ON Wednesday I went to see Oasis Tabernax
It s a nice inland site with great views 1 1/2 hours from Granada airport and 30 mins Almeria
They have started the landscaping and the sales office is there and has staff- Carmen who lives in Tabernas
Had a meeting with Huma Friday
The PGOU has not been passed and queries have been raised by the Junta
Huma and no one else know when everying will be dealt with- they still expect ACC to restart but it will not be soon
We do not have a bank guarantee as we were one of the late buyers so wanted to consider all option
There are still some at MCC
Oasis has all the permits and building licence for first phase-I have seen and have copies of all permits
Guarantee is from ACC Serquros which is an insurance company which is OK
Start date is late March 2008 and I got the impression that they will not mess about
Build time is 15 month and the normal buffer clause of 6 months
I asked the question? If ACC re starts before Oasis is ready can we move back to ACC?
The answer was YES
Oasis is being built by Huma Indalo and we did all the paper work on Friday-Cancellation contact ACC, reservation OTCC plot 11 , an option to go back to ACC Our deposit pàid in October 2005 is in the account of Huma Indalo WE will have the full contract signed circa 3-4 weeks and the guarantee
So at a stroke our money is guaranteed, we have a Tarifa at 119.000 euros ready mid 2009 and can still go back to ACC if we want to
Huma were very straight forward, efficient and this is an option everyone should consider
If you want Spain now then MCC is th e way to go but few left
Getting your money back will be a slow proces as the banks who financed ACC and taking a budget approach to repayments and you would just have to wait your time
Made our decision and now we have security for our money
So think about it and to all those who thought their money was at a big risk- it is not now if you want to take this option and still have the same Tarifa

I am glad to see that some people are posting positive remarks about Huma.
We bought on ACC and only had part guarantess we decided to move to MCC which now we are really glad we did. We found HUMA really efficient and no problem to deal with we signed a cancellation contract and a new contract last March 2007. We got the keys Oct 2007 and we love it. Even if ACC got the go ahead I dont think it would have been right for us now, we now see ourselves living on MCC where we didnt on ACC.
We decided to move on and buy on MCC and all the stress disappeared literally overnight!

Sorry....we dont share your positive feelings about HUMA.
This company are making you buy one of their products by being less than ethical / professional/ moral about the return of deposits following breach of contract.
Whatever way this is looked at they SHOULD NOT BE BOUNCING CHEQUES AND INVITING COURT ACTION.
Go ahead and buy from them but there are a huge number of people who simlly do not trust this company.
Good luck with your plans,,,,I wouldnt wish what we are going through on any ACC buyer.

I can see a temptation in moving to Oasis to secure your money if you have no bank guarantee but how do yiu know HUMA will give you one when you have transferred over? Are you relying on HUMA being honest and after you have signed the paper work giving you a BG? I was suppose to have one on ACC (says so in my contract - as everyones did) but never got one. I purchased in June 2005 several months berfore biuilding work was stopped so there was no reason not to give me one. I personally do not trust HUMA to give me one.
Also in connection with the Oasis project it is a long way from Murcia airport and no UK airports near us go to Almeria - this would mean a lot of travelling either in the UK or Spain.
Another problem is the site is quite away from the sea and I also understand that it is close to the desert and some of the weather can be extremly windy (sand storms spring to mind).
In connection with moving to MCC I feel this is amore attractive option as it is near the sea, near an airport and allready built. My main concern here is that the swimming pool (of which there is only 1 and quite a way from the property) is only open for a couple of months of the year and you have to pay to use it. I have 2 children - one loves the beach the other the pool and having to pay every day for a couple of hours use is not what I want from my holiday home. I also feel the property would be difficult to let because of this.
I have paid out about £45,000 with no guarantees and no solution given to me by HUMA which I feel is acceptable. If I sue HUMA for my money back plus intrest what chance is it I will get anything back? If they are bouncing cheques ther surely they must be in severe finacial problems and it must be highly unlikely that after a lengthly court battle (and even more moneis paid out) that i will get any money back.
At the moment I feel I have no options at all asnd the whole thing is making me ill. Any sensable suggestions will be welcomed.

rowlandsbb, good luck in your decision to move. Your insight to some of the problems at ACC has been very welcome/helpful - hope your move to Tabernax doesnt stop you posting on ACC as it would be a loss to us all.
I have bank guarantees (for what they are worth), so tabernax isn't an option for me at the moment as its too far in land, not what i want for my holiday home.
I wasn't aware of the pool charges/numbers at MCC - so that looks like not being an option either.
Looks like ACC is at least another year off.
Therefore I have two options:
1 ask for my bank guarantees to not be renewed come their expire time and get the money back. Loss of interest and loss of deposit - offset is the euro strength so means i should come out even(ish) and a lot wiser
2 sue Huma via the courts - I know i would find the info in one of the numerous threads, but can anyone tell me a lawyer who has had success for ACC people and what costs i could expect to pay to start the process - i take it huma have to pay court costs if they loose. Did they settle out of court nearer the time?
I have always tried to stay positive about ACC as time wasn't a pressing thing for me as it was only going to be a holiday home/long term investment, but reading the last few posts, I think enough is enough. Even if ACC gets the nod in the next six months it will still be 18 months from then, minimum, for my property as it hasn't yet been started.

