We have received an email attachment from Seasun which is an invite to the first Community Meeting on Saturday 8 March at Hotel Mexico.

Luckily we are going over from 7th March - I will be taking some notes - not sure if the meeting will be bi lingual (we have some knowledge of spanish but not enough for a public meeting lol)

Some of the message is:

ORDER OF THE DAY
 
  1. Information of the administration of the community of owners.
  2. Election of Meeting Management (President & Vice-president.)
  3. Approval of the quote from 1st March 2008 to 28th February 2009.
  4. Approval of distribution quotas of the community from 1st march 2008 to 28th February 2009.
  5. Community Issues:
Ø      Norms of coexistence & statutes.
Ø      Security.
Ø      Awnings.
Ø      SPA
Ø      Satellite
 
  1. Authorization to the president of the community to grant powers to professional and legal representatives of the community, so that in representation of itself, they carry out appropriate judicial reclaims for the cover of existing outstanding bills in the community, and for any other related issue, for what is deemed necessary intervention in the interest of the community in name and representation.
  2. Requests and questions.
 
Given the importance of the subjects to be discussed we request your personal attendance in the case that it is not possible to delegate someone to represent you.

“Will loose their right to vote, as the article 15.2 of the existing LPH, those owners who at the time to start the board would not be updated with the payment of all past due amounts to the community or have not filled a legal complaint to the above mention payment, or proceeded to deposit into court office the amount, of notary appropriate past due amounts”.

Following on regards this meeting, having recieved our notice of the meeting we will respond to Seasun seperately anyone wishing a copy please advise by pm,

1.Were we not previously advised that KM were responsible for the community costs ubtil conclusion of this meeting? what was the initial 150 euro fee to KM for, and why now another 100 euro to Seasun?

2.Who is responsible for accepting satisfactory completion of the communal areas from KM? Ipresume they will be as bad to deal with on any defects to these as they were on our proprteies?

3.I thought it had been stated  that until a certain percentage of properties were completed to the owners this meeting could not take place?

4.Is anyone going to tell us how many remain unsold?

5.The statement at the end of the meeting notification appears to suggest we cannot vote unless we have paid the 150/100 euro fees- again surprising seen as KM are responsible for these?

6.Do we have a right to be given a breakdown of actual communal costs as opposed to quotes for the past year?

7.How do we obtain evidence that KM are actually paying fees on the unsold units?

8.Has anybody seen quotes for this year or distribution quotas?

There must be more that I can't think of yet! lets hope the weather bucks up PDQ to take our minds off things?

If what Kaz & Bob say is true, and i'm sure it is, then we have potentially an even bigger problem as it seems a number of us have yet to be able to pay the 100 Eu to Seasun, and thus currently have no vote, proxy or otherwise.

I would be interested to confirm whether the additional 100€ payable as a "top-up" fee will be deemed "outstanding" as per the date of the meeting (8/03/08) if one hasn't managed to get Seasun House to take the damn money!!

I have tried on numerous occasions to pay this amount, but due to there not being anyone  to assist me at Seasun House, I have had to walk away without paying. I know that we have received a direct-debit form asking for our bank details, but does anyone recall having already given this information on completion day, or did I dream this?

I am concerned as to the amount of personal information being bandied about by both KeyMare and Seasun House. Where does the responsibility regarding the safety of this information stop?

How can the 100 euro 'fee' be anything to do with community charge if KM are responsible for this until conclusion of general meeting? Has anyone managed to find out from Seasun what we are being asked for 100 euro for? As usual I await Seasun response to my queries!

I have just received the email from Seasun.


I have emailed my solicitor as I am not sure on two things

1 - I am nominating a proxy voter on our behalf, who & how do i inform Seasun/KM of this.  I guess its just sending the form back to them, but its not clear

2 - We have not paid the 100 Euros, does this forfeit our right to vote, from reading this forum I dont think its clear who to pay the money to?

Hope the lack of direction from Seasun is not a sign of things to come

We paid our €100 by bank transfer from our Spanish Bank Account direct to the account number that was in the letter from Seasun.

My understanding is that if this has not been paid then you will not be able to exercise your vote.

Again, my understanding is that KM are only responsible for paying for the apartments not yet sold - the responsibility for paying for the cleaners, gardeners etc etc lies with Thalassa owners & that is why we have been asked for the additional payment.

Luis did send out an updated quota a couple of weeks ago, indicating how much the fees are likely to be for each apartment. If you haven't seen this, please PM me & I will email it to you.
