Mr, C  Cough whoops ,its back again

You post on this forum with seemingly little other reason than to upset those that have everyright to put foward their views.

The forum or its members ask a civil question for help and assistance regarding information you say you have regarding probably the most important issue relating to Santa Maria Green Hills

You then post a couple of waffle comments so I trust the information will not be forthcoming,.information that I can assure you others are very interested to hear including me.

Think now the forum should be allowed to move forward and please dont let the door hit your arse on the way out.

You know Dan, you are your own worst enemy. NOBODY will post on here because of the rude  and insulting way you respond to posts. Your response to Chris is a prime example.

 I actually have Pm's stating that fact. If I were to show you examples you would say I made them up.  In future I will not respond to you. I will respond to genuine people on the forum, if anyone bothers to post. and if I can offer any advice that may be pertinent to them.

 People pm me so that you don't butt in and rubbish everything I say.   99% of the Pm's that I receive are from people who want to get rid of Green Hills. They are not interested in your posts which have no information or value to them.  In retrospect you do not say anything of value you just insult people.

100% of the P/Ms I get are from those that have completed,those that are considering completing and some undecided.

Those that dont want to complete would clearly not wish to look at other options as their minds are made up and I fully understand and respect this.

I dont care if they like me or not as I take the time to post as much of a balanced veiw point as I can and if that means not agreeing sometimes.then thats tough( you are welcome to post any P/Ms regarding me as I have no problem with anything I  have contributed)

I asked a very sensible question,received a load of waffle and light hearted banter and I ended my posting in the same vain which is the whole issue we are trying to get away from on the forums.(I am sure Mr C like myself are very capable of exchanging views even if it results in banter as we have been around the forums long enough to not take it personally)

We have the same star sign and very much the same sence of humour and very capable of posting each others views without the need of help

I really do hope that you reply to my postings as we both represent by the look of it two sides of a very mixed legal mess which is great worry to all of us.

Surely it is right that viewers and those with issues relating to this development are able to see both sides of the situation.

None of us fool ouselves in realising that those that have completed are in a potentially difficult situation and those that do not wish to complete are having to shoulder heavy losses.

Please can we get the forum back on track without banter and any form of future insults then none of us would get the hump and then bore the forum with tit tat comments.

This way we would have no reason to have anyone upset and have reason to post complaints to the editor as healthy debate and arguments are very close at times in tense situations and the last thing we want is for any comment to be taken out of contex to cause any problems,do we

Perhaps I am not as alone as you feel as it appears that the thread has attracted a fair amounf of interest and 7 P/Ms that are eagerly awaiting a sensible reply to a straight forward question.

 Either your here to offer help and support or to play some silly game with your friend with our development.its residence or those that are using this forum to seek important information both good and bad regarding the problems they face.

As the  is still burning, thought I'd keep you company for a bit.

Firstly I must admit I find it rather strange that if people want information as to whether to complete or not then why they send you a pm instead of posting their questions on the forum.  I can’t imagine how anything that I know can be of help to you now, especially as you have already completed on your apartment a considerable time ago and have stated how very happy you are.  And as I posted earlier (5th Feb) with my link to a previous post of mine on another thread, I have already explained my situation on the upper blocks which were never built and how I went to court and obtained a total refund of deposit plus legal interest and costs.  Not much help to people in a dilemma re. the lower blocks I'm afraid as the two situations are obviously very different.  The lower blocks is still a dilemma for me, what more can I say?

However, I think I have the answer to your flattering persistence that I supply information to help others generally re. the lower blocks.  I have just received a pm from someone giving me a link to another forum which concerns Green Hills.  There, someone has made an excellent post giving a synopsis of the situation and the various options open.  As it is such a comprehensive reply in response to a couple who are in a dilemma and requiring help, I feel it appropriate to copy/paste this all-encompassing and illuminating (excuse the pun) information here.

Do hope Dan that this will satisfy the many questions that you and the seven people who pm'd you may have.  The last sentence of this post sums it up exactly.  Hope you find it of interest.

