Hello Sandrab,

You say "if you disagree with this send in your proxy by fax or email with an note clearly stating your objections "!

Would you mind explaining in simple terms, because I am simple, EXACTLY how to do this? I would not like to have my objections unrecorded because I did not understand how to rdo it.

Hi Frank - have you got a proxy form.  If you are not attending hte meeting, use that to nominate someone to vote for you but also make clear your voting wishes.  You can do this by an accompanying note.  Send both bits of paper to the administrators by fax, email or post.

Bear in mind that if anyone has outstanding community fees then their vote will not count.....make sure you pay these before 21st!

Incidentally this entity does not replace the individual phase communities but is in addition to - surely when approving a budget then we need sight of both the urban conservation one and our own community budget so we can get an idea of total cost for us?

You might assume that to be the case but even that is not clear as you are asked to attend as a member of the Entidad, NOT your community which you are indebted to.

Yes the two budgets are separate but you already know your community budget for this year the question is, is the Entidad budget divided up betweem the 1200 built properties OR is there some contribution from Roda who still own the undeveloped phases, the clubhouse and golfcourse etc. if we knew that it would help to make things clearer. But no information about percentage contributions or indeed voting power has been offered to us.

The original link is now working in English.  My understanding from this is that the uncompleted properties (including the land) will contribute 75% of what they would be expected to contribute when complete, so yes there will be something going in the pot.  What I'm not sure about is how the clubhouse/course/shop/rentals office etc contribute.

Dear ALL

I only recieved my notification of the the meeting to discuss the URBAN CONSERVATION ENTITY two days ago and like all of you I find the whole thing astonishing. I spoke with housing as soon as I read their edict. I voiced my very real concern about the the leagality of calling such an important meeting without properly notifying the main people effected namley us the owners and also suggested that it had been called at such a time and with such speed that owners could not possible attend or respond adequatly.

I understand Roda called this meeting so it is very clear by the timing they do not want many people there. in my opion to send us this basic information and expecting us to sign away our rights by proxy is neither constitutional of maybe legal. I was sent the minutes of an AGM held on the 16th of October at which the budget issue was raised. It is clear from reading those minutes that the kind of questions that needed to be raised were not, I suggest anyone wishing to read them contact Housing and they will e-mail you them.   

I also have also just recieved an e-mail reply back from my Vice President Flan Lillis informing me that there are meeings currently taking place with all the Presidents and Vice Presidents with the aim of getting this meeting postponed, if this cannot be achieved then they will be seeking legal representation at the meeting.

Flan has also suggested that we all send an e-mail to Marisol voicing our anger at the way this matter is being railroaded through and as to sending a Proxy Vote these will simply end up in the wrong hands.

Our best bet is to put full pressure on both Roda and Housing, if we all send letters or e-mails now we may just get this meeting stopped at least to give us all time to understand how it all works.

Marisol appears to be advising all concerned owners that the meeting date cannot be changed as Roda will stop paying the fees wef 1st jan 2010. The meeting was called by Roda and San Javier Town Hall so no surprise there then.

Many questions such as what happens if we boycott the meeting and no one turns up?

What if we reject the budget?

And so on

It is however important to ensure your proxy goes to your President or VP if they are attending who will at least vote against the proposed budget which may be all we can do, even then it is possible this may not be enough to prevent it unless of course no one accepts any of the designated posts of the Entidad but without full knowledge of Spanish Law it is impossible to speculate on how or why things can be swung the way of the owners.

I do not know to whom to give my proxy as the President of our part of phase 2 is Ana Escribano of Calidonna who has an obvious conflict of interests.

I wrote to Marisol Morenilla of Housing Communidades to ask how I register my 'no' vote since the form issued does not allow me to do this (it only asks to whom I wish to transfer my vote). 

Marisol replied that I can send the Proxy form to HOUSING to vote in my name, with what I wish i.e. to vote against the proposal. This is what I intend to do and I suggest all other dissenters who do not have someone to whom they can give their proxy vote do the same.

I agree that the PROXY needs to be dealt with in the correct manner as this may be our only hope of forcing Roda to deal with this issue   in a way that we can all be part of the process. I have just asked our vice President to whom should we send the Proxy forms and what addittional information should we enclose with it.

I am waiting for his reply, which I will post.

