view to completing in November. To be honest my gut feeling is that phase 1 will not be completeing this side of Christmas there is still a lot to be done concerning roads and access on the site plus all works will stop for 1 month in August. To the right of Don Juan there is a massive site being constructed this must be the 1400 apartments that are to be constructed. If you go right to the top of this new site watch out for the dog near the site cabin, hes tied up on a rope but will make you jump when he sees you. Not sure about your point 4. I am pretty sure the remainder of funds owed to the developers is handed over at the time of signing at the notary's office when all parties are present and all paperwork is signed and after all the solicitors have checked that everything is as it supposed to be for their respective clients. (supposedly anyway!).
