We are now on our third solicitors and several thousand pounds legal fees later.

We moved to Andersons in late last year and we instructed Miguel to take Huma to court for a refund.

We were told that a Writ would be ready end of January.

I have sent emails in Februrary & early March with no response. So I rang today and his Assistant Luisa says the Writ is not ready and might be now in April probably. She said he was very busy and had other clients than ACC ones and Huma was very complex and needed a lot of time. I am really glad to know he is very busy and raking it in! I did not get any confidence from what she said - making excuses about Easter and holidays.

This is a deja vue, everytime I have changed solicitor - the new one has been appalled at what happened before and promised me the service was not acceptable and they would not treat me the same. But here we are again -  talk to you for a couple of months after you pay - then there is no ostensible action and the principal ignores you and the same excuse of being too busy with other non ACC clients.

Miguel of Andersons was very efficient in faxing for my credit card details back within minutes of talking to him in October/November last year - but I appear to be in the same position 1,700 Euros later.

I started with Aldea - completely useless - I did manage to get my fees refunded eventually when I threatened to report them to the regional College of Lawyers (like the Law Society). I then used Plazas Abogados Sl, Cadiz on the recommnedation of a fellow EOS person. In the end they just ignored me totally and the principal would never talk to me - even about complaints of bad service and his assistant was permanently out of the office!

Are you an Andersons client? If so send me a private message and I intend to try and force some action (if you are getting the same problem that I am getting). I know Andersons are representing at least 40-50 ACC clients.

If you are trying to get a refund via the Courts - what is your experience? -  Has your solicitor actually delivered a writ to the court?

I am beginning to think that not only Huma have taken us for a ride - but the whole Spanish legal system sees us as a target to rip off too.

I really wonder if any solicitor is serious about taking on Huma in the Courts and is there some dirty dealing behind the scenes - collusion and corruption?

It is time everyone stopped being embarrassed about the situtation - the most intelligent person could have been duped by Huma and we must put our stories on EOS as I suspect Huma/spanish solicitors have have a real laugh at the expense literally of all of us!

I am an accountant - I believe it is possible Huma could have 1,000 deposits on ACC @ £35k a time average.That is £35m - the interest on that @ 6% is £2m per annum. We have all paid over £3m in legal fees - for what?

When we bought at ACC, we bought a plot that already had been sold - but we were told had become vacant suddenly due to someone dying. I am now beginning to wonder - if plots have been sold over and over again and if in fact - some of us may find we have not actually bought anything at all - if it is ever competed!

No doubt ACC money has been used to purchase the new Desert site and here we go again! Hence bouncing cheques! However, from what I have heard the real estate in the desert is not exactly prime land - so I would suspect there is quite a bit of change out of £35m after ACC expenses to date. If cheques are bouncing - where is the £35m?

This is only my opinion and if you think I am wrong shoot me down with pleasure  - please post a reply if your experience is different or you think my thinking is floored.

If you are not at the end of your tethers like us - you must be mad by now!

I have stayed silent too long. I am really mad a new site is opening up and there are no refunds for ACC - are you?

I need to get evidence of as many cases as possible together - so I can persue this at Government level and at the Spanish Law Society equivalent - this scandal has to be stopped - Huma must not be allowed to continue trading like this! It needs high level action and embarrassment - but it needs facts not opinions.

I feel for you mate, I do...... - in a similar boat myself.

You mentioned the Spanish law society, have you / did you get any details?? I have struggled to get this, can you help?

I have details for an English lawyer in Spain, u can if you wish have these but following from your own experience, I personally cannot say what this guy can actually do or deliver...you'd have to find out...

Hi John

 We appointed Andersons beginning of Sep 07 so were in the same boat as you .We emailed Miquel and he didn't reply so we emailed is secretary ,she said at the end of Feb the papers were being drawn to Huma they have 2 weeks to respond , if they ignore them then court action would be taken that is about now, so we have emailed Andersons to find out whats happening i no the courts have been on strike  , i will leave it a few days for them to reply , so if its any consolation i no what your going through ,how can this happen and how can they  get away with it ,hopefully watchdog will help or even if they cant they might be able to give some advice of who can ,there has got to be some law against this scam don't give up some things got to happen because this is doing my head in ,ill let you no what happens and if you need more evidence count me in. good luck.

