I have tried several calls and emails to Claudia - as I want to discuss my options sensibly. I have won our court case for ACC - but we all know that we will never see the money - especially since I am owed 100k.
I did have talks with Natalia & Pilar earlier - but they have both gone! Natalia was not very enthousiastic about OTCC and was trying to offer me new off plan villa sites on MCC on the hill opposite the HQ - but gave me the impression that BGs would come for them before OTCC. I would not go ahead without a BG. Obviously, there are so many lies - I would not read much into that! It appears there are no BG's coming (currently) for anywhere. Has anyone else heard of any new building @ MCC?
Is Claudia the only english speaking contact in Huma HQ @ MCC? Does anyone know any other english speaking contact @ HQ that can help?
She is either constantly out or in meetings every minute of the day - and the reception has never an idea when she will be in.
As Claudia is head of sales (I am told) - what is she selling currently to be so busy? or do you know if Claudia is now doing something else - chief negotiator with new Builders, etc? Or is she leaving too or has she left now? - it took me a number of weeks before I found out Pilar had left - but her emails still went thru - with no reply.
Does anybody know what is going on?
Apologies for posting on this forum - but it is obvious Huma have wiped their hands of ACC completely now and do not even bother to turn up to court - they just hold us in absolute contempt!

Try this....e-mail today from Carmen said that they will be closed 1st May as it is a Bank Holiday...Carmen does seems to reply to e-mails!....and seems to be at the site most days

As you can see from this forum the current information from Huma Indalo is that new builders will be on site in circa 6 weeks!
I doubt this but hope it is true as I think they have been credit crunched...everything stopped circa Sept when the banking crisis worsened
Finance either new, continuing or renewing for residential development like OTCC is very difficult at the moment...some may say impossible as Banks do not want to know!
I do think that OTCC will be built but late this year for a re start if economic conditions start to show some improvement and this means that it will not be until 2010 that the first Manzana get their Licence of First Occupation
There is just so much infrastructure to be done...bit of a shame really as everything was moving on until the crisis got worse
Everyone should take their own legal advice regarding their position and what to do but it will do no harm if everyone pesters by e-mail or calls Carmen at Huma Indalo for information!!
We may hear in the next 6 weeks about the re scheduling of OTCC and I hope they re start before the Spanish summer holidays.......but I suspect unlikley!

I received a e-mail today from our solicitors saying we now have to pay tax on our properties, which we still havnt got. The law was changed for expats etc on the 1st january 2009, anone else know anythink about this tax

You should check with your lawyer for more details , if you are worried
But as far as I know, and I would be surprised if I am wrong, there is no tax liability on properties in Spain which you do not own or rent or occupy...and I think that applies to almost everywhere
You have a contract to puchase and will not own the property until it is built and you have the deeds
I am in the same position as you and do not know of any liability and do not expect there to be one until I own it

I think that your solicitor is probably Aldea. If so, then don't worry as they are only touting for business. The Tax that they are referring to is what is known as Wealth Tax, which was abolished. The Tax they are offering to present for you (using form 210?) is Non Residents Tax - which, as Rowlandsbb, quite rightly pointed out, you are not liable for until you own a property.

Has anyone heard from there solicitor of any more answers to why the builders did not start at the end of May, as promised ! and are you receiving good service from your solicitor in Spain.
I presume we all still want that property in Spain, the first phase should have been completed by June (plus two months) and its difficult to decide if one should still wait or not,as anyone started instructions to cancel ?

I emailed Claudia on monday to find out whats going on - Guess what- no reply ( No change there then.)
Our contract is July with 2 months so September for completion. (Dont think its gonna happen!!)
Have started making enquires about retrieving our money with an independant lawyer
No BG - could be fun ( I mean long Haul)

Hi all, have just spoken with our solicitor,. not good news. She says that the new builders cannot get finance and building has stopped on OTCC and Mazarron and she says that building will not commence in the near future. That is her opinion, Huma have not said that, they are still telling her that building will start soon. We cannot swap as there are now no properties available on Mazarron. So it looks as if we have been well and truly stuffed. We have no BG and did not have on ACC either, so thats that! How stupid have we been, thats us not everyone on the forum.

all is not lost yet, i believe that in the near future acc will get the final approval and at some point the site will be developed whether it be by huma or not, then you can place an embarge on the property you have paid a deposit for, how long this will take is anybodies guess, but i am sure you will get your money back eventually!! hang in there!

I agree with jethro on this one wih the information that we have been given and as to the direction the solicitor wants to go in Almazora looks like the only way of seeing your money returned if you have no b.g,but it is no quick fix and depends when planning permission is eventually given,in full and huma or another developer looks towards finishing whot was started,a long time ago!

I think you have a point if HUMA develope the site but surely if HUMA go bust and someone buys the land from the liquidator then we can not place an embargo or make a claim against the new developer - our only call would be as a creditor against the liquidator. On that basis I would expect to only get a fraction of my money back.

One thing about Embargos is that you can only place an embargo on an asset after a court judgement and subsequent non payment.
Therefore - when you cancel your contract - it takes ages to go to court and embargos are put on a first come first server basis - so you will not be able to embargo your own plot - it depends what is available at the time.
I may be wrong - but that is what I understand.
It will be interesting to see how the embargos succeed for the few ACC clients that have them? Will they actually turn into hard cash or will the Spanish judicial system fail again??? I hope people will post if successful.
I know ACC solicitors are finding it hard to find assets/bank accounts that have any worth to embargo? Huma have no doubt done their best to prevent this route being easy - like every other route for money back. It will not be an easy or short route.

For all the people who have not received their deposits back from Huma surely that money is deposited on the property.
Or is it - I don't know but i have 3000e on an apartment in ACC. Did I read somewhere that in Spain debts are on the property.
