Hi to all,
Today the Court of Alicante has informed about a document filed in Court by the Municipality of Jumilla.
This report explains that the Legal Department of the Townhall of Jumilla has reported with regards to the project "Santa Ana del Monte Jumilla Golf" that the following processes should be started:
1. Declaration of breach of urbanistic obligations (of the urbaniser, formed 80% by Herrada del Tollo and 11% by San Jose - the rest are minor investors).
2. Cancellation of the urbanisation project.
3. Cancellation of expropriation processes to other land owners.
4. Cancellation of the reparcellation project.
5. All licenses that were granted to be revoked.
6. All guarantees provided, to be refunded or executed.
It is accesible in the Townhall for all those interested all this information for a period of one month since this information was released. The report is produced on the 16th of September, but notified by the Court today, 15th of October. I understand this is when the one month period starts.
Our interpretation of this is that the Townhall is not in favour anymore of this project going ahead, which may reduce any chances of this development being built.

If this is going to happen looks like we are going to be shafted, perhaps this was the news the women from san jose promised in October, wonder what SARC have to say on the subject!
Tony/Brian have you heard anything regarding this latest development in your contacts with the smashing people from san jose. Surely one of you must have at least five minutes spare to put your view on this.

Without ANY of the licenses, the value of the land is now completely worthless with even less chance of us getting any of our monies back.
Strange though, I thought I read on here that the TownHall were backing HdT all the way, and were keen for the development to go ahead..........................................................

Glendale you said " if this is going to happen " I don't think there are any ifs about it ,it has quite clearly happened .
It would be good to here from SARC surely they have been lied to more than most in all of this and believed the lies enough to spread them and give false hope .There ain't nobody getting their house now or their money by the looks of it .Sad !!!!!!
Perhaps SARC have moved on or cut a deal with SJ for helping to keep everyone in the dark about what was really happening and what we should have been doing to help ourselves .Who knows their silence is making them look very bad indeed .
I agree with Chrissie SJ have treated us all very very badly .

OK, so you want another miracle?
First we had SARC saying all was well (Miracle 1)
Now you expect to hear from SARC (Miracle 2)
People call developers con merchants, so as SARC sided with a developer and advised all to support the developer, what does that make them?
We know they are miracle workers as Nurse Tony has told us often enough how he has saved the world in the hospital where he is a proter, or nurse, or something. Then he was saving all from the pandemic, then thighs were quiet and information delayed as he was a swine flue victim.
What ever happened to the assurance Tones had from the Town Hall about them supporting the development.

From the SARC July August report
Jumilla Town Council:
HdT met with the Jumilla council the week prior to our meeting and discussed with them the
way forward for the SADM development. The council wish for the development to go ahead
and HdT have been discussing with them, ways in which they could help the project to
proceed.
Was this just hear say via HdT or did SARC actually speak to the council .It would seem not !
Tony Brian you are fools and have been stitched up like kippers ! problem ! No you are at liberty to be conned as many times as you like by this company ! but it is a problem that you perpetrated the lie to others .Were there ever more than 4 members in SARC if so would any other SARC members like to express an opinion on the latest developments ?

Yeah, that would be interesting to know, also, when was the last time SARC supporters had been given an update or contacted?

Nice to see that you are still around anyway the report will be out shortly as for Martins info annoucement it is only their opinion not a fact and remember that in concorsa I ask my solicitor for his responce to the message from Martin
My solictor replied with this
I have check the document from the Town hall, this document is a legal report but it is not a administrative disposition.
I think that the Town hall is chasing the legal administrator to go ahead with the project.
I suppose that the legal administrator will present a writing to the Town hall against this report.
Nevertheless, the last word in that case will come from the Judge.
The judge could paralyze the acts of the Town hall.
So Please hold fire and wait for the report is will be important and please read it very carefully

Absolutely unbelievable !!!!!!! I can only suggest you get a different lawyer or look at the document yourself it is self explanatory .What more do you need ? A Janet and John style document with key the words explained in the margin !!!!!!!!
Does your lawyer actually reside in San Jose's pocket or just weave the lining !
If this is the best you can do you deserve all you get . Jeeeeese ! God Help us all

Were you a purchaser at SADM - if not, it would be helpful to know your interest in this development, as you are a recent member of this forum, whereas most purchasers have been around a long time?!!! I notice that there is no information about you on your profile - it would be helpful if you could complete it.
We are going to check at Jumilla Town Hall in person on Friday, and if we find out anything more we will post it on here.

Don't you realise that solicitors comments are always opinions, which is why judges and courts are needed.
To make it simple enough for you to understand, in such cases, each side would have a solicitor, who would give OPINIONS on what they believe is correct, but a judge would decide.

problem is that with some solicitors, they see a long drawn out proceeding as a way of income.

I wish i could be in front of you when the report goes online I would love to see your smug smiles wiped out and all the miss information that you have delivered over the past two years and the heart ache you have given to genuine purchasers at SADM
You really should really place all facts not just part facts before you make your comments and scare people who don't have the info infront of them or someone at hand to give unbiased answers.without chargeing them for it
I hope to see all those who either wish for there money back or their property get what they want and I am very happy at the moment about the situation haven't felt this good in two years

Louise Cecilia is Magic Meg and JA not my fault if you get banned from this forum for speaking out against injustice and agents you have no right to reply or redress .Everything in the Spanish property market is rosie and certain people don't want anyone rocking the boat .Sorry I will tell it as I see it no matter what .
Now that I have said this do not be surprised if I get banned again and have to pop up as someone else .That's life !!!

Brian and Sue are you two suggesting for one minute that Jumilla Council go about putting documents in front of the court for no reason or perhaps as a hobby to keep themselves amused ?????? Please people get real .Do you really for one minute expect the judge to dismiss such a vote of no confidence . Should we all be looking out the window for the flying pigs again .I am totally stunned by your blind faith and belief in SJ after all they have done .It is truly astounding .

Jumilla town hall has issued warnings to the builders of Santa Ana del Monte resort as deadlines to construct infrastructure, expropriate land and design plots are due to expire in the coming months.
According to Fina Torres, chief of Jumilla town hall legal department, the board of compensation has not paid the 4.6 million euros for the land which has to be expropriated and they have done nothing since February, 2008.
"The building plan has been definitely approved by the authorities, the land has been turned into building land and the scheme has been temporarily stopped, not cancelled," Sra Torres added.
"Our duty is to state that several parts were due to expire and to find a solution.
"If the board of compensation is unable to manage the expropriations and we do not reach agreement with the board, we will have to find a way to manage it."
The board of compensation is managed mainly by Herrada del Tollo - a sister company of Grupo San José - and they are in voluntary suspension of payments.
Grupo San José sales manager Almudena Rodríguez told CBNews they were fighting to finance the expropriation, but it was difficult due to the voluntary suspension of payments.

An interesting post, that puts a slightly different perspective on things, although the main problem of finding the necessary finance is still the issue. I would add that, living in Jumilla and speaking to local people as we do, we know that our town would receive a boost to its economy if SADM goes ahead and therefore I would be surprised if the Ayuntamiento really want to cancel the whole thing. Although we haven´t had the luxury of waiting to see what happens and have now bought elsewhere in the town, we know many Spanish buyers are still keen for SADM to go ahead. Obviously the Ayuntamiento are losing patience, but.......
FIN, if I say I will do something I always try to keep my word. I will post on here when I get a chance, even if it is to say I haven´t found out anything new.
LC/MM/JA. That explains a lot - so I will let you off updating your profile now that we all know who you are! I am surprised that you have been banned though, as I have seen a lot of negative posting on EOS on other threads without people being banned.
