Hi everyone

I am astounded that some of you have still not completed, my solicitors put pressure on me as they told me if I did not I would loose my deposit and have to pay interest.  They had received licence of occupation and that was all that was needed for me to complete, I even went to another solicitor asking whether this was indeed the case and was told that it would be difficult to try and delay on the grounds of unfinished roads lighting etc. as the apartment was ready to occupy. 

On the up side I have spent five weeks in my apartment and had a great time dispite lots of unfinished area's it is still a beautiful layout and the views are fantastic.  Some of you are saying that the bridge is being built over the toll this should make such a difference to access.

Hello all,

When Eralia sold these apartments, the whole site was to be completed before any were to be taken over and occupied.

With no helicopter pad, no motorway access etc. etc. How can the site be said to be complete??

How can you be forced? Surely you were just advised to do so by your solicitor.

Many of the developers here do not supply what was promised in the brochure, by the sales staff,and agents,  yet they seem to be able to get away with it by threatening loss of deposit. In this they are often supported by "your?" lawyer who seems to act more for the developer than for you.

Penthouse buyers could surely not be forced to occupy without lifts?

Eralia were considered to be one of the better developers.

What has changed? Surely the contracts must be honoured as signed, whoever has bought them?

The off-plan business here seems to be very very risky.

I agree with you Norman.  It always comes back to the solicitor you go with.  My solicitor made sure that our purchase contract was watertight before we signed it.  Changes were made to the original contract produced by the developers to make sure that the completion clause was more specific and would not only be when the building work was finished and the licence of occupation in place but that all the facilities on the development were completed too.

When we buy properties in the UK we all take as much time as we need to make sure we are happy with everything about a property before we exchange contracts.  How much more important it is to do this when we are buying in a foreign country with a system we are unfamiliar with.  I found out as much as I possibly could about the Spanish buying system so I knew what questions I needed to ask and then emailed many solicitors, choosing ones who were based in Spain (had nothing to do with the developers!) and who had English solicitors as well as Spanish.  Believe it or not, many did not even reply, but one stood out above the rest because he took the time to send me a lengthy email full of excellent advice before he even knew whether I would go with him.  I did my homework but I was also extremely lucky.

All that said, I'm dying to complete and start enjoying the property like so many you already have.  I just hope the developers want the rest of their money badly enough to get their collective fingers out and get everything finished!
