That puts a different perspective on things - your original post suggested you had managed to get your money back via an embargo on OCC - something I thought was highly unlikely - which solicitor are you using as they seam to have sorted things out for you.

Like Rowland, we have received the "Good News" that the builders are going back on site on 23rd November. We had a phone call from Claudia followed by an e-mail. I for one am really pleased - Huma's hard work has paid off as now they have signed an agreement with several national builders who are sufficiently solvent to undertake the building project at Oasis Thabernax Country Club without having to rely on bank financing.
The journey has been long and hard, harder for some than others, but for those of us who have held in there at Oasis let's hope that next December we can all raise a glass and put the past behind us. Negativety doesn't get us anywhere so let us all now be more positive - I'm sure it will make Carmen's job a lot easier.

Well said Moon - agree with all you say.
We have had very little to celebrate along this journey, and although we are not out of the woods yet, it is the first real lift we've had for yonks! Claudia also phoned me after the e-mail and sounded really upbeat about it all - today is the day!
There is very little positive news for anybody on this or any other forum (for obvious reasons), but it is great to have some at last.
How many people are still with OCC? There's us, Moon and RowandsBB at least? Anyone else out there?
Bye the way Moon, we would be delighted to chink our glasses in December (fingers crossed).

A reality check,,and not wanting to put a downer on what is obviously good news,but for who? Huma,
We all signed contracts way back and thought we had got a bargain but now 5/6 years on? In effect you are contracted to buy a property from a developer that does not deliver at a price fixed when the market was bouyant and increasing with a very favourable exchange rate. But now the exchange rate is forceing the retired brits home and property prices have not just fallen they have plumited,so if you want a bargain buy a repossion or a property that is being sold because the owner cant afford to live there!
Once you have then managed to take possesion of you home in the sun you will then be liable for its up keep, bills etc even if you dont have the peasure of living in it|,,,more money
Sorry, but i feel this is reality, the good news is that it should stabilise in the future and if we live long enough a possible potential rise in the asset value.....

I think the good news is for those who paid a large chunk of money over - may be in the region of 65,000 euros - with no BG - little possibility of being able to get their money back from any other method - a way of getting a property for another say 65000 euros. For those who still have some faith in HUMA (and may be blame the credit crunch and legal problems in Spain) and who like the site at OCC then it is good news. For the rest of us who have little faith in HUMA or did not like the OCC site then it really seams to be just more of the same. In the end only time will tell - if I was one of those who had transferred across then I would be happy with the news.

You`ve paid massively over the odds for a property, from a firm that has still not returned money to those it owes and has no lawful reason not to return it and you are accepting a phone call and e-mail as good news ?
Do you think that they will be reliable IF these properties ever get finished ?
Look at MCC for the answer to that .... Electric being cut off, bad after sales service to name but two.
I could write off the money that HUMA still owes me, put the money I got back from them into a property, and still pay less than you have at OCC....And its in an area of my choosing not out in the desert where HUMA could buy cheap !!
Wake up and smell the roses, you are not getting a good deal here and are with a firm that has no morals or ethics at all.
BEWARE YOU ARE GETTING YOUR HOPES UP TO BE LET DOWN.

You are one of the lucky ones who have had some money back from Huma so you have a choice. They have not given me a penny back from my 71,000 Euros or a bank guarantee.
I've been watching very closely how people have been getting on with getting their money back and I have yet to hear of anyone who has got money back without a BG. A lot money seems to have been thrown at solicitors without a successful outcome so I am reluctant to go down this route.
As soon as someone receives a BG or insurance from OTCC then I will consider transfering to that site to at least give me a chance of getting some money back, or something for my money. I agree it is not ideal but neither is writing off 71,000 Euros

Very fair comment Gary. Those of us with no BG basically have no good options - we just clutch and straws - sue the banks, sue the solicitor, try and find a charge free property to embargo, go to the EU, transfer to OCC or MCC. None of these are really good options - they all have pitfalls - what is the best thing to do ? To be honest no one really knows and transferring to OCC (if you like the area) is an option to be considered especially if people begin to get BG. You are probably then buying a property which is over priced but not by the amount of your initial deposit.

For all you poor souls who don't actually have a BG - they do exist, it's just that Huma have them. You need to find out which bank is currently guaranteeing Huma (they changed my BG 3 times due to change of bank)
I'm also going to say: maybe it's time for all of you to get together and organise a trip to Huma's offices, complete with video camera to record the event. I would also suggest taking stuff out of the office, maybe if the police become involved and there is media attention, things will move a bit faster.
In short, time for a bit of vigilante behaviour.
I'm in Spain many months of the year - if you want any support or a place to stay, let me know.

GOOD NEWS:
Carmen has e-mailed me this morning to say that the builders are taking tiles onto the site and that she will keep me informed of any further progress. Also, she will be putting some pictures onto their website - not sure what these will be but I'm sure we will find out very soon.
