Hi All
Has anyone completed at the development yet? We were under the impression from our agents that some people had already completed, but looking at Helen's email I get the impression that all the utilities are not up and running yet. We're getting really close - the date we've been given is within 14 days of the 30th November

It would be intersting to know if anyone has completed yet and if so did they get a Licence of First Occupation issued?
If you read the postings on the General Topics side of Eye on Spain it would seem to be a big issue and that it is essensial that this is done at the time of completion. There are some horror stories of people completing without them and then still unable to get them several years later, resulting in loss of power and water services. Furthermore it causes problems if you ever want to sell. So just be aware.

Hiya
To be honest the impression I got was it was highly unlikely anyone would be able to move in before christmas. I could be wrong as they were a little vague, but I'd get on to your sales reps or Taray to clarify. As I mentioned there are no proper roads and the water etc is not connected yet.
My Mum is still out there so I will try and find out when they expect the first lot of people to move in.

Has anybody completed on site yet or got actual completion dates at the notary?
We got a letter from Taray in November saying we would complete within 14 days of the 30th November, then were told it would be end December, then we got a letter from Taray on 21st December to say the house is ready for occupation, but now the solicitor says they are waiting for paperwork from the land registry.
From reading the posts on this site several people appear to have the 31st January, but just wondered if anyone had confirmed dates prior to this.
Tricia - It sounds like you are close to completion

We too have been told by Taray that our property is available for completion but like Dave & Janet we were concerned about the risks involved should we complete without the necessary paperwork being in place. We contacted the broker who is arranging our Spanish mortgage and this is his response.
Hi Elaine without Licence of First Occupation you will not get a mortgage. Nor indeed would I recommend you complete without it. It depends on the state of the urbanisation as it stands whether the Licence will be given or not and it will be the Land Registry assessor that decides when this should be granted. You are correct that if the infrastructure is incomplete then the Licence will not be issued but it depends on how crucial the infrastructure is to your dwelling. To wit if the urbanisation is being developed in stages it may be deemed that infrastructure crucial to those houses ready to be released is complete hence the Fin de Obra (end of works) is signed off and the Occupancy Licence can be issued. It might be worth asking your lawyer if the Fin de Obra has been formalised and if not when do they anticipate this and hence the 1st Licence.
Our lawyer -who has Power of Attorney - has confirmed that he will not complete until the Fin de Obra has been formalised and he is contacting Taray and the Land registry to check on it's progress. Hopefully everything will run smoothly and it will be granted sooner rather than later.
Has anyone who is nearing completion done a "snag" yet on their property and if so, how did it go?

Hi All,
I had a phone conversation with our solicitor yesterday and he sent an email to confirm all that was discussed. I enclose below a portion of it which will be of interest to those who's completion date is the same as ours.
Dear Mr. McMenemy:
As continuation of our phone conversation I wish to confirm you that we have checked Taray has not got the Habitation Licence for plot 3 in Hacienda San Cayetano (they just have Final de Obra). We actually are in the legal situation to wait until they get this licence or go ahead with the completion. Please bear in mind that we could not contract water and electricity till they get the previous mentioned licence, but the builder will supply those utilities from the build.
We have been advised by our mortgage broker and solicitor, that unless we are in a big hurry to move in, to wait until all the paperwork is in place. No idea how long this will take, but we have decided to take this advise and sit tight.

Hi all,
we chased this matter as we know that, if you leave anything to the Spanish, nothing gets done.
We were given a notary appointment for mid January but we discovered that this is now cancelled because Taray have not yet finalized the property registration process. Pity they didn't think about this before sending out letters claiming the properties were ready for completion on December 29th.
Sadly, like every other company here in Spain, whatever their business, Taray are in need of serious guidance about customer service.
We have now been told that we should be completing sometime early in February but we will believe it when we see it!
Anybody else being told something similar would be advised not to hold their breath! Still, house moves anywhere are not known to go smoothly are they?!

