I don't know what is more terrible - the situation or the fact that I was not shocked!!

How much can they blatantly get away?  I feel so sorry for the residents on this urb. I just don't know what else to say as I am lost for words

Thanks for posting the article MM.

We are due to exchange/complete onto a fully furtnished  show house Marbella  on Playa III next week so naturally have forwarded the article on to Legals who have just replied saying they will investigate this further.   We went over for a couple of days in early December and our pool area was immaculate and working with filters etc?  There was even a cleaner in the house we are having doing such a fine job we'd take her on!. We met a very a lovely employee to show us around (no sales pitch or raving on about SJ - just a normal working girl).  We did chat about us being the 'victims' of the Jumillia scam and she freely admitted that SADM would never be built as far she and her colleagues were concerned, so we felt justified in cancelling that worthless piece of paper at least and deciding long ago that SARC were completely distorting the reality of the situation and offering inaccurate advice.  As for those meetings with Alumundena and the Reports.. just made amusing reading really in the end.  I used to send them to our Lawyer occasionally if something flagged up.. but his replies were so dismissive I eventually stopped and let him get on with REAL options available.  Court or exchange ... its taken a long time but we shall see this time as long as it suits US.

   Having said that, like anyone else ever to have had the misfortune of believing SJ/HdT over the past five years, we trust nothing and will look into this further to ensure no charges will apply to our exchange.  We've been caught out so often by these crooks, it aint over til that big woman sings and its cost us a furtune!!!  The people we've met and cybered with are wonderful and love living on Playa.. Its a lovely community and we are hoping to get this ordeal over with very soon but... cautiously....

If this isn't warning enough to steer clear of buying a key ready (and overpriced) property from San Jose then I don't know what is.

San Jose owners should be stripped of all their personal assets as with any other criminal.

We couldnt agree more.  Lawyer's are looking into it as we speak.

We all have to go our own route in the end and make our choices/decisions if they are open to us.. but not at any cost we would agree.  Good Lawyer's negotiate hard, which ours did and for us it came down to  take a  property (lovely one)  or potentially loose 98000E with no BG/ more Court expenses. We made a choice.  Believe us it was not an easy decision  given the pain/financial losses this Company have cost us let alone the wasted years of enjoyment.  

We personally dont begrudge SARC trying to do something, but listening to them soon became clearly not the route to take in our opinion and became rather insulting to many peoples intelligence.

We sincerely hope we all get something from this ordeal in 2010 and wish all the very best.

I'm not surprised by this article which i read myself this afternoon, as far as Grupo Mediterraneo are concerned they have taken quite a slagging for mis-use of community funds from the Torreveija forum. Sal & Martin  if and when you complete make sure you vote against keeping them they have created  problems on a couple of urbs I know of from my dealings with our Presidents Liason Group

Hi Linda ,I think you miss the point .The trouble at Playa Golf is they can not be voted out because of SJ  ! I have read  the forum you mentioned and think all this is  just another scam sanctioned and designed  by SJ  .They appoint the administrator and the first step is to divide the community in to sections ,divide and conquer ! The administrators  fee is considerably  increased by advising that the build is divided into separate sections for admin purposes and no matter how many times an explanation has been sought regards why this is necessary purchasers are faced  with a load of bull .So it will make no difference what Sal and Martin vote for just like on El Pinet and Playa Golf .SJ are not just crooks by default but by design .   MM

I do get the point but maybe I didn't explain properly it was late when I made the post.

Maybe the president of R2 Playa Golf ( I know the area well) should read his rules tis nowt to do with SJ unless they are paid up members because if you are a debtor you cant vote and that is on the majority of Urbs, thePresident has more power than most think , he needs advice  and he clearly isn't getting it from Grupo Mediterraneo on how he can get rid of the administrator 

 However he is quite right to ask his owners before he does this and to call an EGM (i do exactly the same on our Urb) but,technically if they aren't doing the job they are paid for, it is the President  who can according to Horizontal Property Law appoint another for the good and benefit of all owners .

It is preferable to ask all owners to an EGM if only to let them all know the problems, you only have to give 7 days notice so many will not attend, but the administrator under the Presidents' direction should be balloting all owners on the issue I would think if they dont do this then clearly they are not assisting the President
