IBI Bills Phase 1

Before this years IBI bills are despatched I am hoping to lodge an appeal against the higher bills that owners in Phase 1 are paying compared to Phases 2 & 3 .

In order to proceed I need to provide the Patronato with proof of the differential so if you are in Phase 1 and want to appeal please PM me with details of :-

Your block and apartment number, copies of your IBI bills for the past 3 years (if possible) and if possible copies of IBI bils for similar apartments in Phases 2 & 3.

I will then pass these on to someone who has offered to take the matter before the local Town Hall office. However this may be a lengthy process not guaranteed to succed as the decision is not taken locally, but in Malaga and you should not withold payment of this years bill because you have lodged an appeal.

Just an update re the IBI bills.  I wrote a letter and was going to send it to Malaga but the office in Manilva said that you have to visit in person!

The lady also explained that the land had been revalued early this year and we were paying 0.9% and this would increase by a percentage point over each of the next 10 years!!  (The land will not be revalued for 10 years now.) Our IBI this year was €690! We have a 2b2b of 100sqm incl. terrace - This is completely unacceptable!

I am planning on speaking to another resident who is a lawyer and lives in bloque 1 at the EGM to see if we can raise some kind of collective legal action.  My Spanish is really rusty and I don't have a clue as to how we could do this in person in Malaga!  I am hoping the lawyer will have a better idea.

We are in block 1 and we are really fed up that we also discovered that phase three are even lower than phase two and that was bad enough !!!! We will be at the EGM  so perhaps we can have a chat. 

maybe you pay more on phase 1 beacause buildings have only 3 floors? and rest phases 4 floors, it permits owners fase 1 enjoy mor meters in plots.Hacienda evaluate this too.

I think you are mistaken as the developer paid one price for the whole of the development land and the area occupied by the Phase 1 blocks is in fact less in most cases

Our IBI for this year is € 824 for a 2 bedroom apartment.

It is clear that owners in Phase 1 are being ripped off by the Patronato and I suggest a petition from all owners in Phase 1 as set out below is sent to the Patronato requesting a revaluation of the land in line with the values attributed to Phases 2 and 3

I the undersigned owner of apartment   ..............................  in Phase 1 of Duquesa Village, Manilva, hereby make formal complaint that the values used for the calculation of my IBI are greatly in excess of the values used for Phases 2 & 3 and I therefore request that the Patronato re-examin my IBI for all years since I took legal occupation of my property.

We are going out to Duquesa next week for twelve day s  and will leave a sgned copy at your apartment along with a copy of our IBI bill  ,which was this year   1057euros!!!!!!!!
