Has  anyone  else  bought  through Overseas Property Shop Ltd, 31 High Street East,
Uppingham, Rutland, England, LE15 9PY   TEL: 01572 821881 or 0845 226 3706 (local rate number)

They  are not  interested that  they  have  sold  me  a property  without  the licences  in place.   I suppose  from  their  point  of  view  they  have  had  their  commission  so why  worry that  I  have  no  property  and  no  hope  of  getting  my  money  refunded  in the  near future.  I  hope  they  can  sleep  well  at night -  I  certainly  can't.

Hello

I purchased through Overseas Property Shop.

They were quite rude to me recently when I rang them and told me what I was saying to them was lible less.

There counterpart in Vera "Euroselect" have left town.

They told me originally that our money was 100 % Guaranteed (except the 3000 euro deposit) what a load of crap!

there Agent "Euroselect" lied to us by saying all the licences were all passed so we foolishly gave them our money.

They have a  responsibility as far as I am concerned, If I find a way to take them to court as well I will.

Hi

I to bought through Euroselect & Overseas Property shop.  If anyone has any legal way of suing them then let me know.  I expect Overseas Property Shop would have Professional Indemnity Insurance which if we were succesful would ensure we got paid back.

I would try contacting Trading Standards and speak to them to see if the PROPERTY MISDESCRIPTIONS ACT covers them, as the act covers anything WRITTEN, SHOWN OR SAID has to be factually correct.

The Purpose of the Property Misdescriptions Act

 

The purpose of the Property Misdescriptions Act (PMA) is to enforce accuracy in any description given about a property, no matter whether these are in writing, verbal (including telephone conversations) electronically (internet or e-mail) or pictorially with photographs and artists impressions. led to believe they were buying.

It is well recognised that prospective purchasers base their buying decisions on information provided and specific undertakings given. And if these are inaccurate it means that they will not have bought what they were

Under the terms of the Act, THE AGENT IS LIABLE for anything that is said or written about the property and for anything shown to a prospective purchaser.

 

So the purpose of the Act is to ensure that all descriptions about properties are factual, accurate and in no way misleading.

This is well worth a try

bear in mind though, that the plans were approved by quevas town hall and this was the usual practice at that time although as we all now know, things are done differently now to the expence of us all!!!!!

We bought through Masa International. We recently had a phone call to ask if we were interested in purchasing another property from this company. When I discussed the difficulties we are experiencing with ACC and suggested that Masa should take some responsibility ( they assured us that licences were in place )  we were  threatened  with legal action !! 

We went to one of their property exhibitions, and the agent gave us all of the usual things, ( we will look after your interests, we will protect you from the perils of an illegal build etc,etc,    I think that something should be done to inform people in the UK about  these agents because time after time we hear of  people going out on inspection trips, making a purchase, and four years down the line pouring funds into the pockets of Spanish lawyers to try and get their money back.  We at ACC are not alone in this situation. There are many others. These agents are continuing to operate in the same way. I wonder if our trade descriptions people could help ?

WHAT LICENSES WERE IN PLACE MAY I ASK ?

Strangely, We threatened the said same agent with legal action (via London) if the money they held of ours wasn't refunded quickly. They held our 3 rd payment for 3 years (no BG). Fortunately they refunded in full with no quibble ! As for Huma, different story...........

Why is it that these agents wash their hands of it all when it goes 'pear shaped.' (like most off plan devs do). I think the word is certainly out in the UK about these agents and buying in Spain.....    DON'T. Just go and have a general conversation with anyone about it.

Give them another 10 years to sort out the total mess they have all made of the property market and buyers may look again. Until then, it is doomed, and in serious trouble, many will go out of business. That's why they are holding onto YOUR money today for dear life and not refunding until absolutely forced to !

However, timing is on your side should you wish to still buy in Spain. The market is crashing big time. So stand back and watch. The 'business' and glossy magazines, will have you believe different,  By the time you get your refunds you should be able to pick up a key ready bargain. That will have dropped 30 % or more. So all is not lost. And, with the wealth of buying experience we all have you are not likely to get hood winked by a sellers scam are you ? - Wishing you Good Luck.
