As you know, San Jose and Herrada del Tollo S.L. have recently filed for administration before the
Spanish Mercantile Courts. It is now up to the Judge to decide whether the petition for administration
should be accepted or not. If it is accepted, then it will be necessary to ascertain the reach of the
petition and whether there are any chances for the developer to continue trading under administration.
It is very likely that a board will be appointed to administer and control the developers' activities.
I am aware that there are hundreds of British buyers affected and that there is a huge concern about
this matter. I have been dealing with an average of 20 phone calls everyday and been trying to explain
the affected the current situation. Due to the large numbers of buyers affected I am not going to be able
to speak with everyone and therefore it would be better if these can communicate with me via email. I
will then get back to them as soon as I can.
Our intention is to speak with the Judge appointed in this matter and get as much information as
possible about the current condition of the petition for administration. I am happy to get instructions
from those purchasers who do not have a lawyer and take them as clients. We will prepare a power of
attorney and include them in the list of clients that we are gathering. The larger the number the better
because hopefully it will allow us to push the Judge in our direction. Once in possession of the
information we will then contact our clients and provide them with a report on the options available and
costs involved. I am aware that the majority of them will probably want a refund.
Due to the amount involved we will have to charge a representative fee of £225 plus VAT for preparing
the power of attorney and representing the client in this initial stage. Once in possession of the
information from the Spanish Courts we will then provide our clients with a better idea on the options
available and the costs involved.
For those who already have a lawyer I would recommend them to speak with their lawyers first and see
what the lawyer recommends. If they are not happy with what the lawyer suggests then I will be happy
to take those clients as long as they terminate in writing their agreement with the previous lawyer and
pay any outstanding fees due to that lawyer for the work done so far.

I think is imperative that we start speaking with the Judge appointed in this case. We need to know
whether this administration is going ahead or not. If it is, then we need to inform the Judge about the
existence of our clients who have been left unprotected without a bank guarantee.
Any purchasers interested in using DWF LLP will have to contact me and provide me with their contact
details. I will then send them our engagement letter and get properly instructed. Once instructed we will
prepare a power of attorney for them to sign and will use the power of attorney to represent them in
Spain. We will speak with the Judge and find out which is the current situation.
Once we have the information we will then get back to our clients and inform them about their options
and the costs involved as the latter will depend on what the Judge has decided in this case.
Clients need to bear in mind that time is of essence and therefore if someone is interested in going
ahead with us then the sooner we start preparing the documentation the better.