I would like to know if anyone on this thread is actually going to be able to attendthe meeting? It seems we are all in the same boat, since the meeting has been called at such short notice and at a very bad time of the year, very tactical and underhanded in my view.

Anyway, looking through this thread, the consensus is we do not agree with the proposedbudget. There is insufficient breakdown of the costs, even if they are reasonable, to make a decision to approve them.

For example,

- what percentage of these costs are the Administrators fees?

- How much does each property contribute?

- Where is the cost breakdown for 2008, 2009 budgets for comparison?

I my opinion we need to have a voice at this meeting, someone who shares our views and is able to express them at the upcoming meeting. I think it is even worth clubbing together any paying someone to attend, it cannot workout that expensive. I would be happy to hear from someone who would be willing to attend.

On another point, no-one is happy with the Administrator and we should consider finding an alternative. They are never on site, checking the status of the resort and in my opinion are not acting in our best interests. If they are not prepared to do their job properly then we should replace them with someone who can. We should have this as an point in the next meetng for each phase.

They of course will not be happy however it needs to be done.

Also we know that Roda and the Administrator are reading this forum so lets hope they get the message that we are not happy and its far better to work with s than against.

That is good news, perhaps those attending may be happy to put their names and community on the forums so that others can ensure their proxy is used.

Owners of all Phases should also ensure their Pres or Vps are talking to other communities as lawyers have been consulted but once again communication is as much the problem as anything else.

On Phase 2 apartments Jill Sylvester the President will be attending and we are hoping to send an email which has been drafted to all owners asking for a proxy with a brief explanation of the situation. Perhaps other Presidents can be persuaded to do the same

This will have to go via Housing who hopefully have all the email addresses, if they do not have up to date ones please contact them yourselves

Hi All

We too are concerned about this forthcoming meeting. We have written to the Administrator to object to the timing of the meeting - Christmas week is a ridiculous time for such a meeting, and we feel that it is a very deliberate ploy from Roda Golf.

We will also be in contact with our Vice President on Phase 3B to ask him to represent us.

I'm just wondering if Maria de Castro is still on the forum? Can Maria offer any advice to us at this point? Our understanding was that the Entity would not be given over to residents until the resort was entirely finished? Any legal advice would be much appreciated Maria?

I would hope the everybody is sending their signed proxy form to Housing either by post, fax or email naming a person who they know will be present and who they trust to vote on their behalf.

I am not sure the form allows you to name a proxy and then decide which way you wish to vote but no doubt you can indicate that you are against the proposed budget as it stands and leave you proxy to vote on other issues such as the board etc.

I have just come off the phone with Housing and it is now very clear that Roda's only concern is to move their current financial outgoings to the owners as soon as possible even though they have failed miserably to fullfill their contractual obligations with owners.

For those of you who may not have all the facts, they are quite simple this. As of the 31st Dec 2009 Roda will cease to pay all service charges and if the owners do not pay, those sevices will not be provided, the services are laid out in the budget. In addition the community charges you currently pay will also continue.

I asked Housing who would pay for the following,unfinished phase 4 and not started phase 5, the area where the hotel and commercial centre are propsed and the club house area. They replied that Roda should pay for phase 4&5, Devere and other parties committed to the commercial site should pay and that the owners of the club house should pay, if you notice I said should pay in reality we all know this may not happen. so who takes care of the shortfall? and would full services be provided.

I have also just found out that the meeting venue has been changed and a notice will be posted on the Town Hall door so I hope everyone who intends to go knows this, for my part I will now be flying out as I feel this does need everyone full attention, as it will be to late to change anything after.

For all Phase 1 owners at Roda.  I have now heard from Peter Beard, our President and he has indicated that he will be meeting this week together with other Pres/V Pres to discuss next week's meeting, He intends to vote against the budget as it would appear the meeting has to go ahead.   He has asked that I advise anyone I know to send in their proxy to the Housing office with their voting intentions shown.

Anyway, just to reinforce this again, here is the website for the Entidad information which has a pdf link to the meeting documentation including proxy voting forms which can be printed off and sent to Housing with an indication of how you wish to vote.  www.eeuuconservacionrodagolf.com

Please note, as previously advised,  the meeting venue has been changed and is indicated on the Entidad website.
