New batch of photos. Has anybody got news of the Habitation Licence ? Have tried to make contact with sales office but no reply to phone calls.Our lawyers have no news of progress either.

Contacted Mijas Town Hall re Habitation Licence. Got back the standard reply ,it is with the Technical Dept. I did ask when the application was submitted but .they failed to answer this ,I believe it may only have been made recently.

I have been to the site a lot as i live in spain and since november different departments have been on site from the town hall since november when the licence was applied for i have texted the sales office and she has had proplems with internet and phone, let you know if i here any news.

Has anyone heard anything else re the habitation licence...as it's now over 6 months...it may just be that the local council is taking things slower re the court cases....anyone have any other ideas?

Hi All,
Went to Mijas Town Hall on Thursday 8th May and spoke to Louisa Machen ( lmachen@mijas.es ), I THINK she's English, in the Foreigners Department (tel. 952 58 90 10) there.
The Building licence number is 425/01 and the 1st occupation licence application is 188/07, according to her.
She also said that the technical Department found much uncompleted work and informed smd to re-apply when all the work was finished. Up to date they have not re-applied.
She said that from the date they re-apply and all workmen are off site it will be approximately 12 weeks to the issue of the license.
Then it will be however long it takes our lawyers to get the completions done.
On Friday 9th May we went to 'La Condesa' and met Lourdes who explained things differently. She also said her internet and phone connections have been disconnected by the developer but I contacted her by email to book the appointment so I'm not sure what she was talking about or if it is working now.
The land behind blocks 6,7and 8 has been cleared to build villas. We were told it would not be built on but it will be a little more secure than rough land. This message was last edited by sandra on 5/26/2008.

Hello everyone, i spoke to lourdes yesterday and she told me the Boss not the developer went to the Town Hall on Thursday they are waiting for one document 134/07 which is to do with the opening of the Garage doors, and the first occupational licence 188/07 which is water meters, electrics etc. If anyone is concerned I should phone her and she will explain, I'am sure it won't be long now.

I can only assume that this is the boss as my husbad actually met him in January this year when he asked our lawyers to arrange a meeting with the developer to discuss our own particular situation. He is also one of the people in the latest photographs.
We do seem close but I just wonder how much longer we will have to wait and I am just itching to get in.

Hi I know the developer is going to the town hall all the time to chase things along, they want there money as much as we all need to complete, I know Loundes who works for smd has been very helpfully and you can always e-mail her or phone, if I do hear anything I will let you all know.

Hi I have been informed by my solicitor today that the developers have been asked to carry out addtional works before a FOL is granted. With summer coming up this could delay completion things for awhile.

I don't see why the developer is going to the town hall.....surely with all the corruption cases the town hall doesn't take kindly to being this type of behaviour.
I know that the bank guarantee is not valid once the licences are granted!!

To all those who are purchasing a property in La Condesa.
We have all been given, at some time or other, a completion date, and we know how those have been and gone.
Should we all look for some kind of compensation, after all, some have lost over 2 years rental, all have suffered the fall of the euro and so will finish up paying more and then there is the actual property value.
Cannot we all get together to force some kind of compensation - I spoke with my solicitor and Spanish law requests us to pay the balance of what we owe and then claim back compensation - this will not work.
If we do not pay we will not get the necessary completion documents.
However...................
What if we all threatened to walk away at the last minute, even though it will mean the loss of the deposits, unless the seller reduces the price?
The developer must be desparate for the balance of the money and the interest he must be paying daily.......
Your comments most welcomed, but soon, who knows completion might be just round the corner, somewhere, sometime !!!!!!!!!!!!!!!!!!!!!!!

Hi, interesting you have only made 1 posting...where have you been?
I have won a case for a refund...however, due to the obvious appeal I am still ' in the system'.....to date I have paid just shy of 10k euro and am being asked for a further 8500 euro.
I am totally devastated by the Spanish system and have had an article printed in A Place in the Sun.....obviously making me look a chump!!
I think, unless you can access ALL deposit givers...not owners...you will have a job, especially given that you haven't posted before!!
