Hi

Can anyone recommend a good Solicitor in England or Spain to obtain our refund?  Not happy with our solicitor, they have quoted us over 10,000 euros to take Huma to court which seems a lot to us and we are owed around 78,000 euros and we do not have a BG which our solicitor should have made sure we had in place before parting with this money.

Is the amount they are charging us to much or about right?

Any advice appreciated!

Hi we have looked at solicitors in uk but are still waiting to see what happens , because our solicitor is in the process of taking Huma to court we have paid out 2000ero,and on our second solicitor now Andersons, the first one who were recommended by Focus real estate didn't help at all or get our B/G when we paid our money so were like you no B/G , we are looking into everything to see who can help hope this helps.

  It may be worth trying to negotiate with the solicitor re fee's.

ie. Agree to pay 2000€ 's to take the case to court and on the proviso they win the case PLUS, ALL  costs, interest, compo etc.. etc... They then get the final agreed amount or %. (taken from the award) Similar to 'no win no fee'. If they don't want to talk. Move on. I wouldn’t pay 10000€'s up front.

 Also remember , the solicitor, agent and the developer have acted illegally by not supplying you BG's for your money. ( I could be wrong but thought it was a legal requirement when purchasing a property in Spain.) So sue for that as well.

Really, if it's the same solicitor he should show some compromise on fee's for failing to ensure you got BG's. They are surely partly to blame for you having to now go to court.!

We HAVE USED DAVIES SOLICITORS . THEY WHERE SUCCESFULL. IN GETTING OUR MONEY BACK . tHEY CHARGED US 3480 EUROS IN TOTAL. HALF UP FRONT AND THE OTHER HALF WHEN WE RECEVED OUR MONEY BACK FROM HUMA. We wher extremely happy with them. We have since purchased another property using them to perform the conveyance and everythigng whent perfect.

We have since hear d from  two differnt people who innitially wher going to purchase in the COUNTRY CLUB , but did not do so because Mr. Michael  Davies recommended them not to purchase. Needless to say they are now very happy with the advice received.

Their claim and litigation deparment is based in their Almeria city office. The conveyancing office is based in Mojacar.

Hi Clevercloggs,

How long did the process take and did you have a bank guarantee?

We have no BG and don't know what to do for best.

without a b/g only leaves you one option the court rout,       as long as you have some sort of record of a transation being made through maybe your previose solicitor, you maybe in with some sort of a chance,   be sure you get a good lawyer.

we had  bank guarantees.

in any case I recommend making an appointment with DAVIES SOLICITORS to discuss your case.  We have found them extremely efficient and straightforward and  in general are 0 pushy in attempting to take you on as a client.

They can organise an appointment with the barrister either in Almeria or Mojacar.  If possible I recommend you make the appointment to see the barrister in Almeria   as the Mojacar office is always extremely busy and theirfore the barrister tends make the meetings shorter. The barrister charges 50 euros for a half hour appointment to discuss your case or 100 euros for an hour.

Michael Davies was honorary Consul for the UK for a short period last year but renounced due to his workload.(not surprising with all the illegal buildins in the province)

Thanks Clevercloggs,

I will contact them for some advice.

We have reserved a plot on OCC but have not signed a cancellation agreement yet. We were over there with Huma 6 weeks ago and they said they would send all the details to us within a month. As per their normal practice they have not communicated with us and do not return emails or phone calls so I am at the end my tether now.
