we are still owed €11,000 which was our intial deposit for an Aroma Bungalow in 2004 that was costing €104,000 and we were also very very lucky to get back 2 stage payments that totalled about €70,000 after a long complecated fight!

I 'wish' that we had gone down the MCC route and had somethng to show for all our efforts but at that time they were asking very a very high price, something like €180,000 and so we said no and pulled out of the null and void purchase contract 2007.

If we had completed on the Aroma my worry today would be that it would only be worth in the region of < €60,000 probably less. So a net loss €44,000 in equity and probably no chance to sell if any planning anomalies. Perhaps the 'gods' were with us and hind sight a wonderful thing ...................

But I know for those in a much worse situation this is all terrible and I hope that people in authority in Spain find a solution and repay what is owed to so many 1000's of people.

i agree the tarifa at Acc costing about £80.000 would not even be worth 50k,  huma would have never built the shops/bars/clubhouse/stables all the things they still have never built at Mcc,  making sales very difficult,  we would have all had  the Mcc problems of no elec/water contracts after years of lies..........BUT Huma still stole our money and the courts know it but do nothing...

Finally there is  an Abogado willing to take on Huma/Banks on a no win no fee basis.... there was an article in Round Town News this weekend saying if you have proof of payment of monies for Almanzora Country Club into BANCO POPULAR SA, BANCO DE VALENCIA OR BANKINTER he will take your case on a no win no fee basis.

At Last...... just make sure the deal is no refund, no fee.  No win, no fee is slighlty different as you may win the case but as in most cases they refuse to pay!

These solicitor posted in July last year saying they would take a case on a no win no fee basis - see

So this is not new - having said that I am not saying using them is a bad idea just that they were advertising this last year

They ae following the trend of going for the banks based on the law currently being very successfully used by others that says banks have a duty to issue BG's and not doing do does not excuse them their legal obligation to have done so.

Huma has nothing the banks have..... see the Finca Parcs success and go for it, you have nothing to lose.

I am not advertising I am an owner and President on Mazarron Country Club where Huma still exists and just trying to do my bit to help all you people that have been ripped off.

I represent a number of purchasers in varios developments who did not receive the property nor the funds paid.

I guess that this is your case also.

Although we have obtained a positive judgment against the developer, the problem comes when the funds have to be recovered. The companies do not have assets to pay back the funds.

In the last years, we have obtained positives results going against the bank that have received the funds paid by the purchasers. Even when no bank guarantee has been issued. 

Please, let me know if this would be an interesting option for you or any other buyers you may know.  To be able to claim against the banks it is basic that the property is not finished and the funds were paid to the developers bank account. 

if you are interested or know something who may be, please let me know. We could even have a meeting if there is a number of people interested. We work on a no win no fee.
