Getting there - sort of - Nigel.

 

May be of some interest - Huma had an extended meeting with 6/7 Asian business people today at MCC.  He was out to impress them (replaced manhole covers; had a team of gardeners working at pool/restaurant area; arranged for a security guard to man the front entrance).  Are these the 'investors' ???????

Maybe - if so could be good news for those at OCC.  Have you heard anything about HUMA being able to pay there debts up - are they running up creditors locally?  Any idea if they are likely to go bust soon?

I had an e-mail from Carmen yesterday, she is still on site at OCC. Although she still cannot give a re-start date she says that HUMA's new partners have been on the site all week and  ''they are a step away from the restarting''.

I know we have heard similar things before, and time will tell if this is correct, but I personally feel that Carmen is honest and does not feed us with the same amount of bull**** as some of the others?

We will see . . . fingers crossed!

This is a copy of my post 30/07/09 and besides what has been said by other since, this is still my own personal position...everyone must make their own decision

Other much larger and smaller developers have gone into administration so the fact that Huma Indalo SL [ & Huma Med] has not must in these difficult financial times be a bit of a positive for an eventual acceptable outcome

Anyone with a BG should exercise it or at least get legal and financial advice about doing so  

Anyway . it is all talk as they say and this is my July post and my own personal position

 I have also had a chat with Carmen and it all sounds positive but Huma Indalo are on holiday for August and whilst I do think OTCC will be built, I would be surprised if they had a re start in September

When a building site is stopped and new builders come on site ,there is quite a lot of detail to work through  before the new builders can start.....one is the cost measurement  of the current build and the new builders being satisfied with the standard of construction they are taking over and checking this

If the finance is agreed now in July, then a start before Xmas will be quick work

They also have a situation where many of the early contracts have expired and new completion dates have to be set and agreed

There is the matter of the individual guarrantees to be sorted...they will want the majority of buyers to stick with them and all this takes time

So a realistic start for me, and I am still in, is early 2010...hope I am wrong

By all means be positive but realistic.....at least it appears that Huma Indalo SL are not walking away from the project

They will of course blame all the delay on the credit crunch...and they may be right......many will just blame the ' Huma people' !!!...........let's hope it ends well

And you never know, 2010  may see some positive vibes on ACC which would be great for those still involved with ACC

There is no more to say and of course waiting is frustrating for us all

With regards to your comment, firstly, is it not right to blame Huma as they have taken deposits, signed a contract and  undertaken to build a property for a client by a given date, credit crunch or not? 

Secondly, do you agree that Huma withholding money, not appearing at court and retaining money for as long as possible, is a scandalous and immoral way to carry on which you  wholeheartedly condemn ?

Thirdly, do you or do you not recommend Huma to people who are seeking a property?

As you well know all the points you raise have been dealt with before

I am a buyer in the same position , with money at risk, like everyone who changed from ACC to OTCC because they did not have a BG

Can you tell us all what your position is ?

I think you stuck with ACC and took legal action

How much has it cost you so far?

When do you think you will get paid?

Are you happy with the legal advice you received?

Did they tell you before you started the legal action that it was almost certain that all the assets of Huma Med were secured to the Bank s[ as it would be in a similar situation in UK] ?

And there would be no money to pay you...unless the Banks agreed which they will not because Banks only look after their own interests!

Hi there

Am I right in thinkin' that should, and I state should a restart begin after Christmas and we are going for HUMA through courts for return of money, then they could not sell the property which we have the deposit on.

This may give them an incentive to return money. he he he he just seen a pig flying. The last time a miracle happened a star appeared in the east...so I shall keep a sharp lookout.

Hi Folks,

 

Just returned from a weeks hols from Mojacar.  We vistied our new Solicitor that we changed over to last June, we were with Aldea!.

Anyway, our new solicitor informed us that Huma Indalo are having trouble getting the bank guarantees sorted with Santander Bank.  Huma Indalo informed our solicitor that this was causing the delay, but hopefully it will be resumed soon!.   Our solicitor dose not believe her.  We are having searches done on Huma Indalo to see what there financies and assets they may have.  I think as for Huma Med the cup is dry concerning them to make any claims.  All assets frozen or clients have embargos on what was available at the time.  Lets hope OCC has a restart date and thier maybe hope at the end of all this!!!

Sounds a bit suspect , as we were told by the girl on site in April 08 that bancaja were the guarantors ( if thats the correct term). Still never got one though!!!

Rowlandsbb,

You have not answeed the questions and I do not have a record of you ever answering.Please do so now.A simple yes or no to each will do.

Our position is that we have been to court and that the court found in our favour. The court seized an asset and this is being re-registered at the Land Registry prior to it going to auction to be sold. The land has to be in our name in order for it to be sold.

It has cost us 2,500 euros and a further 2500 will be paid when we finish the process. 

I think we will get paid when Huma decide they dont want to lose the asset or it is sold at auction.

Or we could just keep the land and sit on it !

The legal advice received has been accurate and efficient.

Obviously all assets are not secured to the bank as the court odered forfeiture of land in our favour. We have got so far, just over ha;lf of our money back and the amount outstanding is 15000 euros.

We have got back money and got further than you.

No I have answered your questions, answer my original ones which I have put below !!

Well Rowland did say you were better to change to OCC because he felt if things went wrong you had a better chance to get your money back as there would be more assets there.  Personally I didn't believe him at the time but from what you are saying maybe he was right.  I am still with ACC - have won my court case but cant find any assets with value in them - whilst on the other hand you have transferred across and have placed an embargo on an asset with value on.   It seams to me that maybe Rowland wasn't at wrong as we all thought.

From where I understand it OCC and ACC are two different companies Medit. and Indalo.

If they re-start OCC in the not too distant future then they will be unable to sell properties with our money already on them.

I might be seeing the odd pig fly but am hoping that this happens and they give me my deposit back.....at the current rate I should make enough on the strength of the Euro at present time.

I just want me money back and hopefully by this time papers should have been served on the courts in Almeria.

We live in hope.

By the way just returned from Fuengerola and weather was fantastic.......best for 37 years they say   evry cloud etc.......

Like many others I have today received an e-mail from Huma Indalo which states that building work will re start on 23rd November 2009

Also an attachment which explained the situation and that the new builders have sufficient resources to build OTCC without bank finance 

Also in the PDF is a note from Santander that they are prepared to provide mortage finance to buyers at OTCC

So for those of us who deciided to change to OTCC in 2008 it now seems that we made the right decision

OK it has taken 12 months from the banking/financing  problems to get going again and there is still the matter of Bank Guarantees but it must be great news for many like myself

If you have not received the e-mail or PDF or will now contemplate changing to OTCC then please get in touch and I will send you a copy of the PDF

We didnt change across to OCC.

Why would anyone agree to transfer to OCC knowing that HUMA were not returning monies to clients who bought at ACC ?

Rowlandsbb still hasnt answered the questions put to him.

We have an asset awarded by the Court and the latest from our Solicitor ( 17th Nov) is that a Technician is being appointed to value the asset prior to auction. The asset is not at OCC ( Not prepared to elaborate further).

The asset has to sell at the auction --agreed--but it only has to achieve a low price to settle our loss!

If it does not we will sit on it.

This has taken about  4 yrs to date, we have received half our money back.

Think that answers all of the points raised.
