Thanks for your clarification on the situation - but I think I may have missed something and hope someone can clarify this further for me.

this is my understanding so please anyone correct me if I am wrong.  Without credit against the mass, we could all be put at the end of a very long queue of creditors.  Therefore the promise of a resolution of our contracts, interest, and even a trip to the moon, will mean nothing if there is no money left by the time they get to us.

HdT offered us some time ago that they would give us our interest charges (good of them !) if we stopped our application for credit against the masses.  You can guess the reply.  Until the court decides on this, we have remained quietly cautious.  

Whilst not wanting to dampen anyone spirits, and this is certainly a step in the right direction, I will not be opening the bubbly just yet.

As I say, perhaps I have totally missed something................................

Lord Dave ,not sure who you are  trying to slag off but perhaps if you want  yourself or your latest  business venture to be taken seriously on here .You should clarify who you are referring to and give that person the  right to reply . It would seem to me you are attacking someone for disagreeing  with you , in that your sales scheme was not a good option !

If you can come on as Lord Dave and insult you should at least be able to clarify who you are insulting and why . No one is asking you to give explanation to the masses , just to the few who may have been included in your insult. Are we to take it that you disagree in some way with the legal expert (Martin ) who contributed to this thread .Without clarity are we to  take it your attitude is down to sour grapes as you have not followed the litigation route .  Perhaps you are still annoyed that certain posters and  experts  on here warned others against getting involved in your dodgy little property deal  .With no clarity  people will have to  make  up their own minds but a lot of credibility will have been lost . I think you may have  rentered the rat race the day you hooked up with Soane properties or is that just a hobby ?   If you can't clarify an insult don't give it  ! MM

Please clarify what you mean by  "getting involved in your dodgy little property deal" Also do you actually know Joan Soane? or is this just your unfounded opinion of her and her company. All I have offered people is the chance to look at another option with regard to their deposits paid to San Jose, people like you took advantage of that offer and I sent you, along with others what information I have. Some people have choosen not to pursue this line any further some have taken advantage of the information and have investigated further and have even been out , looked at the properties and have made their decisions based on their own legal advice. So far I can't see anything "dodgy" can anybody else?

As far as my wife having insulted anybody, perhaps you should look back at the many insults and jibes we both received when I first posted this matter. All my wife has stated is that the so called experts on this forum are quick to post their opinions and insults and should be prepared to accept the same. 

Lastly this is not my latest business venture, once again you assume, wrongly I might add, My business is Property Management, if you are interested in our services feel free to contact us.

 come on guys lets not argue at just the time when we should all be happy. the news is starting to come good. lets hope that the days of us all posting on here (insults or otherwise) will soon be over and we can all spend our money however we like!! Me personally...I am going to have lots and lots and lots of very nice holidays to make up for all the stress.

Dave  I have had three separate professionals look over the details of what you are offering and the unanimous opinion was  "dodgy " "risky "  "not exactly legal" whatever !

I am aware that  a few people are looking at the deal and in fact a few are visiting to learn more ,that is their choice but I urge them to check it out with an independent lawyer not the ones you /Soane are offering to provide along with the sales package . I understand that you may really  believe this is a get out for people but I disagree and I am as entitled to my opinion  as you are  . I think purchasers on here have been through enough and as I have said before I don't think that Soane properties or anyone else for that matter is queuing up to do them a favour and make everything good .The same deal was offered a while ago on the general forum and many legals said not to touch it as it was only people trying to cash in on the situation and misfortune of purchasers .

As for your wife's insult , it is unfortunate she can not answer for herself . I still think the she should clarify who the  insults were directed at . I have great respect for Martin the legal expert who contributed to this thread and your wife's comment may be casting doubt on the contents of his post .Martin does not have to post  on here and many members value  his input .It would be a shame if he decided not to post anymore as he has also been insulted by SARC on many occasions  .Perhaps we should be wondering why some members would rather that lawyers did not post on the forum and try to discredit what they say .Is it self interest  I wonder ?

I appreciate that you and your wife have faced insults on here however I think the reasons were made perfectly clear at the time ie many did not like the way you used the forum to advocate a scheme which many had previously investigated and found after  taking legal advice to be  "dodgy " I would also like to say that despite stating you did not want to you did indeed break forum rules .It may have been more upfront to ask Justin's permission to advertise the deal and post for all to see ,thus allowing proper debate and deliberation from all forum members including members who are also legals .This I believe would have been the correct route if as you say you were truly trying to help purchasers out of this mess .

Sorry if I have insulted you but the reasons are being made very clear  and are not ambiguous like your wife's comments  .May I remind you that despite you speaking on her behalf , we still do not know who she was referring to surely if that was clarified we could draw a line under this matter . Regards MM

Assuming that you were going to buy a property. In view of your experiences, if an agent offered that if you wanted to buy that they would introduce you to a firm of solicitors who will complete the legalities for you.

I would run a mile . If most of us on here are honest the biggest mistake we made was to go with the agents /developers lawyer .We did not seek  nor were we advised to put  in place a truly independent lawyer  before we went to view and face  the hard sell  tactics .

When the agent /developer introduces you to a lawyer this lawyer has an immediate conflict of interest this was the start  and route of all  the problems for most of us . I hope we have all learnt from this and as soon as I see an agent or developer offering to introduce buyers to a  lawyer I just think dodgy dodgy dodgy !.

Sorry Lord Dave but you are doing this  in your sales for Soane and in your property management company ( will not mention the name ) Have you learned nothing or don't you care  . Are you relying on the next wave of vulnerable buyer's ignorance ?  All of us except for the usual suspects have learned from our previous mistakes or should I say the underhanded way agents and developers misled us, regards the independence of these recommended legals .

Dave the very least you could do is to make it clear on your web site that it is best that clients contemplating a viewing  trip  and considering a purchase have already made contact with an independent lawyer in the area but we all know Dave that's just not how it works !!!!!!!!!! hey Dave or should I call you Jack (I am alright )  did you learn nothing from  your misery or the misery of others .I do despair