Hi All
We have a notary appointment for 26th January, however it is looking unlikely that we will be able to complete then.
We have had an update from our solicitor & the new building declaration deed was presented by Taray to the land registry on 27th November 2006. Taray are now putting pressure on the land registry office to have this document registered and have been told this should happen by w/c 22nd January, but who knows what will happen?
The builder will then sign the end of works deed approximately 15 days after they receive the land registration.
Our solicitor informs us that Taray have not appled for the Certificate of Habitability (Licence of 1st Occupancy) yet, which would mean we would be on builders supply.
Our understanding was that you should have the licence of 1st occupation when you move in, does anyone have any further information on this?

Hi Sue & David,
If you read the postings on the general discussions side of this forum, the advice there is that it is essential that you get a licence of first occupation before completing. Many have suffered badly because they did not get one and some have not got one after years of trying. Major problems with utilities supplies and if you ever want to sell the property.
Can't see a problem with Taray not getting the licence as they are a very reputable company.

Hello Everyone
We have purchased an apartment that overlooks the as yet unfinished inner row of detached villas and triangle shaped communial area. Has anyone got Taray to confirm when both are scheduled for completion as both look a long way off being finished. Both will have a detrimental effect on rental income for our property while they remain work in progress. Does anyone else share our concerns?

We have corresponded with several people who have purchased on the Taray site at Torre Alacantara & they all appear to have completed without the licence of first occupancy.
Our solicitor confirmed yesterday that she has no idea when Taray will get this.
As you say Taray are a very reputable company but it is quite concerning that some people on the other site have been ther for 3 months plus now & still no sign of the licence of 1st occupation

Hi All
We have just returned from Spain.
We did not complete as had been planned. We visited Taray head office on Monday & they have now said that the property registration will happen in the next fortnight which has been confirmed by our solicitor. Both Carrie at Taray and our solicitor have said that the habitation licence (licence of first occupancy )will not be granted until the whole site is finished sometime in 2008 & we would be on builders supply until that time. We know someone who owns a property on a Taray development in Los Alcazares & he did not get his habitation licence until the whole site was finished some 18 months after he completed, but said this was not a problem as he got free water & electricity & there were no problems with continuity of supply.
It is very confusing as most people say that Taray are a very reputable builder & you are quite safe to complete without the licence as they would not tarnish their good reputation, however we have been reading the SOLbank magazine & there is an article in there about Camposol near Mazarron (not to be compared with our lovely site, I know) where residents are still waiting for a habitation licence 8 years later.
Some people have completed on our site & apparently some were moving furniture in at the weekend. Not sure how they got on the site as all the access roads appeared to be sealed off, but we have been told that the access roads should be open by the second week in Feb.
When we visited the site again on Monday we had to wear hard hats as the builders were there - therefore seems strange that completions are taking place.
What are everyones views on completion?

if what you say is true and i have no reason to doubt it, this is very disappointing news indeed. as i mentioned to you in my email last week, i feared this would happen, regards the time scale and regrettably it looks i was right.
when we initially paid our deposit on our quad a year ago in feb 06 we were told it would be ready feb 07. to be fair to taray the house is ready on time, but without this licence! it's quite simply unacceptable to us that no one, from our solicitor, to our agent, or taray themselves, brought up the subject of this licence and it's significance to our attention. last feb on our visit we seroiusly concidered a resale in the area. i wish we had done! if we had, we could be holidaying in it this year !
elaine and i are across there next saturday for 4 days and i will be discussing a lenght with our solicitor the terms of our contract and any options there maybe to pull out of the contract. we will see what he says, but i fear we may have to sit and wait until the whole site is completed and this licence is granted.
when you say 2008 i fear this may mean 2009. i don't expect the town hall to be waiting pen in hand to sign off this development and issue the habitation licence the moment the site is completed ! it maybe the case that our development has to wait in line behind others.

Hi to all you lucky people due to sign and take possession of your properties???? We visited the site on Thursday
and found we no longer need to wear hard hats and that all the barriers have been removed from around the finished properties The sections still under construction however are now totally barred off ,So we can no longer get in to look at our progress through the week We can get in only at the weekendstill 2 pm
We are keeping our fingers crossed that all will turn out well soon and that you can actually all move in
By the way David the weather on thursday was glorious
