I must warn buyers of La Condesa de Mijas Golf, that there are lawyers in Algeciras with bad intent to advise them to initiate legal actions that aren't viable and after that, charge fees. Lawyers who are, just look through their personal interests, collect money and don't explain their clients the risk of initiating procedures that are not going to win because now don't have legal basis, in sum at the end they'll have to pay all the cost from this bad lawyer and the developer's lawyer, since they will win these proceedings.

The crisis now is present for everybody and there are always bad people who seize the opportunity to win money even telling lies.

I beg to think that this 'conlulu is a plant by the developers.....my lawyer is based in Costa Brava, and, apart from someone who got their cash back via the bank guarantee in Febuary 2007.....no-one else seems to have got as far as me........I think the moderators should find out just who 'conlulu is!!

I forgot to add that I am in talks with Michael Cashman MEP regarding this terrible situation...conlulu...something tells me that you are not English...by the text!

It does sound like someone trying to dissuade people from taking legal action. To the point that they say there is now no legal basis to do so.

Well I beg to differ on that point, I think there is definitely a legal basis, but wether or not it will be easy and inexpensive to win the case is another matter.

Whoever this 'conlulu' is, they have certainly put the idea into my head that taking the case out of the 'Malaga' district might be a viable way to go for some. So thankyou for that, although Gill has not yet managed to win a successful outcome with her Costa Blanca lawyer.

So, whoever you are 'conlulu' /'monolulu, we are not phased by your single unsubstantiated posting. Give us more details if you are genuine in your concern for us, and naming  the greedy Algeciras lawyer would also be helpful. You can send me a private message to avoid any possible litigation issues.

Finally,we have been here since day one (almost) and have supported each other. Where were you???

Thanks for your post that brings to us the possibility of explaining some things regarding our actions in favour of claimers against Sol Mijas Developers in La Condesa de Mijas Golf. Of course there is no doubt you are refering to us, Costaluzlawyers, Algeciras based  lawfirm and quite present in this forum . Thanks for the oportunity again. We refrain from intervening against anyone in this forum as we fully respect the terms of it but we need to clarify for the peace of mind of our clients, just for that.

Again... this post just for the tranquility of our clients:

A Fuengirola Court has recently rejected the attempt by this developer of changing jurisdiction in a case directed by us.  Sol Mijas Developers wanted to change to Malaga jurisdiction and we opposed that it might be a  way to avoid a jurisdiction which has  already passed a decission  for cancellation in favour of consumers and that might be important as precedent for future wins. The Court gave reason to us and opossed Sol Mijas Developer attempt to change the jurisdiction.

Not to say that we are finding incredibly challenging to act in favour of our clients in Sol Mijas Developers cases, as we are finding Bank Guarantees which got lost,  lack of response by those who were supossed to be guarantoors of the client.... Full typology of difficulties.  Much to learn and learn.  We love it. Very intersting indeed, thanks for that too, Conlulu.

Monlulu you are in the clear as far as I am concerned...this ploy has been done on different forums before. Don't take it personally! They picked on your name thinking that it was easy to manipulate!

 

It's a case of dividing the clients, and putting fear of the unknown in peoples minds..............they seem to think that we stupid English will just walk away from this without a fight...how wrong can they be. I intend to publicise this mess to the best of my ability.......no contract amendments, no communication with clients...........I wonder what feeble excuses there are for not acting with any kind of ETHICS.....I thought Majestic was bad, but 2 yrs 4 mths after the scheduled completion and still no contact with purchasers........how contemptable can they really be?

 I am thinking about transfering my case against SMD to Maria's company. In that way there will be several people fighting for their deposit back, and the team will have a better idea of the opposition's tactics. I reckon that there is just under a year to go before any appeal...of course, the idea of going to malaga must be something to do with the massive backlog of corruption cases. I beleive if SMD are so shaken by the company, they nust be on shaky ground...............so, I am now going forward with a sense of positivity. I have already spent a fortune, so why stop now!!

Wouldn't it be a breath of fresh air to deal with civil people with ethics......since the beginning of this site, I believe 5 yrs ago, people have had things happen in their lives, births,deaths, separations, and the additional stress of this 'investment' going on. I wish the people we are dealing with knew the massive amount of misery they have caused to the many 'customers' they have, and I wish the customer service would have been consumer friendly, but no, we are the ones expected to pay for the stupidity of chosing (or being advised to) this awful site!

Recently back from holidays and catching up with things on here.  We found this "conlulu's" post quite amusing, if not pathetic, desperate and childish.

We, for one, are clients of Maria, having previously dealt with a useless lawyer who failed to protect our interests, and can assure everyone that there are lawyers (specifically in Algeciras!) with a moral sense who are concerned about consumer rights and applying the rule of law.  Though this may irritate the developers and anyone else involved in their corrupt practices, we have every confidence that - no matter how long it takes - Maria's firm will get us through this nightmare.