Similar story here. We were assured that all licences were 100% legit and that Huma were one of the best builders in Spain.

My wife had her doubts about the project from the kick off and I talked her round, you can imagine the grief that I have been getting since things went pear shaped.

We are heading out to Spain in a few weeks to see for ourselves what the MCC and TOCC have to offer, I will be acting according to what I find and will post here with any conclusions when we return.

The reports are that 50% of estate agents on the Costas shut down last year, what does that tell you....? The market MUST be decreasing and that should be reflected in the prices. Huma are not offering anything when they talk of a swap to MCC or TOCC. Like someone else said on another thread, MCC houses are the dregs that they cannot sell. TOCC is being built in an area that experiences extremes of temerature, hot as hell in summer and freezing in the winter, happy holidays!

I agree with the comments about the lawyers, they would get struck off here, I'm told that the Spanish law society don't give a monkeys about how the lawyers act.

If you have a BG Ok ,you have a third option but for many who do not then Oasis Tabernas or MCC is a 'real life option'

Please see my other posts

there are a lot of people with or without BG who are now looking at OCC and this option may not be available for long

And as an agent we are now starting to sell OCC ....Tarifa at 147.500 € when I have, and many others are doing , changed from ACC at 119.000 € ready mid 2009 phase 1

I would prefer to sell you a maisonette on Polaris World for 119.800 € if you get out via your BG !!!

But you should look at the OCC option ASAP

By site rules you are not allowed to put commercial  adverts of properties you have - see rules below ...

I have asked EOS to bar you from this site for your offence.

Also you post a message on virtually every thread - to get your name and service in front of all us unfortunate ACC buyers. Most people on this site now posting are more bothered about refunds than waiting another 2 years for an overpriced (unsaleable) property in the desert (that no doubt will not be built too - as the Huma have found a way to scam miliions from gullible Uk buyers - so why stop now.

My thread was about Andersons and solicitors in general and refunds via the Court - nothing to do with flogging other sites - than you.

Also your comments and speculation in the past has proved wildly wrong and inaccurate.

If you are such a great property advisor - why have you no BG and got caught up in ACC (if that is true?) - your judgement is floored - Why should anyone listen or want to deal with you!

It may or may not surprise you to know that a lot of information I have posted has been a great help to other people in the same position as me on ACC

Many have been in touch and there is no sales pitch for OCC  or MCC as agents get nothing for people changing

If you have a BG and are able to go to court, then good luck and if I had one I may possibly do the same

No purpose in going back over the history but not having a BG just shows that agents are 'human'...and I am not the only one!........in the property business and any other  no one is perfect!

As regards this ACC forum, all I am doing is replying to posts when I get notified as ACC is now history ....and a re start when it happens will be some way off  

This we all know because the local plan was sent back by the Junta for revision by the local council

The main purpose of this ACC forum - is now obviously to see how we can get our money back - no matter how impossible it looks! All you have done now is swap one problem for another. We will see how it works out!

I suggest you ask to start a new Forum  for the desert rats!

There is to be a worldwide recession - Property investment companies are failing and closing by  the day  (many going bust). Investors are diversifiying by the minute worldwide. 

Large housebuilders are cancelling project wholesale worlwide.

That is now the truth. Government Banks have failed to increase liquidity in the banking system after pumping in billions.

Property prices will fall everywhere.But how much 20%, 30%, 40%, 50%  ... who knows?  There is no demand as there is no money pot to lend mortgages.

