    What is a concern,If the President is running illegal companies,I do not Know if this is true,But if it is,I do not think any President should be using there position on any Garden in running illegal companies not Paying taxes or social security,Hampering the companies on site who are paying there taxes,and obviously under cutting them in there said services,As Presidents you would think should leed by example helping legal companies on the resort to Prosper,As its quite expensive to pay your monthly fees to be a legal company,I know a lot of people complain about illegal workers in the UK,taking jobs and not Paying taxes,So it it is in Spain a Problem,Like I say I do not Know if it true,,As I suppose the Guardia Cival,and the Social office in Cartagena would be notified of this,

Arlene.....................exactly. No point starting from scratch again and I don't seriously think it would ever get to that. or in fact needs to. Just get together and make it clear what the rules are - both sides comply with the guidelines & protocol and carry on to make forward steps together. Unless of course there are more serious underlying issues that we are not being informed of ??

Will – thank you. I am Norwegian. I experience enough bad weather here, so I never considered buying an apartment in Wales as “bluevelvet_77” suggested , although I would like to visit Wales one day.

Jackie – I suppose the minutes are not signed by the Presidents present at the meeting? No minutes of such a meeting should be considered valid until signed. And of course they should not be distributed before signed. I thought that was quite basic.

Hi 

Though the justice system in the UK could do with a good overall the one thing I think this country can be proud of is that everyone is considered innocent until proven guilty.

As Phil Tann is on holiday & has not been given a fair & just opportunity to defend himself I believe ML has acted in an unprofessional way.
Let it be said that I have always thought that ML have been doing an excellent job so far
I could never get my head around the horrors that occurred in what was once Yugoslavia.
Now I can
Just one email (a one-sided one) & many want to start a lynch party
Let us all act as intelligent grownups & not silly children.
I believe that the truth will come out but only when Phil has the opportunity to speak
In a court of law the opposition is given early notice of any incriminating evidence against them in order for them to have their right to reply
In this case that has not happened.
Give Phil the fair & right opportunity for a right to reply
I have sat on many comities in my 65 yearsand sometimes not very pleasant ones but everyone has the opportunity to speak up for themselves and produce documented evidence to prove their case
In Phil`s case this has not happened
Everyone serving on Comities at any level knows there is a set procedure
And everything listed on the minutes are dealt with first.
Did Phil really take up 2 and half hours of time, what was the chair person doing. Nodding off to sleep?
Surely not, so if the truth is that Phil spoke for ex amount of time prior to the start of the meeting instead of at the end under “any other “
Then the chair should have been more forceful & closed the meeting or called Phil to order
This will be my last comment on this subject until Phil returns to Condado and has his right to explain his side of the argument.
I am of the opinion though that it might be better that the level one president is  fluent in both Spanish & English as often  things get lost in translation
A good knowledge of Committee proceedings & the rules should also be fully understood
And so endeth the lessons for today Ha Ha.
Sorry but felt I needed to put a bit of a happiness onto what has become a lets hang some one ethic

All meetings held in our name (owners) should be conducted properly with minutes in both English and Spanish and these minutes, once signed off as fair and accurate by both ML and the attending Presidents should be available for anyone who wants to see where our community fees are going and what the plans are for our resort.  There should be no secrecy and of course all meetings of this nature have controversy and people are not always going to agree on every subject.  However, they are all adults and should set down some procedural rules, hopefully respectful of each other's viewpoint and any contention or disagreement about the decisions taken should be put to the vote of the entire community.  Our presidents act on our behalf, I hope, and therefore should have the best interests of all owners at the forefront of the job they have agreed to take on.  Not everyone would volunteer to accept such a responsible role so we should be grateful that some people are prepared to give of their time freely to carry out the duties of this position.  There should be no hidden agendas from either ML or Presidents, all should be transparent and the accounts made available to anyone who wishes to see them.  It is our right!!!!!! No-one however, has the right to decide what information should or should not be released to owners.  All Condado residents have equal rights including the right to ask for clarity and honesty and transparency when it comes to spending our money.  We put a lot of trust in the Presidents and also ML and furthermore I am sure Phil will post his response to the accusations from ML and once we have read them, we can make an informed judgement about the contents of the statement.   There are two sides to every story and we do need a level 1 President who can stand up to the powers that be and fight our corner.   All this bad press just paints a very grey picture indeed and hopefully the problems can be ironed out in a manner which will be in the best interests of us all.  Please! Please! Please!

