Briando, find a petition "to force banks to pay bg's" for clients who dont have bg's.

We have talked many times and i know you are not stupid like our friend Tony, but that would be a challenge!.

There was a website a while back reporting directly to the spanish government failed and crooked builders.

There are people registering on this petition who don't have BG's.  The petition is about the whole BG system,  and enables you to add a comment, so would still be worth signing IMO

I have signed and there are a few people who's names I know from this forum without a BG who have signed and some of them who do have a BG so it must be worth a try

Surely it's worth signing to help make sure that this sort of thing does not carry on because I dont care if you want your money back or your house I dont want this to happen to anybody else.

Chrissie you support and defend SARC their actions and their support of SJ/HdT  will ensure  that it will happen again .

The petition is going to the bank of Spain who regulate the fiancial institutions who issue BGs Unfortunately they do not regulate crooked developers who sell off plan without issuing BGs .Does any one know who regulates them  ? Perhaps another petition to the Spanish minister of industry or housing is in order for those who do not have a BG .Can't do any harm as no one seems to give a stuff about any of us .We have all been cheated .

Wash you mouth out with carbolic soap. SARC is only after protecting the interests of purchasers and not those of a developer. It is a shame that you are unable or unwilling to see that.  I agree that any one who has a BG and their completion date plus 3 months has past should be able to get it actioned.

"Real world" Tony some of us are there you have a very long way to go .Perhaps you can explain to me and others why you think it is OK that those with BGs should have to go through the court system to enforce .It is more than your mouth that needs washing with carbolic soap

 Have you any idea Tony how sad and stupid you are going to feel when it becomes clear that you have allowed yourself and SARC members to be fed yet more bull for all these months .Dream on Tony it will give me no pleasure to eventually welcome you to the real world .

Thisis an old posting from before SJ went into administration no one paid much attention the unthinkable had'nt happened yet, it relates to all types of problems within the Spanish property market and the aim is to hand a petition to Gordon Brown can't do any harm and may do some good.

Personally think it's time we became a little bit more proactive and let our voice be heard and don't think it matters whether you have a BG or not.

You  go on with the same old rubbish.  I did not and would not suggest that any one should have to go to court to action a BG that should be legitametly paid. If on the other hand you are just trying to get more money E.G. interest shame on you, for that would come from the same limited pot of money to repay those without Bgs. But then I gues you do not care and it is a shame that there are those without BGs who do not realsie that you probably after some of the money that should go to them.

What absolute rubbish you talk as usual Tony why don't you get your facts correct .If anyone with a BG decides to claim legal costs and interest as they are legally intitled to do  this will be paid by the banks. You are once again protecting SJ/HdT against purchasers with a legal entitlement to the return of their money at no extra cost to themselves .The real world awaits Tony let us know when you are forced to enter .  What part of this do you not understand Tony people are having to go to court to get any return even if they don't want to claim costs and interest ,I bet Almu is not telling you that Tony SJ/HdT have caused this situation  for people with a BG and could quite easily fix it .Why don't you ask Almu why instead of listening to her excuses and blaming those with BGs instead of the real culprits .You are sad .Tell me Tony what would you do if you had a BG ? .

PS Tony why are you concerned with what pot of money will be left at the end .If SADM is going a head you wont need to dip into the pot or is your hope fading ?

As our lawsuits are all filed against SJ/ Herrada del Tollo  for not accepting the resolution of our contracts I believe that legal costs would also be directed against them.

None of us want to go to court and spend time and our money fighting for what should be given by LAW.

however if I am going to fight then I am going to claim legal costs and interest. I would be stupid not too. There would be so incentive for a more prompt payment without. Don't direct your anger at owners trying to get their money back. Aim it at the administrators and san jose who have written out to all banks telling them NOT to pay

I object strongly to being told what I can claim for when SJ and the bank have had the interest on  my and everyone else's money

i for one have just signed both petitions as regardless of our personal plight i want the Spanish Government to be questioned as to why they have allowed and continue to allow developers to flout rules and legalities, at the expense of the consumer.

If by signing a couple of petitions we can get our voices heard then it has to be worth a try

I did back you up on a posting i made some time ago when one or two people were being rather rude to you and i said that everyone is entitled to their own opinion and should be accorded a little courtesy and respect and i still STAND BY THAT. Having said that Tony, i have noticed that when you make a posting and someone questions a part of that posting, you rarely come back on that point to clarify it or even to admit that on second thoughts maybe you were wrong on that particular point. Dont worry though Tony because we are all wrong from time to time and for my part i am quite glad when that happens to me as at least i know that i am human and but a mere mortal.

Your posting on this thread dated 24th Nov. as J.A. said, is incorrect because with a B.G. you are legally entitled to claim your deposit back FROM THE BANK with interest. That is the interest you have lost while they have held YOUR money and it is the interest they have GAINED while they have held your money. Some people for various reasons accept their money back off their B.G. without interest, so the bank makes a profit with the interest. Most of the banks profits on B.G.s have been made [until recently] over the last 15 years or so, when a developement is completed and the bank gives the deposit back to the developer but keeps the interest. They have made a lot of interest over the years because very few B.G.s were executed [until now] only because hardly any builders went into administration as they were selling properties like they were going out of fashion and only a few people were not prepared to wait if their developement was late. So the banks have done very nicely thank you with our interest.

THE INTEREST does not come out of ANY OTHER POT. Those with B.G.s are not taking money from those without. Let us be straight about that.

Why the banks are crying now, because loads of people are claiming on their B.G.s i really dont know, as the banks are only giving back the clients deposits that they have held [its not the banks money] so the banks are still not losing even if they give the interest back which they have ear'nt, which as we know they are not seeming to do at the moment. Nobody has yet posted that they have got their deposit back WITH interest. So Tony when you say: SHAME ON YOU!  I think you could at least retract that.
