we did the same. went to a reputable legal firm in London. Had POA docs raised, certified a copy of our original BG and contract etc...
It was more costly but seemed to have more clout back in Spain to get this resolved. (well I like to kid myself it did anyway !)

Thought I would share with you that our executed BG was refunded today by the Banco Popular, Mazarron. It took 3 months and a fair amount of hard work by our solicitor. (They kept postponing meetings and playing the delay tactician game).
POA was given to our solicitor in April 08, although our notice to Huma was originally Jan 08.
Huma still owe the first instalment but continually choose to ignore any correspondence about that so litigation is under way. (Believe it)

Fantastic news! We're very pleased for you Philmel. Your solicitor sounds as though he/she knows his/her stuff. Keep going till you get every penny plus interest and if you can, some compensation.

Yes our solicitor was very good and worked hard for us (up against her own Countries beaurocracy and mixed laws / changing goal posts - not easy)
She now has a very heavy work load, as you can imagine.
But if anyone wants to make contact with her please PM me for details. What I do know is, that she has good contacts in her field and profession! Her base is Vera town.I would recommend her, but remember, this refund business takes time , many say too long. I don't think any solicitor will get a fast result sadly.

We are so pleased for you. We have been waiting since August last year for the bank to execute our guarantee so you have done really well !!
I hope this gives everyone some hope and keeps people motivated to carry on fighting for what after all is their money !!

Do not post here a lot now as I have moved on[ no ACC BG!]....but
If you have a BG at ACC...you do have to press your lawyer hard to get your money back
Legal BG are ' as far as I know' no problem
When you get your money back from the BG, if you bring it back to UK , then a nice exchange rate
But if you like this location....and you have €'s then you can exploit the exchange rate in your favour and get a really good buy
The market is now slow to but do not wait too long!!!

Are you for real. You say you are an agent...No wonder you fell prey to Huma at ACC. HOW can you justify telling people to hurry while stocks last like a DFS salesman to purchase in Spain at present.
People are aware of all the corruption
People are aware of illegal builds
People are aware that the property market is on it's knees, not just here but everywhere
People are aware that OTCC is not fully licenced to sell ALL of it's properties.
You think that now you have an insurance policy in place (maybe) you are safe. Think again...people on ACC had a bg ....that did not matter at all.
So what if OTCC has showhouses...so did ACC
Until OTCC is ready for families to move in my advice would be to keep quiet. YOU do not know what the outcome of OTCC will be.

Agree, agents will stop at nothing and even stoop low just to get a sale. What agents DONT tell their clients is that if they have a bank guarantee it will cost 2,500 euros to execute it. Our agents didn't mention that it would cost us to get back our own money!!

Hi,
I think Brian Rowlands is such a sad case I can almost feel sorry for him. He is still trying so hard to impress us with his knowledge which in actual fact is sadly lacking. No one would think twice about his dealings with Huma, we have all made the same mistake with ACC but to encourage sales at OCC is just too much, one mistake is enough.
Huma certainly won't get any more of my money and I was without a bank guarantee - will I get my money back through the courts? I don't know, we will just have to wait and see but certainly Huma won't get their hands on any more of my cash.
Good luck to all who have had money back, well done and for people who have transfered to OCC I do wish them well and hope it comes off.

Just had confirmation that one of my bank guarantees has been returned to my solicitor from Banco Popular, and now in my account. The other from cajamurcia is held up because the person is on holiday (back next week so fingers crossed).
Think thats about 9 weeks since visiting the new solictor, so i didn't break the record...!
As a side note, had Huma phone me 4 times since the solicitor put things in motion to cancel, trying to get me to transfer to MCC or OCC - makes a change from them NEVER returning a call - even when i enquired about an upgrade on ACC prior to the last bomb shell - may be they knew it would be a wasted call !!!

At long last I have my 61,000 Euros refunded from CajaMurcia. It cost 1300 to cancel with Huma and execute Bank Guarantee and all in all it has taken 15 months. I didn't get interest or initial deposit of 3000 Euros and I have to let my solicitor know what I want to do . He says he will also ask for compensation. Trouble is my heart says I don't want Huma to get away with what they still owe me or they will continue to act in a contemptible manner toward other buyers as long as they keep getting away with it. On the other hand my head says what are the chances of me actually getting anything back in this current climate, there is too much uncertainty out there for people to buy at OCC and ACC ( if it ever gets the go ahead) Some long and serious thought is going to be needed and I will let you know what I decide.
I have been in touch with Maria De Castro and she has been helpful, and I guess I shall seek her opinion on this one, she is one clued up lady and is not afraid to go head to head with the big guys and if I do decide to go ahead I will ask her to represent me.