 First of all I wish the likes of Blue Velvet would crawl back under their rocks

On the subject at hand:

ML have done a good job...however they have lost my backing with a totally unprofessional report targeting personally the elected representative of the community.

PT may be doing work on the side...personally I think thats wrong if he;s not paying tax but I am more worried about how he impacts on the running of the resort. 

Lesley may have been ill advised posting on behalf of are in support of Phil in the way she did but then ML (a professional company) posted a 10 page attack on Phil.  plus including details of where our security details may be found...something I had never heard of previously.

Some of the comments were more than petty...asking for an urgent signing of a cheque and being replied to within 5 minutes that Phil would sign it straight away if they walked 100m to where he was having a coffee.  Remember who is getting paid and who is not here!! Now if Phil refused to sign cheques anywhere except in a crowded pub over a few pints I would have an issue but the example quoted was anything but this.

Unfortunately if the parties can't work this out they must both go.  We cannot have presidents who cannot deal with administrators and we certainly cannot have adminstrators who feel they can dictate to the owners who may be their elected president.

I am also very unsettled by the timing of the email as I had also learnt from other residents that Phil was away at the moment.

I had credited both Phil (and the other presidents) and ML for moving things forward.  This letter has discredited both parties and CdA.

And to those posters who want a say in every decision...put your arse up for election.  This is no different from your local club, school board, council etc etc...those you vote in make decisions on your behalf without consulting you.

 Just a quick comment on roadsters last post.  In agreement on the minutes BUT there will be commercially sensitive information discussed at these meetings that should not be published...at least until it becomes irrelevant or contractually available.  Some info will be supplied on a confidential nature so the details of any discussion must respect this...although the general nature should be recorded.

Hi, my wife and I arrive in Condado next Friday for nine days and the uncertainty cast over the working relationships between our appointed resort administrators and our owner representatives (which has been a real surprise to me) is what I suspect troubles most of us most here.

I am a penthouse owner and I visit around four times per year. I have never met any of our presidents but I must say I am most appreciative of any voluntary service done on my behalf as an owner. I have had some interaction with the Mileniun site office either by email or in person over the years and have always found the staff to be courteous and helpful, whether this be helping me organise repairs from afar or indeed helping me arrange my internet connection etc.

It seems to me relationships at the top have broken down, and reading the minutes suggests the breakdown is largely but not exclusively along nationality lines ie. there appears to be sympathy from the Spanish presidents for the Mileniun position whereas most of the English-speaking presidents appear to be aligned in their own perception of Mileniun. Perhaps as a Scotsman it is easier to spot this but it looks like right now there is a lot of heat (pardon the pun) but not much light as to what the issues really are. In my experience there are usually three sides to every story...

I imagine (and hope!) that within the management rules for our resort there are mechanisms already in place for dispute resolution if situations like this arise. I simply suggest that these should now be followed. As a further suggestion I think all owners would feel much more reassured if an annual audited statement of income and outgoings was made available to all owners within say four months of the end of each year, similar to what those of us living in the UK receive each year telling us where our council tax has gone. A good start would be to send out the most recent annual audited statement to all owners.

Also I would suggest some consideration is given as to ensuring that at least one President is non-resident on Condado - I think this would have the twin benefits of ensuring that the non-resident perspective is represented in decisions but also help to ensure there is a more distant voice involved in decision-making so that decisions are made based on the information presented and nothing else.

Finally I believe that the most important thing to ensure is that there is no disruption to the management of our resort. So I would counsel against knee jerk reactions - imagine how quickly things would deteriorate for all of us if gardens and communal areas and pools were not attended to for even just a few weeks.

So I will respond to Mileniun directly setting out the above and would be happy to follow up on site next week when I arrive.

My wife and I are celebrating our first wedding anniversary when we get to Condado. I believe all of us owners love our little places in the sun. Let's ensure that we encourage the parties who represent us and who manage our resort to resolve these issues in the proper manner with the continued enjoyment of the resort for all of us being the only thing that is non-negotiable.

