I have just spoken to the main offices of san jose with the help of my solicitor we had a conference call. we were advised that the compnay is not in liquidation and the build is still going ahead. however there have been some changes made within the company and a official letter will be issued before the end of the week explaining what these changes are. my solicitor was happy with what was said and we now await the official letter.

How can they not be liduidation when they have applied to the courts - verified by three abagados - citing lack of cashflow and the fact they will have ask for iva?

I hope your solicitor is right to be happy with the answer from SJ. Personally i think they should issue a statement NOW, not at the end of the week. Also, we have been given various dates for when the structure licences would be granted, the last one being Oct. 10, 2007 which did not happen and we were not told why. Now we were told the end of this month which will not now happen. I would really like to know why the licence was not issued, but they never did tell us the reason,

Just a thought, but why not inform SJ that they can have their keys back
when you all get your deposits back. I don't know if you can claim
squatters rights in spain but it might make them think, I don't know how
daft this might be but worth a try

Firstly, as a fellow resident at La Zenia, it would be impractical and insensitive for any of us to post openly our situation here albeit it isn't any favourable to anyone elses. Spanish occupancy rights do act in favour of the tenant (see Spanish Tenancy Act 1985 if necessary - Diane, might help your position also).
Some of my understanding is as follows.
The Spanish Banks are closing up on the lending of money either through loans or mortgages with the property market in such disarray. San Jose, like any builder requires funding and if it doesn't come forth then bills don't get paid. SJG may have gone to the Courts to suspend their debts rather than incrue more until this situation is resolved. If the courts take on the debt, they have the power to intervene with the Banks to ensure they do co-operate with the construction companies to continue funding..legally. Basically, the government and judiciary have to support this element of the economy to avoid the recession going deeper. Many Construction company money is tied up in land and stock and in order to clear a debt, and if Bank's do not assist, is to sell off assets, getting back to solvency asap...but obviously, more helpful if the Banks step in. If the in-country banks don't help, constructors are permitable to go to any Global bank to seek assistance. If this was the case, good could come out of bad as Global Banks could see this as an investment of a service that is on it's knees and the only way back is upwards, thus a quick return on investment.
My words, not SJG's so any disagreement please aim at me rather than them. Doesn't stop people from acting to resolve their own personal situations though.

If I had to back the business success of your business or San joses then on this occassion yours would be looking quite attractive. If you honestly do believe that San jose are only the victims of the credit crunch and not any other factors regarding their integrity and business acumen then you will be shocked.
Whatever your situation I am sure you will look after your own interests well enough. Good luck

The whole market over here is in disarray and we are seeing a number of Estate Agents, Immobilaria as well as construction companies going to the wall. San Jose will not be the first and only company to struggle in these times and i apologise to everyone if my post indicated otherwise which having read it I don't think it does.
I have invested like others on here and sure I will look after my interest like the 1700 others will as well, all is in the hands of a lawyer who is well practiced in these situations.
