The Offer from Almudena

Hi All,

I have just received  via registered post the offer from Almudena Rodriquez Gascon, Sales Manager, Herrada del Tollo S.L. despite the fact that I cancelled my contract last May. They haven't quite got their admin right!! but that doesn't suprise me.

The offer to creditors who wish to continue with the purchase of their properties:

"All purchase contracts will have to be amended with a new completion date but will retain the full amount of the credit and the same conditions as the original contracts. The new completion date for the delivery of the properties will be between 2.6 - 4 years depending on which phase the property is located in."

The offer to creditors who wish the return of their deposits:

"Whether they are service providers or clients who have cancelled their purchase contracts they will gradually see a return of their money in installments over a 5 year period totalling 65% of the deposit returned"

The only mention of Bank Guarantee's is on the website under Questions and Answers where they state that should the company not provide according to the contract the Administrators can force them into liqudation.

The letter also states that the full proposal which explains the current position of the Company, its projections over the next few years and provides details on how it plans to meet its commitments as laid out in the document (ie. by meeting a repayment schedule or by the delivery of a property at Santa Ana Del Monte Golf Complex) can be found on their website. Wrong the proposal link says not available yet!

In fact the only link that seems to be working fully is the link to SARC. Strange that eh!!! However as the SARC executive Comittee will probally say that I talking B******s because I've got a Bank Guarantee and I want to see the comapny in liquadation because I'm mean.  Enjoy reading, I would, (If I was still contracted to the company) off course vote to Liqudate the company and stop them inflicting any further misery on anyone else stupid(like me) enough to fall for their lies again.

We have not received any letter or access to website as expected from recent posts.  

We did not receive a bank guarantee despite your companies promises that we would way back in 2006 .

Ok, so I may be struck off this website for saying what I feel,  however ,

Almudena,  I curse you and every member of your your family. that you may suffer ill healh and misery which no amount of money can buy you relief. 

You have brought nothing short of despair and false hope to people who trusted your words and you are still perpetuating deceit !.

 I totally agree with you this is blackmail ,manipulation and theft at its worst (Have SJ/HdT no idea of the total misery their folly has caused ) Do they really expect us to trust them when they have shown such disregard for the most  basic points of Spanish property law .

(This whole situation has very little to do with the Global crisis and has much more to do with SJ's greed , over expansion and mis management )  Not to mention the superiority complex they hold dear with regards to their customers,share holders and creditors.Their attitude throughout  beggars belief !  

Use Dave's link to the  web site it works.  However the total deceit of it all and the bare faced cheek is enough to make you weep.

I am sure you will not be struck of for your little outburst .Your anger and frustration  are  completely understandable  . calm !!! time for a chill pill or a large vino .

The password and username were sent to us as "confidential" and  for our use alone ,but  myself and Dave  felt everyone should be able to access the so called website, as on the original email from Almudena there were only around 35 names and we all know there were 1700 buyers, i beleivethe letter was to us in order that we might/can vote for a continuation of SADM. We have our Del Monte but it aint Santa Ana

Do you not think that these might only have been sent to those registered with SARC?

We are also finding it difficult to say the least to get hold of or get any comm's at all from PSi! To take our vote (which is of course NO)

Steve you should know we have been postng on here long before SARC came into being maybe because we updated our address when we moved to Spain is more like it

No I'm not with SARC either, never would be! I believe that the reason we received the letter is because San Jose's admin is so shit that they think we are still living in the apartments in La Zenia, despite the fact that we bought another property 18 months ago. They are desperate to sell the apartment block to raise some capital, therefore are trying everything to empty it.

Nigel, no problem  your welcome. I believe you are coming over at Easter too complete is that right? If so perhaps we can meet up again?

Hi All,

I am not surprised that some one in Spain recieved their letter first and was abel to access the  HdT website. SARC stated that we had asked for a web link & have placed one upon our site. As for some of the comments, they are what I have come to expect from some one who yet again confirms that they have a Bank Gaurantee and want HdT liquidated. Is that why this person has given out their log in id, thus enabling any one who is not even a creditor to access the HdT site? 

The information on the HdT site is their for us purchaser/creditors to be able to get information etc without any external parties who may wish to benifit from our loss from gaining any information. If Dave wished to share his personal log in details perhaps it would of been better if it had been done via PM's rather than on an open forum.

As for those of us without BG's, and that is the vast majority of purchasers, we can not afford to have HdT liquidated, even if a selfish few are hell bent on trying to get that to happen. And why would they being doing such a selfish thing, you may ask? Well it is probable that are doing it to try to make it easier to action their BG and get ALL of their money back , while we many get nothing!

