This is now becoming beyond a joke.  Bachir (my husband) laughingly bet me that we'd not be in until Christmas but I'm beginning to think it might be closer to that than we think!  If they build the road as quickly as it has taken to complete the apartments...........

If they had have built phase 1 by Nov 2006 and applied for the occupancy licence in Sept 06 the developer  would have been in the position of having to utilise the 3 month extension period within our private purchase contract for unseen delays. If this was the case we would of propably completed in March/ April 2007.

This above is what should have happened, it is not the Town Halls fault at all. Who in the right mind would allow a development to be completed without a proper acces road,road lights, pavements etc being in place!

Thanks for that info Jim & Joan.  Rather disappointing but not surprising I suppose in view of all the broken promises in the past.  I assume the "provisional service road providing access to sector UR-1" refers to the existing road alongside the railway or is it possible that there is some other route for access?  I also wonder who ADIF are?  Maybe Max can help us on this one!

We are going out again on the 1st August so it will be interesting to see what progress has been made on the road by then.

Andy, there are 2 separate issues.

The circumstances regarding the Town Hall and the railway company not having agreed what is required (or who is going to pay for it) strikes me as genuine and although we seemed to know about it before the developer (if you believe their letter) the problem is not of Arrohabitatge's making. This latest advice that they need to get a completion certificate and then there will be a further delay before the Licence of First Occupation is issued is disappointing - it is hard to plan when we can't be sure when we can get possession.

The other issue is the late delivery by the developer. It is clear from their letter that they are making their case that they completed the development on time and are therefore not liable for compensation for the late handover. We all know this is not true - however I do not think it will be easy to obtain compensation. I read elsewhere on this site that it simply never happens and there is sufficient "grey areas" here to make our case very difficult to win.

The only positive thing I can think of is that in the meantime Arrohabitatge is still paying the mortgages!!

Utterly disappointing to put it mildly... (I actually used much stronger words when I just read it).
 
What I didn't realize a few weeks ago was that this provisional road would be considered as a completely separate building project. Thanks to Jim and Joan's lawyer it's now clear that this is the case and that they have to apply for a 'Certificado final de Obra' (completion of works). This is issued by the guild of architects and takes some time after the actual work is completed. With this certificate Arrohabitage can re-apply for the Occupation License. No idea how long this will take. I guess the developer is promised a speedy procedure, but there's no certainty there. August is a very slow month over here so we will be lucky if we see the first hand-over in August. It could well stretch into September, beginning of October for some of the apartments!

UR-1 is the sector on the development plan of Fuengirola where DJ is located. It seems pretty sure that they will use the -already widened- dirt road for this provisional road. ADIF is responsible for the railway infrastructure (while Renfe exploits these).

 Regarding the 'dispute' between Andy and Dave I would say that Arrohabitage is mainly responsible for the delay. They have always known that they had to build this road, but they couldn't reach an agreement with the other parties involved (not only ADIF, but other developers in this area as well). They postponed and tried to get the License by persuading the Town Hall it was not their fault. They announced in public that this dispute wouldn't interfere with completion while they well knew that this was their hope, no fact. This strategy blew up in their face and now they have to improvise. Their fault I would say.

From watching the Overseasproperty news channel on skyy 287, there was an article on the Malaga to Fuengirola railway line and station upgrade saying it was about a year behind tthe scheduled completion date.. Wether this had anything to do with the completion of the road i dont know. If you remember an article i posted a few months ago regarding my chat with one of the security guards who told me there was major problems with completing the surrounding roads going up behind Don Juan including the one that is supposed to llink up with the motorway. From what he told me, the reason why the tarmaced roads suddenly stop, is because they dont own the land, and dont have permission to build on it. Apparently the land between the motorway and the section of road completed so far leading to it, is owned by the guy who owns the big restaurant up on the motorway and is refusing to give permission allegedly. The same goes to the far side of the motorway which apparently comes under Mijas townhall, and they are not on the best of terms allegedly wiith the fuengirola townhall. So if the security guard is right we could have a number of road problems for years to come. his last words to me were, Here they build anywhere and worry about building the roads after."

we are flying out on Saturday for two weeks.  Hoping to meet up with Max - staying at friends apartment in Torre Blanca. Going for some much needed sunshine, anything else will be a real bonus!!!!!!!!    Hope we receive some news whilst we are over.

