 I was not picking  on John G and in fact find his information far more straight forward and honest than yours .I will not be bullied by you and will ask whoever , whatever whenever I want on this forum with out seeking your approval or permission.Who do you think you are  ?
Why don't you read over your posting of said letter and ask yourself how misleading it is .For instance you state you have highlighted in blue.You do not say what is highlighted or why. Is the highlighted text you words, thoughts or what you have been told or are they part of the original letter . Who knows because you don't make it clear.
For a long time now when I slag of SARCs literacy levels or the lack of them you thought I was being catty . Not once were  you able to take on board that what I was trying to say  Which was that without care to such matters your postings here and on the SARC website can be completely misunderstood or  the meaning of what is being said completely lost or changed. I have lost count of the number of times this has happened with your postings and info. Here we all are once again having a debate about what  you have actually said never mind what you actually meant to say . You really should get someone to read your stuff to make sure it is  clear and precise before you post it . 
I am not trying to insult I am just fed up with all the confusion both you  and Tonymal cause with the badly written info you put out .
I cant even be bothered to go into the actual content , you guys make me weary. JA

I have sent a request for contact to Ward and Co. Will follow this up tomorrow.

Can i get the full monty on this, John G you say you got the information from Ward and Co.....Brian says....it wasnt John G who gave Tony mal the letter, Tonymal has gone as quiet as a mouse in a church hall.

What is the problem with you lot........just say who the letter was from and what the date was, is the question really difficult for you?

Does anyone realise the implications here, if some people are actually buying off plan from San Jose, while they are in administration...................it means there are other British people giving their money to this builder.

Whats your glee at this, are you happy they might be subsidising you or something?................come on sarc......get real, if its factual you have to stop it.

I did not forward the letter to SARC. As far as I am aware, Ward & Co are NOT selling any San Jose properties currently. Ward & Co have been very good and honest with us - they also got us BG's - until all the financial world went tits up, we were very happy. I believe that the directors may well have purchased at SADM and I therefore believe that they have personal as well as company interest in the development. Lets hope we all get want we want.

The letter if it has not been altered by SARC clearly states SJ are still marketing and selling properties on Playa Golf  and something about it being a very desirable development . I dont see how can that be allowed before any decision on the future of the company has been decided by the judge.As you say this could lead others in to the  same mess we are all in and if this is true where is the money going have they suddenly decided to do things by the book , put the cash in an a seperate account and issue valid BGs I simply dont get any of this anymore.It is madness .

Such bad news about Tonymal's  PC hope it is not serious

Is it just me, or do others now worry about whether or not they could afford these houses now ? Or wonder if they would be given the mortgages that a year ago were looking easy ?

I am of the same concern.  A mortgage on a property in Spain now, with no infrastructure to the site and no proper services, would be a millstone round your neck.

No golf course up and running.....imagine the advert you would place in the paper to let your holiday home.

Come to Spain and have a holiday in my home, miles from anywhere, golf in a few years, builders working at a snails pace..........but hey, its hot here............

How much a week for that John??

I think many of us would find it impossible to get the same mortgage deal we were getting all those years ago or any mortgage at all. Although the down payment would count as a deposit so no one would be looking for a 100% mortgage deal.God only knows what the bank giving the mortgage would value the houses at they could drop so far that they are valued at less than we have paid .I also think that SJ can no longer give us the houses at the original price .  I think that if  and it is a very big if ,building goes ahead the new contracts completion dates etc will also include a new purchase price .The day SJ give out  any decent  compensation  I will eat Andy Murray's tennis racket .
I think these are the reasons that most people WTMB .I was buying mine to use as a holiday home and was lucky enough to have the first two installments in cash . I never intended to re sell for years if ever so to me it is not a case of  weighing up profit or loss . I am out because I do not trust SJ  and having been in some of there properties that have been up for 3/4 yrs I am no longer convinced of the quality of the build. Also the house I was buying has been half built for 3 yrs open to the elements exposed electrics , brick work etc  and I am not even sure if it is water tight but I am sure It is not worth having anymore. I am not a builder but I am sure this can not be a good for any structure in any climate .Anyway as the dragons say I am definitely out . JA

Brian has said, with some smugness about keeping up with the times, that Playa Golf is the holding company developing a site and its not part of the administration.

This is probably the difference between me and SARC.  If the builder can carry on building and selling and issuing the same contracts and the same bank guarantees, SARC seem to think its a reason to be cheerfull and publish it as a letter of celebration.

I just think its perpetuating a scam, and the Spanish system allows it to happen and drags it all on.  Its like they are not prepared to accept the whole system is rotton to the core and more people are going to fall into it.

I say to anyone listening in Spain building cloud cuckoo land.  Stop it, sort it out and lets get back what we can............take their assets and wind em up

Oh well not this year but the boy did good !!!!!!

I get what your saying about  the holding company but I know that people on Playa Golf who do not yet have title deed or habitation etc are having to apply to the court  and admin to secure them so I am afraid it doesn't all add up to me .I don't think the over all dealings of SJ are as clear cut as they are making out . I hope the judge can see through the wood to the trees to save others misery in the future. JA

Hi All,
i have spoken to my solicitor and have been told that making deflamatory remarks about a presons intergrity/honesty on an open forum are a legally acountable.  I request again that Briando retracts his remark, particularly in the light that Jon G statede where the letter and information posted came from.

It is a shame that some one posts information for all to see and we get abusive derogatory postings, just because people do not like the news that SADM is probably about to be refinanced. What ever out come any of us want it must surely bode well for repaying debts and for the building of the properties for those who want them.

For the record SARC has been recieving requests for  info etc from people who want their house and those who want their money and we have assisted them all in any way that we can. We realise that 1 shoe does not fit all and that for varrious reasons we have different goals, although we believe the majority of purchasers want their property.

I wish you all well and hope that we will all have some definative news soon.

Tell you what

I will accept a message from your solicitor through this same medium, to state the case he wishes to persue and when its verified as a valid request from a bona fide solictor, who can spell and use grammatical tense.

And the office of the solicitor is verified along with their credentials, and the case is stated in the clearest terms.

And the party of the first part being the claimant and the party of the second part being the defendant, are clearly identified and formally addressed.

Then....and only then....will i completely ignore you and carry on with my life as though nothing had happened.

Trust that is a comprehensive response.

Thank you for your reply. My solicitor will not contact you through the forum by through your business address accessed via your web site address. Do you still decline to retract your remark or do you wish to recieve a letter and proceed to court?  I advice you that I have discused this with my solicitor and all i require is a retraction of your remark and the matter ends there.
