we are trying to establish if bank guarantees should be provided free of charge under spanish law!

we have paid peinsa £700+ for ours!

would be interested to hear about others charges for bank guarantees!!!

looking forward to march???

It is down to the builder to provide the bank guarantees and should be free. We have not paid Penisa for ours nor have we paid for our renewal as our first expired in July.  Your solicitor should have sorted this out. Hope this helps, sue

Your soliciter should be shot at dawn for that! Its very clear under Spanish law that bank guarantees are the builder's responsibility and they have to provide one free of charge. If the soliciter tells you otherwise then they are either a) Not up to the job or b) probably taking a cut from the builder. Either way I'd change your soliciter if I were you. I had to press mine into sorting it out, but they did eventually.

We paid over £1000 pounds for our bank guarantee, through the eyeonspain website we found out that it was the builders responsibility and when we told our solicitor, she said she would speak to the builder, we are now getting the money deducted when we pay the balance on completion - that remains to be seen - maybe we should make sure we get it before completion - what do you think Paul?

If they are going to deduct it then thats OK  - make sure you have that undertaking in writing though!

Hi

It is nice to see that somebody has got their money back!

As per my PM's,  have stated many  times to many correspondents that paid for bank guarantees are a con as they are free in Spanish law, so if your legal representative has charged you, get your money back.

As for conveyancing-solicitors fees, nobody should be paying more than 600 euros  plus costs, if you are you are being ripped off, the Spanish pay around 350 plus costs per house purchase, they pay nothing for a sale as there is no liability if you are selling and always ask for invoices from the Notary, tax Office Etc. You have been warned!!!!

Here is a copy of an email I received in April regarding Bank Guarantee's. I hasten to say I am still waiting a reply. I have emailed him again and will keep you informed of any updates I receive.

Dear client:

My name is Juan Pedro Pérez Quiles, I´m the lawyer in charge of negotaitingthe sale and purchase of the housing in Calas del Pinar (Spain).

 Last week, I requested the promoter their corresponding bank guarantee´s renovation again, and they told me that in two weeks it would be prepared.

 Regardin the situation of the development, the work has just begun. The promotor is istalling the streets, sidewalks and public lighting in the area.

 The promotor cannot tell me the exact date for completion.

 In this week I have to go personally to the area to verify the situation and to speak with the promotor about the situation of all the clients.

 I will keep you informed on the situation.

I am still waiting
