The following has been copy & Pasted from http://www.simplynetworking.es/news.php?id=31
Which shows local Spanish news involving property developements in and around Murcia. Now I wonder what lies and bulls**t Alumedena and San Jose will come up with to cover this up to SARC and other buyers who foolishly still believe that the developement will ever go ahead.
"Santa Ana del Monte, Jumilla Golf Resort, court asks for proof of adequacy of water resources.
Posted 27th December, 2009
A solitary shepherd, determined to protect his livelihood and his flock has won a lengthy court battle to prevent the construction of a 2285 home golf development in the Jumilla area of North Murcia.
This is excellent news for ecologists, who have been concerned that an urbanization should not be built without adequate water provision, wonderful news for the lone shepherd who was faced with the destruction of his livelihood and the concreting over of vast tracts of his land against his will, but disaster for the unsuspecting people who purchased properties off- plan and now look set to lose what represents not only their lifes savings, but loss of dreams and hopes and confidence.
The nightmare for the shepherd began back in 2002 when he received notification that a high voltage power line would be installed directly through the middle of his finca, and grazing area.
When investigating the reason for this, he discovered that the line was to have originally passed through the finca of a neighbour, but after the neighbour had complained, the line was diverted through the middle of his own land. He went to the courts, but was unable to prevent the installation of the line, and it was during the court case for this that he learnt of the plans to build thousands of homes in the area, the Santa Ana del Monte Jumilla Golf Resort, which would result in the expropriation of 30 hectares of land, destroying his livelihood and way of life.
He was devastated.
All his life he had farmed sheep and knew no other trade or way of life, so he decided to stand up and be counted, and fight for what he held most dear, his right to continue to live his life how he chose, on his finca, with his flock.
His case was based around the question of water availability, or in this case , lack of availability, arguing that there was insufficient water in the area to support nearly two and a half thousand homes and a golf course.
The Administrative Litigation Division of the supreme Court was unsympathetic , bringing to court the evidence that the plan partial provided for the construction of a desalination plant and water treatment plant, and ruled against him, however, 2 years down the line, the order has now been given to suspend the project until the "adequacy of water resources" can be proven.
Jumilla council has back-pedalled, the Mayor first telling the EFE Press agency that the plan partial would be revised, but then admitting that, "In future, plans should be developed in a more sustainable fashion, "
The shepherd and environmentalists are delighted that the resort will not be constructed, and announced that the developer has gone into bankruptcy proceedings.
We are seeking confirmation of the legal status of san Jose Inversiones, as the last release we have was of a voluntary arrangement, not final liquidation.
The La Verdad newspaper today printed a beautifully written piece extolling the determination of the lone shepherd to fight for his rights and to prevent the destruction of his livelihood and his right to continue to care for his flock in peace.
Sentiments with which, as a sheepowner living in the middle of nowhere, I can entirely , 100% agree.
What the paper fails to mention , however, is the great tragedy of the millions of pounds of lifes savings that have gone into the pockets of the developer, San Jose Inversiones, who went into voluntary Administration last year with assets of 300 million euros, but unable to meet debts of 30 million euros.
The paper also fails to discuss the issue of quite where this titanic battle of David and Goliath, in which David has walked away as the victor, leaves the innocent bystanders who bought the homes of their dreams from Goliath.
And , more importantly, are San Jose Inversiones planning to give the purchasers their money back now that the development is not going ahead?
I think the snapshot from my office window above says it all..........."
