We should have been in our new home in November 06.  In March 07 we cancelled, but only had the one bank guarantee. At the end of June we received the money for the bank guarantee by way of bank transfer into our account here in Spain (we have been renting in Spain until our home was 'built').  We are still waiting for a court date. Our solicitor said they couldn't apply to the courts until we were in receipt of the money for the bank guarantee, therefore the application wouldn't have taken effect until the end of September.  6 months later, we are still waiting!  The next step is to visit our solicitor in Murcia. We live in Spain, but may as well live in the North Pole for all the good it does. The government here gives no backing what-so-ever.

Is there anyone out there who has actually taken HUMA to court without bank guarantees and won their case yet.

There is a massive back log in the Murcian Courts due to a strike.

Thanks for the reply. I bet HUMA are loving this I think everything seem to be on their side.  I cant understand how they are getting away with it.  Its like me offering to build you a house asking for £40.000 up front Then telling you that due to unforseen circustances I cant do it now, but I dont think I want to give you your money back. So tough. your out of pocket.  Its unbelievable the ammount of cheek theyve got.  Our solicitor did tell us about a month or so that the courts were on strike but he hoped it would be sorted soon. So are they still on strike or is it over now.