Did youget any compo or any extras....................
Have they any 2/3 bedroomed property being built on the Oasis

Hi Jasp & All,
when considering your options I wouldn't let pool charges cloud your decision. Buy having the pool pay as you go it has a dramatic impact on your community charges.
On manzanna 36 which is where most properties are available the community charge is about 18 euros a month. Yes and the pool is only available for about 3 months of the year the rest of the time its too cold for me. so it has its pro's and con's
But up the road you have the hot springs of the Siera Espuna all year round great for old sportmen like me with my acheing bones.

I am glad you happy with your decision to move to Oasis and wish you well. For us there is not option, Huma are not offering anything equivalent to the Donana and we would like something we can use in 2008. We haven't any bank guarantees, despite contantly asking for one and we have a letter guaranteeing our money with them, which isn't worth the paper its written on. Huma do not know what is going on, how many false promises have we all had. I have lost all faith in them and simply want my money back so we can buy something we can use soon. Our solicitor tells me that Huma legall department are dreadful, evasive, never returning calls/replying e-mails. This is not a company I want to deal with again. We will take them to court if necessary. Sorry to sound so negative but due to family reasons ACC was going to be a family holiday home, for us and also a ill member of my family, now its too late!! No amount of compensation will ever cover that. I wish you well and a happy mothers day to all mums out there.

Hi Everyone,
good luck to rowlandsbb with your change of property. Personally I think we are going to try and either 1: get our money back via the bank guarantees as we are fortunate enough to have them for both stage payments, or 2: go via the courts and try to get all our money + 6% as per our BG's, or the final option, try to transfer BG's to another property which is either under construction with licences in place,or already built.
Tabernas is not really an option as it is too far from the coast, and not really what we wanted. If anyone out there has any experience of going through the courts with a positive outcome I would be interested to hear from them.

hello rowland,
we wish you all the luck in the world with your new off plan developement, we had thoughts about this before we bought on camposol.
how on earth did huma start another developement with no money coming in when they have a site they have spent millions on with at present no return.
i will tell you, tabernas has been marketed with all our deposits, the staff has been paid out of our deposits, i feel (maybe wrongly) this is why we cannot get our moneyback, we rushed to transfer money to masa(huma) to save the tarifa we fell in love with, why not the urgency to give us our money back, 2 years 8months is being patient dont you think.

can only agree with your thoughts and wish that this situation had not come about , if i had the choice the Acc would be well under construction and people would be happy and takeing ownership as we speak.
Second choice would be my money returned with interest giving me the freedom to look around and my last choice wold be to take up the offer of another development!!

This is a Go Site and a very good location
I am a selling agent and the Tarifa is from 147.000 euros and may be ready before ACC starts, the date of which is not known by anyone-

Has the land got permission for building on, are all the necessary licences in place. Has anyone checked at the land registry that everything is legal .
As you are selling them Rowlandsbb perhaps you could confirm all in order.

I hired a car and took a drive out to Oasis CC, it is over an hour
from the coast on some of the most scary road I have ever used
Huge moutains and steep steep cliffs, I had to stop and get directions
for Tabernas several times and was told keep heading for the desert.
after 1 and half hour I found the village........god what a hell hole,
went to a bar, the type Clint Eastwood drinks in and started to talk to
the only other english guy in there.
asked him about the area, he was an artist and said he needed solitude man,
thats why he moved to the desert, it goes well over 100 in the summer and sand
storms are regular, in the winter it freezes.
Looked were Huma are planning........it must have cost about a dollar an acre.
Huma can stick there offer up the cheating conman ar.es, I want my money back
Possitivly take a drive to the Tumbleweed club before you get conned again........

Thats a bit harsh on the village of Tabernas, we liked it and found the locals very friendly, the bars are somewhat rural but that has appeal to us. The only thing that is worring to us is that Huma gave us all the documents but the building licence was not in the pack. A lot of other ones such as insurance and bank details (where the bank guarantees were going to come from) but no actual final licence. Despite us requesting this, nothing has been forwarded to either ourselves or our solicitor. Also all documents are dated May - September 2007.... One question we have asked is for conformation from the insurance company and the bank that all are still in place. A lot has happened since 2007.
We are still proceeding with caution the other option of MCC does not appeal to us, it seems that the ACC owners are being offered those houses that no one else wanted, ie built but not sold. The other option of executing our bank guarantees and or taking Huma to court is such a strain and a worry to everyone that maybe Oasis is an easy option. Hell knows how we got ourselves into this mess!

We have been there....Its awful.
Now taking Huma to Court.....about 18 months more stress.....but tell your new employers we are going after interset, compensation and costs...NO deal on the steps of the Court !!!

But when I spoke to Pilar yesterday (Friday 7th) she said they had no plans to start on Monday and guess what.... it will be in two weeks time that they will know when they will start building.... Yet another two weeks, how many time have we heard that!
Where did you get your reliable info from? You also said the site office & palm trees were up, they were planted last year and the site office has been there for three months....

Well I am sorry to be cynical, but I think you need to go back over some of the posts on here over the past year. Rowlandsb had inside information that there would be positive news in September on ACC. Nothing posted indicates that he has any more detailed knowledge than anyone else!!!! Make up your own minds - don't be influenced by any of this nonsense!!! I have just got back from my 5th holiday in my own place since realising that ACC was going nowhere. Fantastic weather, fantastic time, and only 10 minutes from the beach. For goodness sake, think carefully and don't be influenced by any talk about this being a GO development in Tabernas or anywhere else!!!!
