I have my money back!!!!!!!

 To all those who are near desperation then take heart. I have my money back and have been granted interest also. Despite now having had my bank guarantee refunded, I still think santa ana will never go ahead and that people must be bonkers to even consider anything that Tony says.

keep up the fight everyone and it will hopefully be worth it for everyone.

I doubt he will ever get anything certainly not his house as SJ will string him along for years and he will let them . MM

that is the best news I have heard in ages.  I am sooooo pleased for you, and also hopes that this sets the precedent for the rest of us.

Out of interest, who is your solicitor?(this could be pm'd if you prefer) only I have had communication from my solicitor today that he has secured a payout on a BG, and I was wondering if this was you, or perhaps there are even more of you lucky ones out there!

 Yes one and the same Tracey! I did indeed start proceedings after the administration had started. I hope that this will set a precedent for all of you with bank guarantees. My interest was paid back until the date I first signed so, with the euro rate, I have actually got back a nice amount extra.

Keep up the fight everyone, I am confident that things are changing and that we may all be able to celebrate together shortly.

Yes the bankers draft is in my bank account (though not cleared yet) My bank guarantee has expired but I raised my claim against the bank before expiry.

I am very hopeful that those with bank guarantees will soon be behind me. I believe that my spanish lawyer is in touch with other lawyers (group ones) and similar claims are now moving forward!!

Joannie666, That is a relief for you and goes to prove what I mentioned months ago is that good get advisors around you and be prepared to pay for it and you will then get what you pay for. Your money back.

Just hope that you don't now go quiet on the forum, like others who have had they money back have, as such news as yours brings hope to the sensible.

The others, well, they will never learn it seems and as I said, you get what you pay for.

 funny story.. problems getting my cheque cleared in time for next wednesday (the euro rate is due to weaken against he pound due to interest rate change and quantative easing in the euro) this may lose me thousands

I therefore rang banco pastor in London to enquire about paying the money in there. they had heard about my case already and the fact that it the order to pay me came from the very top of the bank. I thought it was quite witty that they knew about little old me

It just goes to show dont go quiet, dont give up the fight and keep going and there is far more chance of success. I have written a letter virtually every day for the last year and thanksfully they have paid off

I am glad that your Bank Gaurantee was honoured and that you recieved your money back.  I have nver had any issue with you or any other purcasher who has a BG having them actioned and being able to get out of the mess that we are all in. However, the majority of us do not have a BG to action and therefore have to carry on and look for the best way out of the mess.

For those without BG's to get their money back it is unfortunatley a different story , take longer and probably not be significantly affected by legal action. In the current economic climate the refinancing of SADM and those who wish to have their property geting them, paying for them and then enabaling HdT to repay those who want their money back is  probably the best way for a postive outcome.

I do believe that you are sincerely pleased that I have had my money back. I know however that you did think my opinion and advice given to others solely came from my need to have my own bank guarantee honoured. Hopefully now you will see that this is not the case Tony. I agree that it would be the best outcome for all that santa ana go ahead. we need to live in reality however and that is simply not going to happen.

I got back from Spain an hour ago and Santa Ana is dead and well buried. Any hope that it would move forward is gone. the only hope people have is that the legal action they have taken will protect all or some of their investment . I do sincerely hope Tony that you did take some form of legal guidance other than that you have recanted from your lawyer and have not solely relied on Almun to make your decision. If you have then I fear this could be a more disasterous result than choosing to buy on Jumilla in the first place.

I suspect that I am more likely to get money from people buying my book (that relates in graphic detail the trials and tribulations of buying an off-plan property!) than from Herrada del Tollo......

I actually thought it would be nice not to need to come to forums to hear if there was any more likelihood of me getting my money back. Actually however my gear has just shifted. I want to carry on logging on to hear that my friends and colleagues have also continued to fight and been successful. we started this process as a small community back some years ago and that is how I want to see things end. I want to see each of us get something back instead of seeing those corrupt unscrupulous B********s get anything from this at all (except a long jail term)

I continue to keep my ear to the ground and will pass on anything I know. Just keep fighting everyone and please do not give in

The one important thing that I emphasise is to get a bank guarantee before handing over any money - if only somebody (like our agent or lawyer) had told us that a couple of years ago!!!  I do also say that even with a bank guarantee you have to take care.....
