The Vote

Hi all,

I just want some clarification as to who gets to vote for/against the proposal put forward by HdT, i do not intend to offend anyone who has fought hard and won the battle to get their money.

Am i right in believing  that people who have already received their deposits back are still allowed to place a vote?

If so, can anyone tell me why?

The way i see it is that if you have your money back , then you should not be able to vote as the outcome no longer affects you in any way.

Whatever way people chose to vote , it should only be the people still tied up in this mess that should have a vote.

My understanding (and someone can correct me if I'm wrong) is that once you have your money back under a BG, then the bank becomes the creditor and they have the vote.  A post somewhere also mentioned that votes are counted by monetory value, so Banks will have the deciding vote anyway.

I agree that now we have our money back, I don't feel entitled to vote either way. I will continue to watch with interest.

I agree that it will be the banks that will control the outcome and not us , just didn't really understand how it would work in respect to people who receive their deposits back before the voting deadline.

It seems that quite a few are winning the battle at the moment and wonder if itn is another tactic of HdT to give the banks more of the casting vote!

Hi Vic I don't think anyone who has their money back can vote .I certainly wont be .It seems to be HdT /SJ thet are confused as they are still sending out the letters etc to  some of us .I will watch with interest to see what happens ,hoping that everyone can get something back but it really does not affect me any more  JA

I believe that the banks are paying up to ensure that they have the vote. From a Banks point of view they most likely will want SADM to go ahead, that way they can get income from mortagages & minimise their loss. This is a good result for those with BG's and their action could result in helping those of us without BG's. The important thing is that every one who can vote  does, as HdT being liquidated  and SADM not going ahead I believe would be a disaster for those of us without BG's. 

I am voting to accept the agreement & despit giving my solicitor POA , I am doing it myself next week in the UK and informed him that I am doing so.

Tony The banks are paying up because they have been told to  pay by the courts ,they did not want to pay up but were forced to .Your suggestion that they are only paying up to get a vote is completely ridiculous .I really don't know why you get away with posting such nonsense on here it beggars belief . 

Many of us who have been paid out recently had direct dialogue with the banks on this matter .I can assure you that contrary to the tosh you spout on here the banks will vote no as they feel the repayment figures are  impossible and are not based on reality and will simply not be achievable . You are simply spinning a a load of tosh as usual Tony on behalf of Almu .What has she promised you in return for decieving people with your rubbish  !  JA

As you said you watch with interest why so you not do so? You still keep trying to put SADM down , perhaps it is time you did as you said you would do and can it.  As for the banks, well JA you really are very niave, they can play all sorts of games in the courts, they are most likely only paying up as it is their advantage.

Sure Tony the bank  are going to pay those with BGs  all their  money back plus interest and legal fees (which they can not even claim back off HdT/SJ ) just so they can have a vote you are clean off your head  Tony . Do you want me to show you the court order demanding  the bank pay within  14days  or face an embargo of assets I don't think the bank were in a position to play silly little games like you .You are a very silly little man Tony.

I see things a little differently than Tony and his little gang

The little gang who were lucky enough,and in my case I might add,  I told others to get  a BG and a few got paid out long before me.  Having met lots of you and made many lasting  friends from this ,Santa Ana forum and Spainserve I just want to give them some support. So what is Sad about that I would like to think all my friends who did not get a BG would vote NO because it will put the crooks out of business take all their assets and enable someone not directly involved in this awful mess to sell off and pay you all back

The reason i changed my vote was simply because my lawyer said the proposal is ridiculously unfair and does absolutely nothing for the client and only SJ/HDT gains anything.My lawyer and some others have a meeting with them next week to discuss the proposal further and ask the unanswered questions.

We were also informed that the insurance bond covering the guarantees was cancelled in 2008 by HDT, so they are now refusing to pay out.

We are in discussions with another lawyer regarding going after the bank who took the deposits for the two properties in Dec 2006.
