Hi tricky

Are your guarantees dated?  If so, then they expire on that date!!!!  So watch out.  Jethro has the details of a good independent firm of solicitors who are, unlike Aldea, willing to fight your corner.  I'm sure he'll provide you with their details if you PM him.

Hi Tricky

I had no response to lots of emails I had sent so I contacted their sales department via email and had a moan.   The next day I had a response from the after sales manager, Nina Turnbull who said that all the email addresses had been changed some months before.  She said that she assumed the IT department had arranged for emails to the old addresses to be forwarded to the new ones.   Of course, they werent!!

I hope you have had chance to read the latest I received today (new thread) which is interesting reading.  Looks like its going to be another year before we get the keys.  A lot of staff have left the company but according to their TV channel on sky, they are committed to their clients and their staff.   I hope you get some news soon, youve paid alot of money out already.   Its just so frustrating, we knew things wouldnt go without a hitch but this is crazy. Its a good job that we're not in any great rush for the villa.

Hopefully, we can all get together soon at ACC.

Hubby and I received 2 gorgeous Christmas cards. One from Huma and one from Parador. I'm sure other buyers did too, but it's nice to be remembered.

We received a card from Huma, but are obviously off Parador's Xmas list. Glad we've annoyed them so much that they took the trouble not to sent us a card.

Christmas wishes to all and lets hope that in 2007 we may be able to take our xmas break in the sun,in the Almanzora country club!

Well fingers crossed for work to restart early next year, i think thats been on everones wish list for christmas.

Merry Christmas and happy new year to all our prospective new neighbours at Almanzora. We did receive a card from Huma but nothing from Parador, nice to know that our 'owners club' membership means so much to Parador. We have got more accurate info from this forum in just a few months than from Parador in almost 2 years. Let's just hope that things get moving early in 2007.

Ah Yes! Join the club one and all.   Yes I too got a card from HUMA, nice of them, but nothing from Parador.   And who said it in't all boo, baa, and humbug!   Hopefully the new near will bring us all together.   All the best wishes for 2007

I think most of us are all now feeling more positive about it all.

After such a long delay to the building works (over a year stopped!!) surely we must be nearing the end to this wait and see work re start.

We've all seen the nice brochure, the letters, the Christmas cards which is great I'm not criticising. All we now want are sets of keys to the properties we have purchased and contracts fulfilled without further delay.

January is supposed to see some moves towards this happening. Let’s hope so.

Hi & A Happy New Year to one and all

After a year of anxiety and frustration we are feeling much happier and more positive about ACC now and even a little bit excited!  We have received a guarantee for the first payment but not the second although Huma says the delay is with the bank and not them but hopefully if the building is restarted we wont need them anyway.  Wonder if we will receive any sort of compensation for all the axieties we have been subjected to over the last 18 months?

(just my view, I'm not an expert)

With regards to any compensation. Once your contract has expired (six months has also expired) which means your property has not been delivered on time - you should be offered compensation of some sort because the developer is in breach of that agreement. ........Although realistically noone will offer anything so:

There are two ways to go about requesting compo.

1/ Legally via solicitor (which obviously costs you something)

2/ On an individual basis with the developer.

The developer has said that compensation will be offered on an individual basis. This is then subject to how much over- run you have on your contract, any expenses you have incurred and what you are requesting as compensation.

Some people will opt for things like appliances / air con / furniture as compensation others €'s. Each case will be different.

When does your contract expire (including the 6 months) ?

i would like to add that the 6 months extention does not apply in humas case because they did not have the licence in the first place, this we have been informed by our lawyer, so one can claim compo after 18 months

Thanks for your feedback.  We purchased in March 2005 so the 18 months + 6 months is up in April 2007.  Perhaps we ought to think of a group compensation request as there seems to be a lot of people in the same boat!

Unfortunately I also seem to be the bearer of some more bad news!

Friends of ours who live in Spain visited the site on Friday (05/01/07) and spoke to a Roberto Calle Gonzalez in Sales at the site.  He told them that there is no intention to start building for at least the next 3 months as they haven't got all the permissions and there is still a problem with a license!!!  He also took them to look at our property on Manza 4 (27) and it had not even been started even though Huma sent us some pictures before they stopped building of a property that we were told was ours and the outside shell was up! 

Just when we thought some of the worries may be over!!!

I paid my deposit over 2 years ago, yes and am really fed up.

The builders were in breach of contract with us on 30th December 2006, so we are now legally in the right to pull out.  I have been waiting patiently but this has now run out.  The only thing is Parador don't want to know and when I mention this to Aldea solicitors they are very slow at coming back.

I am now about to begin the process of claiming my money back + compensation, all in all they have had £33,000 for over 2 years and nothing has happenend.

After waiting over 3years we have had enough with not getting any info from Developer or Agents Just Glossy magazines and promises! we have instructed our independent solicitor to start legal procedures against Huma to get all monies back plus compensation.

This has not been easy as Huma REPEATEDLY REFUSED to speak to our solicitor.

 We have been informed that this process could take up to a YEAR!

Hello all,

Have just returned from visits to site 4-6th jan 2007 after paying intial deposit march 2004 work is still in progress and agents rep.present on site at time of unanounced visits.Show homes  built on site and able to view, i have returned to uk reassured that on the basis of what i have seen, albeight that it is behind schedule, a lot of investment has gone into the devolopment and it is just a matter of time before hopefully all problems are resolved.

I'm not sure if you have been misinformed or if you know the full story. (I'm sure you do).

But building STOPPED 14 months ago by Court Order. So absolutely NO progress has been made apart from the building that was done back in Aug - Nov 2005. Granted, the developer did get a considerable amount done in a short time.

Behind schedule is an understatement.

This situation for all buyers is a disgrace and nightmare and a resolution with restart to building must happen sooner rather than later. If not , it will all get very messy..........

People are now queing to get FULL refunds, plus interest , and you can't blame them. Enough is enough for some.

Personally I am hanging on just a little while longer. My belief is that we will see the licence granted very soon.  After all, I've waited nearly 3 years !!!

I was under the impression that the lic was granted in october of last year,

as detailed in the glossy brochure from parador?

In addition the information from  parador concluded that work would restart early in 2007.

I think those people wishing to claim a full refund +interest/compensation are doing themselves a diss-service,the value of the development will far out reach the figure paid in refund/compensation (i hope as i am intent on hanging on untill completion,that is if we are still young enough to get there)

Serously i feel that work will restart very shortly and it would be a shame to get off now!