Thanks for that, all though its not great news, you must be going mad as you are waiting so long and its going to be your permanent home.

Were you talking to the developer lately and if so what are they saying. Cause you live over there when do you think it will be complete?

Hi eoin

We are all frustrated at the slow progress and lack of information. I have just gone back over all the posts on this thread - I'm bored and have nothing better to do but it is interesting to see what was expected last October. Many of my posts have been over optimistic - but then even the most pessimistic posts last autumn didn't predict we would still be in limbo in July 2007!

The situation we are in today is that there are complex issues which involve various organisations which need to be resolved before our Licence is issued. We all hope it will be issued soon but I don't think anyone actually knows when it will be. Like you I am now of the opinion that it is likely to be September before the 1st completions take place. I hope it will be sooner but I also know it could be later.

My priority is to complete as soon as possible but back in October the issue of compensation for late completion was a hot topic. Has anyone been advised that we have the basis for a claim?

I have spoken to Perla this morning, she has told me an agreement has been reached with the Town Hall regarding the road. The Town Hall will install the 'pipes', water, sewerage etc. NEXT WEEK. Once the pipes are installed it will take DJ 10 DAYS to finish the tarmac. The Town Hall will then issue the licence A letter has been sent to my lawyer confirming this. Do not hold your breath!!

I remember the last time I was over in April, Perla told me they were tarmacing the road the week after I was going home. I think you would get more truth out of a compulsive liar.

I received the following update from my solicitor today following my request to try and pin down the likely time frame for finishing the road.

"I have contacted the developers. They have informed me that the works related to the access road started yesterday and that they hope to have them finished in a period of approximately 15 days.

 

Once the said works have finished, the verbal agreement the developers have reached with the Town Hall is that the issuing of the First Inhabitant Licence will be imminent."

 

If true, this is good news but I wouldn't start getting out the champagne just yet.....

Sigh... It feels like it is always a week or two from completion, regardless of when people get hold of the developers! We are actually leaving Sweden's dastardly weather in two weeks to come down for our holiday. Our plan was of course to spend it in our apartment, but alas, 'twas not to be. However, we are very keen to see our apartment and the rest of the area so that will be very nice! 

Does anyone have any tips how we could get in touch with the Developer for a meeting? We would like to talk with them first hand and see what's going on. We have asked our solicitor to arrange a meeting, but haven't received any answer yet so we thought to ask you guys too.

By the way, this forum is a life-saver when it comes to getting some news! We are constantly in here checking for updated information, since we hardly have any from our dear solicitor or anyone else. So thank you all for the work you put in when it comes to keeping us updated with info! And fingers crossed for getting the licence as soon as possible!

The Developers, Arrohabitatge S.A. have their offices at the following address which is located roughly opposite Don Juan on the beach front, i.e. the Paseo Maritimo. you can access the Paseo Maritimo just opposite the access road entrance to the Carvajal Train stop. If you walk or drive along the Paseo Maritimo in the direction of Fuengirola you will find the office on the right hand side.  You can call in there and ask to speak to Perla or make an appointment to see her if she is not available.  This is what we did in February last when we were out there.

We agree this is a great site as only for this site we would not know anything. As our solicitor gives us no information and if he sometimes dose answer our emails it usually consists of four words.

We are also going out on the 16th of Aug and I don't know whether to book an apartment or not, wondering will ours be ready, its a real mess.

Dose anyone know the size of the windows in the apartment?

Yes Lorraine and Eoin we will post some new pictures whilst we are over.  Just weighing our cases! have tried to fit in lots of items for the apartment as well as two weeks capsule wardrobe, (well thats what Den thinks !!) Hi Dubbster, we're also coming over in 2 weeks, fly out on the 21st. We've rented our neighbours apartment out at Calahonda, disappointed we won't be in our own. Let me know if you fancy meeting up for a chat and a beer! Anybody else going to be over then, would be nice to put names to faces!