 I WANT A POSTIVE OUTCOME FOR ALL & NOT JUST FOR THOSE WITH BG'S

Tony what total and complete crap you spout it is quite unbelievable .It makes not one jot of difference to those with BGs what way the vote goes .Perhaps you should be asking yourself whose fault it is that the majority do not have BGs  Perhaps you should be asking yourself why SJ/HdT have acted completely outwith the law and treated purchasers with contempt and disregard .Perhaps the reason most want them out the game is because they are a bunch of crooks and will never come good just cause more people misery .If you can't see this as fact Tony you are a lot more stupid than I feared ,Good Luck Tony you are going to need it .

Just for the record I don't have a BG anymore cause the bank take it back when they give your deposit  money back with interest and  legal costs . Almu denied you and the majority of purchasers this basic legal right and you still think she is to be trusted !!!!!!!!!! Sorry Tiger but you are completely  "aff yer heed "

I am not really very interested in your comments, you are one of those who urged purchasers to spend money trying to become privaledged and I glad that you got your money back. If that is the case you are no longer a creditor of HdT and should not being trying to loose the deposits of all of those who do not have a BG.

The only important fact is that if the settlement agreement is not accepted HdT is liquidated. Those without BG's have extremelly little chance of getting any thing back if that happens, but you do not care, as you have cashed in you BG.

Look Tony you idiot, no-one can use the details I allowed on this forum because only 1 vote can be cast using your Username and Password. Surely even you can understand that.  Yes I can confirm I have a bank guarantee and I want the company liquidated, I've never tried to hide that.  I posted the access for those purchasers that have not received any communication from San Jose so that they can make their own decisions and not be influenced by complete idiots like you.

Now run along and get me banned, as if I care one hoot. I personally voted to liquidate the b*****s. Ihope everyone else does apart from you, for you I wish you to get your house in the middle of the unfinished golf resort surrounded by the rest of the fools who believe everything Almudena spouts to them.

Well said Dave .He  is a complete  idiot and is obviously a person of very poor principles with little regard or care for  what is right and what is wrong .If you get banned it is a disgrace .Time alone will show the truth of all of this and those of us who can see  this situation for what it really is and have spoken  out about  the disgraceful ,illegal behaviour of this company  will be able to hold our heads high . ps you were quite right in posting the details of how to access the HdT website .As it  has been seen time and time again we can not rely on Almu et al getting the info out to everyone who should have it  . The only person concerned with and who insisted that the web site was secure  was Tony (I wonder why !!!!!!! ) perhaps he is just being used as a puppet again  with  Almu pulling the strings as it is in the companies interest not purchasers  to control who can access this information .They can then also deal with the tricky questions and answers under no legal jurisdiction  ie (cyberspace ) if they don't tell the truth there is no comeback .

Tony I can not decide if you are just a puppet ,a Muppet or both .Sorry Tony I have been dealing with this company since 2004 and  I know them inside out . I nearly laughed my head off at the compensation offer of air con I have been promised that since my property was 6 months late and here we are 6 years down the line .Tony they must have promised you the earth for you to be so supportive of their illegal and disgusting treatment of all of us but believe me they will not deliver on anything ! ever !

Tony I agreee with all the others you are either in a world or your own or the company has some arrangment with you.

I was told by my solicitor that my BG was cancelled by the company and it is illegal to do so.

So i have no BG and I want the company liqidated.  If I get anything back fine but like many others dont expect to get anything back.

once we have an outcome we can then move on with our lives or take some form of joint action against the crooked company

We arent coming over at Easter to complete I'm afraid. (Although it would have been good to meet up). It is looking more like May day weekend.

Yes more complications have ensued!! basically even Joan's been had over by San Jose.

Our lovely Azenca on Playa Golf I had been motgaged by San Jose TWICE!!!!  All very illeagal of course, (they didnt even own them)  and not just our purchase but as I understand it the whole row of villas that Maher properties owns, not to mention at least two years local property tax. A right headache to sort out.

Anyway we're nearly there now, - If PSi ever get thtere finger out that is................I will tell you the rest when we see you.

Hey Nigel , sorry to hear all the trouble you are having hope it all goes OK for you in May . I am going to resist saying I told you so .I  had been told by my legals that  they had  multiple mortgages on many properties on Playa Golf 1 , it was an option I looked at  but dismissed as too much of a risk ..

SJ/HdT are a bunch of scum bags .Who do they think they are they have broken every law in the book .  

Hope that despite all this you get what you want on playa Golf 1.Personally I would not touch any of SJ,s properties with a barge pole .Guess that is what I was trying to tell you all along but I really do hope it is all go in May and you get a result cheers MM/JA/julie anne

Hi all, I have received an offer from my solicitor tating 35% will be wrote off. So 65% will be paid over a 5 year term with the first payment not been made for another 3 years in 2013.

I have to decide if to accept or not. I have no idea about this sort of thing and dont know if this i a decent offer (best i will get) or if they taking the p***.

My thoughts are its discusting!!!. What are your thoughts and what will you be doing???

This was a saying I heard years ago (can't remember where now).  It came to mind as a tidy sum up of my feelings on this whole SJ/ HdT mess and I didn't trust myself to expand!
