  Hello One & All,

I too have heard the water is back on, at least for now!

I would just like to let you all know, I have sent an email to Justin Aldridge the editor/owner of Eye on Spain, letting him know the situation. He may know someone that can offer us some advice, it can’t hurt to ask!

I have booked a last minute flight out to attend the meeting on Wednesday; I wish it were better circumstances that I will be meeting some of you under.

I had the not very pleasant task today of letting another owner know about what has happened. His family and friends were due out for a holiday in early April. I wonder how many other owners have no idea what is going on.

If I get any more updates, I will post them.

hiya does anyone know if the electric has gone back on. we are due over on Sat for a few days. just wondered if we were going to be able to stay in our apartment or if we need to find somewhere else to stay.

I read an article on the internet last week that was written in The Costa Blance Leader a few years ago and it is potentially about a similar situation to what we are now experiencing, although i'm hoping their situation is worse than ours!http://www.costablancaleader.com/news/article.php?article_id=3750&article_section_id=1

 

I contacted the paper to find out if they had contact details of the lady mentioned as i thought it might be useful if I could speak to her directly and find out in practical terms what they had to do to resolve the situation.  The paper came back to say that they didn't have her contact details but that they might be interested in covering our plight in an article.  If we don't get any joy at the AGM are can't get things moving in the right direction, it might be worth contacting them to put a request out for some assistance.  Maybe someone might read about it and be able to help us.

I know this is not our priority at the moment but worth considering if we are getting no where in the short term.

You would will have seen in my last post that I contacted the editor of the Eye On Spain site, to see if they could offer any recommendations.

The following is a copy fo the email reply I received today, interestingly is that the same thing happened to Susan who responded to my email !!

Thank you for your email.There are so many factors here. The dirt track outside could be a town hall issue. Without an administrator on board and consequently no president there is nothing that you can do.You need to get Juan Carlos on board to get things rolling. If the developer is still the majority owner they still have a responsibility to keep it going. It is very complicated and depends on the state of completion.I would also go to the town hall en masse since they have an obligation not to leave people living in the town without electricity.  The best contact that I can give you for this situation is the lawyer Maria de Castro:

Your story is not an uncommon one and we ourselves went through exactly the same. Things started to improve once we had an administrator. Hopefully it will be resolved soon.

We have also bought an apartment in the Vegamar complex and are due out on 17th April.  The situation is very worrying and with all the conflicting views on this website it is hard to know what to do.  Anyone have any clear cut suggestions as to the way forward.

Hi All

I haven't completed on my property yet but just got an email from Atlas saying the builder (Idearco) wants to complete for the dates 8th April and 10th April. Im really confused as to what to think.

I thought they are going bankrupt and so can they still complete on the property? Can anyone advise on what I should do next. Can I still complete on my property then? Why are Atlas still business as usual? Thanks for any replies.

Hi all

Ihave recived an email from the administrator in this he says that there should be no problem with the water it will cost us around 250 euros to get connected the problem is with the electric the installers are owed over 80 000 euros plus the last 3 electric bills are un paid around 7000 euros all togeather  we will find out more after the meeting tomorrow

Hi Naj,

This news is very confusing, i am carol resident on vegamar 1, we got our electricity on late today after nearly a week with only candles, not nice i can assure you. not sure how long it will stay on for, so am trying to read all and update my keyholders before it goes off again.

our meeting with juan carlos is tomorow, and hopefully an independent solicitor will also come. the newspapers should come in the afternoon. however really interesting, atlas have been saying they are really surprised about the situation here, and they were going to attend tomorow, a lady called angie, and another person, however today my neighbour got a call from atlas, saying they could not now attend as they had a management meeting to go to!!!!. quite strange as now they have told you to complete.  my advice would be to definatley ask them what they are up to as something is not quite right.

for everyone else, i will post an update on this site tomorow after the meeting and let you know what happens

Dear Carol,
Thanks for keeping us all up to date.  Hope you still have the electricity  and water, it must have been very grim, even if the sun was shining.   I was due to sign on the 28th March but it was cancelled by notary and because I was not happy to sign after consulting a lawyer in London.  I was surprised to hear about Atlas and the signings as it seems from the letter from Juan Ballester that Idearco no longer exists, my lawyers, PSI say that they have been unable to contact anyone at Idearco.  I hope the meeting will give us some further information and that we can get this mess sorted out quickly.  Look forward to reading what happens at the meeting.

Hi All

I am also a owner in vegamar 1 Escalara 2 and my father is out there at the moment and was at the meeting

from what he understood a community is going to be set up and electricity meters put in,there is a debt to pay of 7,000 euro for iberdrola and the 100 owners will all have to pay 70euro each

not sure what else went on but hopefully carol or someone else who was at the meeting will update us soon

Hi All.

Just to let you know, there was a vote at the meeting and the community has been set up, i have been voted in as president, a vice president from the spanish residents, and i beleive about 7 commitee members comprising of british and spanish owners.

