As far as I understand if you go to court in Murcia - you must be represented by a lawyer from Murcia. Even if you are Spanish and outside of Murcia - you cannot be a legal representative in a Murcia court.

I am told by my own UK solicitor that most of the Spanish law firms are very small compared to the Uk equivalents and so lack resources and expertise to take on complex claims against tricky large organisations. I don not know if that is true - but if it is maybe we are not getting the best advice. Would a top UK  lawyer specialising in Spain at least give better advice? can we trust Spaniards?

I think maybe we ought to think about a joint action against the agents. Parador are the biggest and high profile - (and I used them). Should we take a test case for compensation against mis-selling - after all ACC was illegal. If we share costs - it may be affordable.

I paid my reservation fee to Parador Spain by credit card - but I wonder if I could go to the small claims court first to test where we are in UK law.

Certainly all has stalled badly in 2008 and Huma are telling all that want refunds to do it thru court - so there is no other way forward now!

John, sounds like the regretable way forward,if i rewind nearly 4 years when we decided to purchase in the Acc and infront of a solicitor were told that he would not release our monies to Huma untill he had verified the legality of the development and everything was correct and in place!!!

That money was released and things were obviously not in place!! Parador even assured me that everything was in place and full bank garantees would follow.......still waiting.....agreed to transfer to Oasis,definitive contract with insurance backed garantees would be delivered by recorded delivery to our u.k address within 1 month!,that was 2 months ago and still waiting.....

Time now to take action.

Rightly or wrongly, when we signed 4 years ago that was the ''way'' property was sold in Spain.

All sign here please , the Mayor says yes, on the nod and a wink and 99% of the time it all worked out and you lived happliy ever after............

But then, (it's was all in the timing for us) some people in the industry got greedy and corruption crept in. The Marbella case rose it's ugly head, all the Spaniards fell out with each other and hey ho , guess what ... WE had the plug pulled..........caught hook line and sinker.....

With hind sight could we have foreseen this fiasco would happen. I'm not sure we would have. Would our properties today be illegal - maybe / probably.

Life is full of twists, turns and surprises we can usually take 'on the chin' but this one is costly.........

Point taken, but when we asked what we would get for the costs involved in the legal bill we were informed that our money would cover the work involved in proving that Huma owned the land and had full permision for the development and no money would be released without everything being in place.. quote..backed up at the time of our initial interview with the solicitor that parador recomended and took us too also sitting in on that interview!