Sorry to hear about your situation and you will find that Green Hills is just one in a similar position.
Not only does Green Hills not have an licence of occupation it is classed as an illegal build.
This illegal build is not withstanding that it does have planning permission to build,however it has been caught up in the corruption of the Marbella Council saga.
There are two sides to this situation and I am afraid to say there is no defined answer to your question but the choices are clear
1 Carry on fighting your case.(if you are not in a position to complete then fight like hell to get your money back)
2 The developer is not in the best of financial states and if you won then getting payment would be very difficult unless it was a claim against the Banks (this may prove to be difficult)
3. Dont complete and walk away and the advice at the moment is that the no one would attempt to try to claim any further for any looses they incur.
4 The advice is clear and that is you should not complete without all of the paperwork in place and that applies to thousands of others that are in the same situation
5 There are many however that have taken legal advice and are confident that the licences will soon follow and have decided to complete to avoid loosing a subsantial deposit and as far as I am aware simply love the development.(which is more than can be said about most other properties on dozens of other developments)
6 There are also many that predict a downturn in property values which would offset losses in loosing the deposit(however Green Hills was well priced against other developments in the area and price falls of those predicted may not follow here)
7 There are also many that feel that over the longer term Marbella will fair well on the financial front and this development is in one of the best areas on the Costa de Sol and the fact that building licences are no longer available it could work out well in the end.
If you bought for short term financial gain then forget it,If you bought as a holiday home,second home or medium to long term investment then the reasons you decided to buy are still there.
Those that havent completed, those that are trying to not complete including many large number of investors ,those no tangible interests and many solicitors will tell you not to complete and there is no argument to that.
There are some like me that listen to the facts that a successful legal solution will unlikely succeed in this case(you would loose further money in fees) and have decided to complete and none have regretted it as at the moment we have something, being a property instead of just deposit which can be lost tomorrow.
We all probably have had sleepless nights over properties in similar situations and the only comfort I can give is it really is a very nice development and is maturing very well.
Sorry I cant give you the answer you are looking for and feel that the answer is not there and is going to be down to each of us to make our own minds up after obtainng information from every source.

As can be seen from the hits on this subject that many have shown interest and have chosen not to post and who can blame them, still at least someone was able and willing to post an accuarate up date which you kindly copy and pasted for us.

Why not try just restricting your posts to actually contributing something "excellent and very informative" like I did yesterday.  It might just try helping "those with problems".  Your pathetic and incessant sniping doesn't.

Well, that's a start I suppose.

Even the information offered in this particular post I pasted from another forum should really be taken with a pinch of salt as at the end of the day it is just one person's opinion who may even have a hidden agenda.  Who knows.

That's what forums are all about.  Obtaining as much information as possible.  Then making up your own mind based on which posters you have faith in, and deciding on who is to be believed when it comes to an unbiased viewpoint.

As I have said I do thankyou for posting the information from the other forum and as we both agree that this was an excellent posting perhaps on one point we should agree and form a basis to build from there.

I am sorry to hear that somone has sent a P/M saying I am disruptive and will of course fully take this on board ,however this happens when in these case the minority being the residence try to voice their views

I have posted a true and honest account of the situation at Green Hills and feel that perhaps my postings take into account of the full picture and not to the liking of some that wish to bury their heads in the sand.

As can be seen on the postings we have those  residence that were willing to post in agreement with my comments and would encourage as many views as possible to help both your goodself and many others with problems on this and many other developments.

At the moment I cant seem to agree with the comments from the P/M that you have posted informative information but I  am sure that I must have missed something.

As you say all should be welcome to post and that way we wont have the situation that no ones listens and the lights need turning off..

Your correct that I post on the other forum as ,Just Frank and most people that I am helping are well aware of this.

You are also correct that much information posted on forums should be taken with a pinch of salt and these are just my views.

We all post these views in the hope that there may be some points of value in trying to help the best we can.

None of us have the answers and that includes the solicitors and if we all contribute then perhaps those that need help can form there own opinions based on the information gained from our experiences

Lets continue to post and agree that everyone is more than willing to contribute without the need for sarky comments which have no value to the forums.

I am interested in getting together with owners to see how we can move forward.

Seems this development has been made out to be one of the only ones with problems and is being profiled as being a dreadfull place which is far from the whole picture.

I fully understand those that have chosen not to complete but thats the same on dozens on other developments.

Lets have a forum thats shows the total picture and glad someone is at least trying to do just that