I did not put myself forward, this was done by all the british people present, i am still a little surprised at the dubious honour!!

there was quite a lot of arguing, re the spanish as they did not want to appoint juan, and wanted to get other views from different administrators, this would have taken they said another 20 days, the british did not want this as we could lose the electric again at any time, basically the spanish did not want to pay anything and want to fight the town hall, builders etc before paying, juan had told us previously this was an option, but that if we did not pay the electric it would be cut off. with respect the spanish have family and friends here they can go to, obvioulsy the brits cannot.

we all voted again and juan carlos was appointed our administrator, i believe he and i are going to the town hall in the next couple of days to register the community and see if there is anything they can do to help us.  however after he left the spanish again said they were not happy, and they bought in a translator as they said maybe juan had not translated properley to us. the translator did not tell us anything different to what juan had alreaddy said, but to keep the peace with the spanish i agreed to the translator commong to our next meeting which is on monday at 6pm ( for all who are over here, ) the spanish were happy with this, and went away smiling, unfortunatley at that minute juan came back and 1 spanish lady was left who started arguing with him, they want to go an denounce the builder, town hall etc, as he then said if we do this the police will come to inspect, find the electric on and then we will be in trouble, at this he said maybe the electric must go off today. i argued this and so far it has not gone off, but if you dont hear from me you know its gone again, in the end after nearly 5 hours there i left him arguing with the spanish lady, he is going to telephone me, but not heard as yet.

the coastrider newspaper is comming tomorow at 1 pm. to cover the story.

i think that is it in a nutshell, other than the builder owes 3 elec bill, totalling approx 7000,00, juan says if we pay 2 bills, we will keep the electric until may, when the 3rd bill must be paid. an idea from other communities is to get a bank loan in the commounity name, and this payment will be added to the service charge of all owners in the first year, this saves having to take different lump sums from people. the water is easier, if we all pay 60e, althogh the water company are owed 32000.00 they will put in our personal meters, and will not chase us for the arrears, but will go to court for idearco to pay.

the electric meters cannot be put in until all arrears are paid and a certificate from the electricians is obtained, this is harder to do as the builder owes the electricians 80,000. however we do not have to pay this, we can fight this with the town hall to give us a certificate  without first obtaining the electricians one, this may take time though and until then everyone would have to pay the electric bill, as communual.

re completion, a couple were here today, that should have completed today only the builder cancelled, they were advised by the solicitor present to complete, as this way they would still have a property, albeit with utility problems, but better than nothing.

i hope this helps, must fly now, trying to do all my emails in case we are cut off again.

thanks for filling us in

there is one major problem i can see and thats this electric thing,if we all paid it as a community then it wouldnt be fair on most of the owners who are hardly there as they would be paying the same amount as the full time residents so this wont work imo

also was anything mentioned about the roads,swimming pool,broken doors,snagging,and cleaning up the area?

Hiya I am for one glad that we have had some progress on this situation. I know we would be paying for all electricity for the people that are living full time but for the little it will cost surely it would not be a problem for the short term. We are going to have to pay towards the bill that is outstanding for which the perm resisdents have used some of this as well as most of the building work finished a while ago. It could be a lot worse.

At the end of the day its a means to an end we need to get the electric on properly so what ever it takes and even if it ended up costing all 100 residents 100€ each to keep it on and get our own meters fitted then I personally have no problem with it. The only thing I would like to know now is how much the electric meters are going to cost to put in and connect us to our own supply.

We are a comunity now and that means we all have to pull together to get things sorted, its not the fault of the permanent residents so why make them at fault.

I dont think the situation is as bad as it could have been. At least we have options that arent going to cost each owner 1000's

Anyway thats my bit said. Carol and the other members of the commitee will do what is neccessary to get our community up and running and vegamar looking its best so that we can all enjoy it after all thats why we brought there.

Paul and I are going over on Sat so will be at the meeting on Monday. I am glad as this will give us a chance to meet everyone who will be there.

My Solicitor is on the case with regards to the utilities so I will update when I hear anything.

hi all,  good to hear progress is being made.but what is happening with the €900 we paid the builder in cash at the notary for the connection to mains electric and water.personally i am not happy about paying a penny for something we have already paid for.you can bet your life that the builder is not sitting at his luxury villa without water and electric ,yet still have the nerve to take our money.at the end of the day these things do not happen overnight he must of known for months that he was going to have problems with funds to pay for things. hopefully things will be all sorted in the not to distant future.  limetree

Hi all I hope you all have water and electric as we will be ariving next wed for our first stay in our new appartment and we wont have any of these problems with Builders because Atlas only deal with reputable Builders who dont rip you off all i can say is all of these 900euros we all have paid must have been for her makeup.

Can anyone advise how much cash i need for bills and where to pay.Or will this be sorted by the community and added to our charges

Also a big thanks to all for getting as far as you have under very difficult circumstances