I have just read the letter and there does seem to be some big personallities with personal issues going on in the background here  , but if you take out the bickering and tit for tat  at the start of the letter and concentrate on what was discussed in the actual agenda things seem to be progressing ok .

I have just come back from 3 fantastic weeks on site and have met all my friends again and all the time I was there heard no mention of any of the issues focused on in the start of the letter which makes me think that the only people it will affect are the people who have the issues with each other . 

If I have missed somethig here let me know ,

Personally I want to see strong people challenging things that are not right and if people including the management team as part of the administrator don't like it then tough. They are not the people that have ploughed thousands into a country where hundreds of people on CDA have been mis-sold properties due to marketing literature that didn't deliver. Before anyone gets onto me about the world wide rececession I don''t care - noone is bothered about my situation and I have no sympathy whatsoever for companies like Polaris. There are things happening on this resort that we will never really find out about and it is very concerning practices. I am aware Polaris had to declare monies with the local council to deliver certain things on CDA and I want to know what these are because surely 1 of the things should be filling the lake on La Isla. I am fed up of the lies and the under hand way of doing business and I am starting to question who is in bed with Millenium, IRM and worst of all Polaris as the cosmestic stuff gets done each week like cutting grass but when it comes to someone addressing the bigger issues we get no progress.

Time for talking is surely over - its been going on for years. Surely we are approaching time for action as I want to know what my 1200 Euros a year in community tax actually funds as surely it doesn't cost 1200 Euros per apartment multiplied by 396 apartments to maintain this little community? Likewise on the main resort - what are we getting frrom all these 3rd partiies and what level of due dilligence is undertaken when each 3rd party is engaged. I am really struggling to see what I am getting for my 1200 Euros per year when I have an apartment on an island with no water and an administrator that in my view is not fighting our cause as much as I would expect if I had employed these people myself.

I have nothing against the girls in the office but I am personally fed up to my back teeth of listening to excuses and the usual 'we are doing what we can' approach!!

Out of interest, your letter dated 28/01 to ML that you posted earlier in this thread referred to solicitors and national press. What did your solicitor suggest and how has it progressed with ML?

Mark is absolutely correct, every urbanisation needs strong people together with a mandate from owners to ensure transparency and integrity.

It's not a coincidence that many urbanisations have major problems in those two key criteria when they have an Administrator who determines how the urbanisation is operated and when that method is adopted by said Administrator they as a matter of course refuse and obstruct attempts by Presidents and Committeesto bring them into line.

We had exactly the same situation here at MCC and decided to run the urbanisation ourselves, we needed a large team of people but since we took the decision supported very strongly by the owners we have gone from strength to strength. We have no debt, we are making continual improvements to the urbanisation, we have a very low Community fee debt level with much lower Community fees than seems the case in Condado, all of our suppliers know we mean businessand give us a much better service at lower cost than when they were controlled by the Administrator.

We had more problems than Condado as many of you will know but not so any more, our water supply is secure, our sewage system is under control and the waste water is now fit for and used for public garden irrigation, the urbanisation has never looked better, we have a large contingency fund for any problems that arise and shortly will commence the work to finish the urbanisation infrastructure.

It has been hard work and if Condado is considering a similar move be prepared for stuff to emerge from dark corners and woodwork but the rewards are there if you can do it and make it work, if we can help please don't hesitate to contact me and we can chat but please don't think it's going to be easy because it won't be.

Well said Mark and Barry!

How many people work in the ML office? half a dozen? and they can run CDA? If you can't find that many people on a resort the size of ours to run it 'in house' then its a poor do and I persoanlly think that our presidents should at least take Barry up on his offer to meet and explore the possibility. Don't get me wrong it may not be something we could achieve but it has certainly got to be explored.

I, for one, was impressed with the staff in the ML office and they are always very helpful but I am bitterley disappointed at this correspondence that has been sent out, they way it is written and also the timing of it being sent out.

I manage numerous facilities in different locations in the UK and yes there is a pain barrier to get through setting everything up but once it is set up it runs very smoothly and you just need to regularly monitor it. I have read on this forum that if ML leave it will fall apart, absolute rubbish, with the financial state of the world and particularly Spain companies will be falling over themselves to offer their services to our resort
