Dear All

I have read the letter a couple of time again this morning and if what ML say is true, Phil Tann shoudnt stand down he should be sacked.

How dare he stop the weekly up date from ML being issued each Friday.

When I am out next I will ask him directly why he has stopped this, if fact as I know Phil reads these threads maybe he would like to tell me, us why he has requested that the news letter isnt issued.

I am trying to look at a balanced view from both parties.

What I do know is that two wrongs do not make a right.

Although it is tempting to reduce to these tactics and it has certainly generated some favour for ML, it is times like these where the level headed stand up to be counted. I am sure that Phil Tann will do so, I am sure he has made mistakes, has no one else? - For all of you looking for the ideal candidate and perfect president keep looking as it will not be in my life time. A thankless task certainly from those who see a snapshot.

For those of you sat by the pool visiting, would you be be prepared to jump from your lounger straight down to the office at a moments notice.

I don't know who is right and wrong but I encourage everyone to keep an open mind and look for solutions rather than looking to hang people high!

It seems that so far we have managed by adopting an 'amateurs night is all right' approach to resort and estate management which has worked well up until the water supply situation a few weeks ago blew the lid off the relationship between Polaris, ML and the president(s).

As soon as that happened with the sums of money involved in putting things right, you could almost palpate the heart beats of those who suddently came under the spotlight for being caught out one way or the other - no ones fault - but things had escalated beyond the skills level of most involved.

What this means for me is that CDA is growing at quite a pace now which is fabulous and we have seen the benefit this year in particular of some excellent management by ML. The festivals and markets are just two examples of that. If the resort gets any bigger, and who knows if Paramount ever takes off it will, then an amateur volunteer situation will not suffice.

From what I can see the concept of President is akin and intended to be rather like a Neighbourhood Watch Coordinator in the UK. Someone who looks out for and represents the views of fellow residents. Once the expectation goes beyond that role then the requirement for a skills set is completely different and not usually one you can get for free.

Probably time for the committee to consider hiring a professional Chief Executive or Estate Manager who has extensive experience of this type of challenge and who has  strong interpersonal and diplomatic presence to take on Spanish bureacracy, ML, Presidents and not least Polaris, as they started all this trouble with the water supply debacle. (No I am not touting for a job as I already have one).

If we carry on expecting volunteers to take on the growing demand of this resort, we will either continue to get shafted when negotiating important contracts for services (Water) , or start to see increasing dubious practices in how decisions are handled by a minority of people who have less and less accountability. I am sure all of our Presidents, including the level 1, did not envisage how demanding this role would be, but without them we would be in a very vulnerable position.

Regarding email send to the owners at Condado de Alhama Thursday August 09, 2012.

First of all I will express my concern regarding the lack of communication between Mileniun and our president. As an “old man” I do believe there is at least two sides to every story. I also believe that bringing out names in an email like this only gives “gasoline to the fire” rather than solving the problems. I strongly hope that both parties “cools down” and continue working together to the benefit of our community. I still believe that the improvement of our resort the last year is the joint work of our presidents and Mileniun.

As an overseas owner of apartment I have to have confidence that all, our presidents and the companies that do work on the resort, do so in an honest way and that there is no conflict of interest what so ever from anyone.

1.       Communication : Information should be totally open, from administration and presidents of each level. If all parties works together that should not give any problems. If any incident (like this) arises, I as an owner then have a better possibility to make up my mind if it is the presidents that have to step down or if we should seek for a new administration.  The information should be signed according to the position they have.

2.       Bidding process : For the major maintenance contacts there is no other way than a bidding process with sealed envelopes. Then a committee, where also president of level 1 takes part, should open all the envelopes in a meeting and report every bidder and price. Then the administration company should go true every bid to see that is has the quality that is shall. That the bidder has the capacity and economy to for fill the contract. If not those companies should be disqualified. A full report with nomination should be handed over to the presidents for decision. Every owner shall have the right to see this report and the argument for the decision.

3.       Illegal work : Both, our presidents and our administration company, should see to that every job made in the name of the community is done according to Spanish law. That the companies are legally registered, have no outstanding regarding taxes, payment to the works and so on. What persons do in there own name the community can not be responsible for.

4.       Management :  Self management is not an option. No representatives or owner of apartments at Condado should be allowed to have interest in the management company of the resort. This will be a conflict of interest.

So once again I hope that all parties take a step back. Put disagreements behind them. It is a waste of energy getting stuck in what has happened. Sit down and make solid rules of how to manage the resort and system to follow up the work is better use of energy.