The stock market and world confidence has been fragile for ages. The market FTSE index was at 6700 in 2000 and today has never recovered and is plunging again to 5700. It will only take one 911 or a major bank crash to kill world sentiment. The stock market is lower than 8 years ago - great investment in the new millenium unless you bought at the bottom of the market. The market was boosted by mainly dodgy credit - and the day of reckoning is coming - Northern Rock is not the first - there are other financial institutions around the world and in the UK - under intense pressure of failing.

The credit crunch some people predict will be with us forever - as Bank stocks have lost billions and now will not take any risky option on for several years to improve their share price.

SO ALL BEWARE - MOST PROFESSIONAL INVESTORS HAVE ALREADY CLIMBED OUT OF PROPERTY & SHARES - and sitting on cash and fixed return bonds - they understand what is happening at the moment - mortals like us are the cannon fodder! See how your pensions have deminished over the last 9 years.

The above -  I call useful advice.

I hate to be gloomy - but this is reality NOW and for the foreseeable future.

The other bit of useful advice is can anyone produce a single Huma customer who thinks they are wonderful and delivered what they paid for? Why should you be any different.

Good luck to all who sail in the good ship Huma! - but watch for the icebergs - they are never far under the surface in icy waters - though on top - it looks ok!

I want my money back - not a hundred milewalk to a beach! Can't see much rental income from that or resale value. from the desert! - when  there are so many coastal properties for sale at reducing prices by the minute!

I realise you are stressed and frustrated Johnfozard but slating Rowlandsbb is of no help to anyone.   Rowlandsbb has taken the choice that suits HIM best, it may not be best for everyone, but that's what he has chosen to do and you should respect that decision.   Rowlandsbb has always been professional and has given some good solid advice on EOS.  The point of these forums, especially where ACC is concerned, is to share thoughts, views, advice etc.  Have you emailed Thomas.hewitson@bbc.co.uk with your tale of events?   If you havent, why dont you vent your frustration there.

I believe china is pretty good for investment at the moment and as for the last share crash you could pick up a few blue chip companies,and some others with fantastic potential,i managed xtrata at a gift and chorus at an absolute gve away to name but a few thats what i would call some great advice at this moment and then if all goes totally down the swanney we should all be able to afford a round of drinks..preferable around the pool.

Yes, I am interested - what good solid advice?  I am afraid I can only see self interest and an obsession with big fat profits.  And before anyone starts saying it is no good turning on Rowlandsb - I will just point out that I have been saying this all along.

Whatever is being said on here - it is nothing to Viva-Almeria, though I am sure Rowlandsbb can cope with the criticism!!

Hi everyone,

We have had a half built property in Almanzora for the past 4 years or more(its been so long now iv'e forgotten). we have now moved to Spain, and now have a Spanish Lawyer involved. She is pretty good, but as you guys have been told different stories so have we, we were told that as we have a BG we could just go in to the bank and demand our mony back, then another tells us we can't. We have asked for some info from our Lawyer, i will let you know what she says, might help a!!

Ok, maybe the advice wasnt good and solid but was always an "interesting" read.  My point is - we should be sharing information and supporting each other in the mess they call ACC, not slating people for taking other options offered by HUMA.  Truce?

i agree, we should try and stick together, if one person has some info, and another has been told something then we should share because you never know, if one person wins something that might help the rest of us. i agree though if other people decide to go with an offer then we shouldn't slate them because that is their decision, and we have no right to critisise(can't spell) we all got hood winked after all

I have concerns about the offers from Huma (besides their obvious mistreatment of customers regarding legitimate requests for refunds).

The tarifas were a popular choice at ACC because of the roof terrace, in comparison the MCC properties appear to have limited outside space.

The climate at Tabernas is described on many websites as being 'EXTREME'. Some sites quote temperatures of 45c in the summer and -5 in the winter. So in the peak summer i'm forecasting having to stay indoors with the AC at full whack and in the winter having to reverse that to trying to stay warm?

My advice is "Don't rush into anything"

Huma are Spanish bandits and until you  have something to show for your money - why be naive have we not lost enough!!!

Tread on eggshells.

Just be careful and not foolish.
