As Darren said, we have been paying a percentage from our community fees towards the painting of our properties from day one, which is also seven years in our case and while it certainly needs repainting I cannot see why we should pay anything extra for it, even if was only 10e. We are just letting everyone off the hook, where will it all end??? We were told we had to do the pergolas last time. If they want to reduce my fees by 25e approx a quarter I will certainly do my own maintennance every year........600e absolute robbery

I dont understand why we have to pay anything.. the accounts show just under 500,000 euros in , after all the expences... that is what we pay our maintenance for.. I will refuse to pay it! Its not the money, its the principal.. we were not advised.. oh.. by the way.. you will have to pay an extra 200 euros every year to cover the cost of painting..!!!

I think we might be picking up the bill for all the empty properties and also paying to paint the properties for people who have never paid their community fees

Its irrelevant to me as im not going to pay it however much it is ... I will ensure our property is kept in good order and painted.. i dont need somebody to do it for me..

So, hopefully we will all email Mileniun to state our intent that we will not pay these over-inflated charges. We should also let everyone else who we know at Condado what is being suggested. There is a very small % of the owners who actually tune into this forum now.
I have certainly not had any communication from Spain on this topic inany way, shape, or form!

Read the accounts again. It says we have 211583.7 in the banks but have 265678.17 in outstanding payments to service companies. The meaningless figures are the top include the 807,000 of debt as an asset. So really there is no money in the funds. Had an email from ML and the figure has now gone up to 650 an apartment????????

Hi, we understand that there are representatives for each garden and they have looked into that on our behalf, why dont we trust them? Maybe you should take into account that painting is not just a coat of white liquid, there are certain jobs to be executed before you can actually paint and some recently painted properties have not done that so they look tired again after 3 months. Firstly it needs a good power wash, then needs filling and other preparation until you can finally paint. There might be scaffolding needed as well as other infrastructure. I do understand that for many people this cost might be a burden but we all knew that there was no money budgeted for that since years. Maybe the former presidents should have taken a more sensible approach some years ago and not lowered the fees as they did, this would have provided a sufficient reserve fund to cover the expenses? Anyway, we agree to pay the levy for the sake of the resort which is in very good shape overall. Looking forward now the the shitstorm, Rob & Bev

Just reading the comunity by-laws, seems there is no way out of that, all owners will have to contribute to that in equal shares once the AGM has decided about. Some people still think they can opt out but dont be mislead, the outside of your property belongs to the comunity and will therefore be treated. Maybe in your home country you can act differently and do what you want in a comunity, not in Spain! Again, this should have been dealt with some years ago by the former presidents, maybe they just wanted to get a quick reduction on the fees sacrifycing the financial viability of the resort. You cant blame the actual representatives, they surely do their best to make the right decisions. Rob & Bev

We are in Spain so yes people need to know and understand the local laws. To charge all owners equal shares for the cost of the painting is against the HPA and the statutes of the community.

Just received the call to the AGM.
On the form for proxy voting there is NO option to opt out of the painting.
The reality is that the few who attend or bother to send in a proxy vote will make the decission for the whole community, then everyone has to tow the line and pay the fees.
As these are taken by direct debit you cannot choose the amount, either pay or default!!

Hi Everyone,
Since signing our contract Ive not missed paying one management fee, in excess of 6 years - I was told that it will be painted every 5 years but in true Polaris style this was yet another con - the money has been paid but no sign of the service
The painting should already have been done at no extra cost to any of us - Im painting my own this year and I think I might not pay my management fees for a few months to reimburse myself as Ive already paid for it !

Just read the thread again how can Condado painting charge someone 200 euros and then charge the whole site 600 euros ??? thats taking the Michael !!! it should be less to do all of us as opposed to one apartment
This should be stopped before it goes any further and be looked in to as I think we all agree 600 euros is too much we all know people are doing it for a lot less

Ditto Leigh - we have already been paying towards these costs in our Maintenance Fee.... and im sorry, but we do have a choice as to whether to pay or default.
I have just received an email and have cut and pasted the paragraphs concerning the painting:
Now on with the painting. The resort needs painting. Both this year and last year
presidents were asked by the community to study this and get quotes. Last year at
the AGM owners rejected any raise in fees to start the work, again requesting more
quotes. We have more quotes. All come in at about the same price as the work is
managed by a building surveyor, architect, who requires very high standards. It is
not a case of painting an apartment for 650€ it is the painting of the entire resort.
The walkways, walls, corridors. The architect also calls for repair to damaged paint,
sealing, and 2 coats of the highest quality paint.
The contractor that wins the bid with the community must have experience in running
commercial work and have a resume.
Option A allows for a 5€ a month raise in community fees to begin this work. On the
call it states to begin with the areas most urgent. This would be areas where bare
concrete is showing. I am sure everyone agrees this does not look good. I would look
on this as a continuous work. Your apartments will be painted, how long it will take
to get to your particular apartment I can´t tell you, the rate, pace and location of the
work to be done will be decided by the surveyor and new board and will also depend
on what option is voted for on the day.
It would appear that the money is required to paint the whole of the resort, not just our properties and so this is why the costs are so high.. So why lie and tell us it is required for our own personal properties. Community Fees are just that.. to pay for the upkeep of the resort... are the banks that own the remainder of the unsold properties being charged 650 too?
I think this whole subject is quite important and is not to be rushed and there needs to be some transparency about what is really required... if there is not to be rebellion !!!
