I Want My Money Back

I think personally its time this thread was put back on the top of the pile Tony as this is what MOST want without any shadow of a doubt.  Yet again Ive sent this latest SARCO December up-date to my Lawyer and yet again its dismissed as misleading rubbish just wishful thinking.  I dont deny anyone a dream but fortunately I woke up (as have many) a long time ago.

It wouldn't surprise me if ALL SARCO members would love to have their money back, but know (some from their own stupidity), that there is no chance, so hang onto the thread that is left, which is to get a house at any cost and my guess would be that cost will escalate for whatever the reason.

Be good if SARCO members who would prefer their money back, would put their hands up and be honest about it. I personally know it is fact, unless some have lied in PMs to me.
It may be more acceptable to others then, who appreciate their predicament, but not the preaching of the SARCO Gospel.

I wonder which side "Tiger" would come down on. Here is the choice.
Would you like all your money back in say 3 months?
If you were guaranteed a house in 12 months, would you wait (assuming that there would be no increase in costs).

Its not viable to have a holiday home on part mortgage in Spain.  The euro is too expensive, the amount of holidaymakers is probably scarce at present, the existing build costs are too high.................no need to go on..................

Is the dream still open.......yes of course, the land will still be there when the market changes, nobody is going to run off with it.....so when there is a demand, the houses will be built,,,,,,,,,,,,,,,,does it matter if its HdT, SJ, bodgitt and scarper or fred flinstone who builds them?................i dont think so..........im not put on this earth to keep the builder afloat, only mself and my family.

I want my money back and quick about it thanks.

Why don`t all the people on this forum help each other.  Share all the information and translations from all of the complicated letters from Herrada del sanjose?? Lets all get our money back and enjoy 2009. Does anyone know what the truth is and what is hapening im not interested in gossip and slaging each other. I WANT MY MONEY!!!!!!!

Hi Paul, and welcome to the forum. 

I assume from what you have said that you have been reading the threads even if you have not been posting.  Sorry, but our solicitor is useless at updating us, so I have no news yet to share, but like you would appreciate any updates.

We ate our 12 grapes at midnight and shared a bottle of cava, so are hoping that 2009 is luckier than 2008!

Evening each. 

I finally had a phone conversation with my Lawyer on Friday who apologised for not getting back sooner.  As far as the letter we all received, he already had this from the Administrators and basically we had responded as far as is possible anyway over the past few months via court.  Basically we are all listed as ordinary creditors as they anticipated and there is now very little argument to it.  Only the Banks, Government and employees got privaleged status.  His synopsis of the Informe is, as many kind forum members already helped notify me of, is that HdT have debts that far outway there assets at this time.  They cannot even afford to pay back privaleged creditors let alone anyone below that rank.  As SJ have a 50% share in HdT it could well mean  they will be drawn into the debts as they do have assets still worth many many millions and are not in HdT's financial position.  My Lawyer's opinion is that.. yes at some stage in the future, it is likely that someone will eventually build on the SADM site.  There is No financier on the horizen at this stage and it could be many many years before this land is built on.  He asked me quite clearly to forget this route entirely.  It will not happen.  We have just as much hope of staying with the Court route and waiting 2-5 years for our money back.   He did read the faxed SARC December Report  and was as usual very dismissive of its contents.  Who ever is in charge of running HdT have absolutely no influence in the business any longer.  They are so much in debt I believe, like many others, that they will go to the wolves.

The only saving grace I personally have that I took out a second contract with SJ (in an exchange effort) and that is who we will be persuing now HdT is dead in the water for our money back.

The SARC Reports are misleading and very dangerous with a deliberate misuse of of heresay from a Company who has failed its clients miserably and still continue to wish to mislead - through Tony.  I only hope everyone took a different route from what was being advised by this defunct so called group of people 'with your interests at heart!'.  I think not.  There has to be an ulterior motive which has now probably gone to the wall given the official financial status.  Almunda or whoever have absolutely no say in HdT anyway. 

I sincerely hope everyone protected themselves and only joined (if that's what you actually do??) the SARC thing, to pay lip service to but took your own legal action quietly.

I wish you all had your houses but I still want my money back even if it has to be 5 years down the line.  I loathe this Company and they will get what they deserve for the greed and dishonest way they have duped us all over the years. I equally feel a good deal of dismay that Tony has been blatently duped and allowed himself to be in a position to spout false hope to genuine purchasers.  Tony you must feel like a total idiot for being so gullible. I actually feel a little sorry for you nowadays.  Im sure you meant to do the right thing, but you just wouldnt stop and listen to anything that did not agree with what you personally were being spun by HdT/Almunda.  I think you should make a personal and formal apology on this site to members and finally admit you were wrong.  

Now let the rest of us who know our status finally, share and help each other with shared information that is honest and given freely to fellow 'Creditors'.

Hope we all have a good outcome in 2009.

Many thanks for giving us such a full report - hopefully our solicitor will get back to us on Monday, as we have had no reply to our emails and when we rang there was no answer.  I may send you a PM next week to ask for the name of your solicitor as we have not been happy with the lack of information from ours!

Like you, I hope that everybody will be willing to share information, as we try to get our money back. If we work together we have a better chance of salvaging something.

I am sure that Tony will give us his understanding of the situation once he has heard from his solicitor.  We have met Tony, and he is a genuine guy - even though it appears from what you say that he was mislead.  If so, he is as much a victim as anybody else, so let's not abuse him.

It looks as if those of us without bank guarantees are unlikely to get any money back, or if we do get some of it back, it will take a long time.  Should we all sue our solicitors now, as they should never have let us hand over our deposits without a bank guarantee, as it is a legal requirement?

Sal I am so very touched by your informative from the heart post .The true situation is dreadful and any one who claims otherwise is a fool .Lets just hope there is something left to have but I doubt it .How can the bulk of the companies in this group walk away from this situation intact when we the innocent purchasers /consumers are left with nothing .I for one will fight on regardless .Until the truth is known.!!!!!! One last thing. I gave up on getting my money back in May last year and I knew for sure I was not getting my house .Perhaps the disappointment has lessened with time .Can you imagine how bad Tony etc feel right now ? Hope may feel eternal but the longer you hold on! The more you will be destroyed!

 Hod on a second now. lets not feel sorry for Tony. Tony has blatently lied about certain things and claims to have seen things that dont even exist and never have. When asked for proof he clears off and returns with some stupid answer.

Tony may have started out as a genuine guy trying to help but turned into a manipulating and lying piece of work. Even now he tries to lie and convince people that legal action is pointless.

Thanks sal for your posts ..I would disagree with your lawyer on several points however

1) The deal is not done. that was merely the administrators report. You can contest this with the judge. This has been done on may occasions before and allows people to have their status changed

2) The report clearly demonstrates that HDT has more assets than debts but not movable ones. The key to this is discovering what the asets are.

3) Currently HDT are still very much involved with the company..hence the continued problems we have all had.

I too however believe in a positive 2009. Tony you do not have my sympathy..you disgust me.