What is the purpose of this e-mail?

Is it to warn us owners that we are going in the wrong direction?

What about the other Level 1 presidents?

I don’t want to be run by volunteers, that clearly doesn’t work.

I would also like the resort run by a professional company that IS ACCOUNTABLE to his employer, us the owners.

As always there are always 2 sides to every story.   I am sure that Mr Tann has made mistakes or do not fully understand the Spanish culture.

 
I am Dutch, but live in UK. Yes there are differences but as ML manage a resort with alot of Non Spanish owners, our cultures much be taken into consideration, as well as us the foreigners must take the Spanish culture in to consideration.

I don’t know Mr Tann, I don’t know any at ML, but I am sure that all of you have the best of our interests at heart. As ML is a company they must also look at theirs and that is to make money.

ML considers to be a professional company, please resolve this issue professionally.

Although I do think the personal attack is not very professional, I do appreciate the communication to advise us owners that matters are not as good as they appear. I also agree that L1 presidents should tell us if they have major problems with ML. We can then ask you to respond to the problems raised, which they don't

 However apart from the water irrigation situation we have not been informed of any problems.  I know the presidents are volunteers, but they must communicate those issues before they escalate.

ML do have my support in resolving the situation with all 3 L1 presidents.

I trust you will do that in a professional manner.

As to the accusations of tax evasion, IF it is true I cannot condole it. We also run a company, pay corporation tax, VAT, PAYE etc etc. That is how the system works in Europe. Any deliberate tax evasion which give a company/person an advantage over an above board company is immoral. End of..    but i do say "IFit is true"

When I added my vote for ML in the wee small hours I had not read the enclosed letter & just thought that it was a case of - do you think ML is doing a good job or not. I think they do, hence my vote.

I imagine there bemused and wound up about phil not taking bungs to not see things,just an opinion

I do so look forward to the Level 1 President having his say.

Is the letter that I received from ML factual, if so please step down from your position, if the letter is not factual, full of lies and slanderous comments, then you have my support and  please take ML to court for slander and defamation of character.

I agree with Jan in that I have no beef personally with Phil and he does deserve the right to respond to any accusations levied against him. And yes, there are always two sides to every story.

 I do, like her, still think that ML are doing a sterling job and would very much like them to remain on the resort working for the community. 

 I have been waiting for "the other side" to respond as well.

I imagine there can only be 2 possible outcomes from this email

1) Mr Tann sucessfully sues for Liable

2) Mr Tann steps down

I cannot foresee any other possible outcome. Although if the accusations are true, Mr Tann may have more problems with the spanish inland revenue, than ML?

I have also heard that the pinata at this years Medieval Festival will be in the shape of Phil Tann.

i live on the resort and see things on a daily basis,yes the feistas are good but when the budget is spent but only 85% of it accountable for alarm bells ring,this is why i think ml have witch hunted phil just to throw up a smoke cloud and get him out,there are 2 sides to this story

You are right there are 2 sides to the story and I am waiting for the other sides story, on the point of only 85% of the budget that was spent on the fiestas being accountable for, where did you hear this, who told you of this so called fact.

I would be keen to know what ML have to say about this and I am sure that they would be keen to know where this information has come from.

Firstly you only have to read the official minutes of the presidents meeting to know that Phil T isn’t a dictator and he promotes and insists on democracy and openness, in all matters. Read them before you rush to judgment.

ML has waited till Phil T is away on holiday to launch this attack.

Many of you on this forum know Phil T personally and know the commitment and hard work he has done for this community.

ML, DO NOT Allow the Presidents to communicate with the owners that is why you do not see anything from Phil T or any other president on ML web site, and they send out their Friday update from themselves only and do not allow input from presidents, o and if as ML say Phil T stopped them from sending out the Friday updates just check back in your mail box and you will see they haven’t missed any of them and the content hasn’t changed either.

In my opinion about Phil T making money from you without paying tax, those of you that bought this equipment from him will be aware that he imported this equipment and sold it on for less than you could buy it for from anywhere else, I don’t believe he could have made any profit, I am not even sure he will have covered his costs properly. And again those of you that know him know he is always happy to tell you were to get the best deal.

Your presidents have no way of communicating with all owners only ML has that ability.

It’s not for me to answer all these issues but you can be sure they will be answered.

I know Phil T personally and can vouch for his integrity and honesty as I know many of you can also.
