How long did it take you to get your stage payment back, my BG is with the same bank and i insructed my solicitor at the end of March to cash mine in

Hi is this good news, and that maybe things are rolling can i start getting excited ,we haven't got a B/G do you no if this makes any difference because i haven't got a clue as to where our money is, any info on how it works would be welcome ,but it looks like were going to court, don't no when ,haven't heard from solicitor he was issuing papers to Huma two weeks ago thanks.

I went over to Spain in mid November signed power of attorney with my solicitor and notary. Beginning Jan my solicitor sent out a bureaufax to Huma after 40 days and no reply they sent another bureaufax direct to banks. The 2 banks I have guarantees with are Bankinter and bank popular - Bankinter have paid up andI am still waiting for the other. I had to pay 350 euros for notary and bureaufaxs. You can arrange power of attorney in England but as I was going to Alicante for short break I was able to go to Aldeas office there.

Hi has anyone heard from Andersons recently ,our last email said papers were being issued to the courts,does anyone no how long does it take the courts to do their bit as its coming up for 10 months that we have waited ,yh getting itchy feet again ,before you no it the Spanish will be going off for their holiday so another 3 months gone don't no how much more I can take my teeth are grinding away.

What, normally, happens is that the papers are submitted; then after about a year someone (a judge?) examines them publicly, and decides whether there is a case to answer; if he decides that there is a case to answer, then he sets a date for the hearing (another year) - he may, also, order that the plaintiffs be there in person.

That sounds about right for Spanish law. Wait a year or two for some judge person (hope he's having a good day)
then wait for the court case to come up then maybe, just maybe Huma will have to pay us all back our money,
That's if they are in a position to pay out.
In other words if we get our money back within about three years we will have done quite well!!
And they just keep getting away with it.
At least the tension of wondering if ACC will go ahead has gone away and I will just think the return of our money that Huma is holding as a very long term project.
Huma and the Spanish government have taught me a lot especially patience.

Sorry last post should have congratulated Marilyn on the return of money. I am very pleased that there is some movement to recover money for people with a bank guarantee. It is just so wrong that some are having to wait so long for the banks to hands over it's just incredible.
Without a bank guarantee you just know you're in for the long haul but that shouldn't be so with one.

,Im happy for you ,its good to hear that someone is actually getting somewhere because every time i come on the forum i hope for more good news of people getting their money back ,because thats what keeps me going thinking theres a light at the end of the tunnel, but it seems that because we were never issued with a B/G Huma has ripped us off even more when its supposed to be law to have one, you would think they would cough up faster knowing this.well done once again.

Always glad to hear that someone has had money back. We telephoned Andersons today but again were unable to speak with Miguel. We have asked numerous times that he contacts us by phone, but they ignore our request. All very frustrating. We have been waiting for the bank to refund our money since last August. We have a bank guarantee, but still can't get our money back.
I think that Andersons are trying to ignore their clients, which is not good. Is there anyone having more success ?

I cant understand why these solicitors are ignoring their clients, as I would think that this would be a nice little earner , especially if they could win their case, with the ammount of people thrying to get their money back. Unless they dont think they can win and are just taking what money they can from us all to make it look like they are trying. No one seems to be getting to court. WHAT IS GOING ON ? when do the Spanish breeak up for their holidays ? My solicitor just keeps saying that its no good him replying to me as he hasnt got anything to report at the moment and the reason its taking so long is because the courts have been on strike. Does anyone know if they are back to normal now.

Court strike is over, but they will have an even bigger back log now. I wouldn't expect to hear from them (the courts) anytime in the near future as, like it or not (and don't shoot the messenger ), property investors are seen as low priority.

Interesting article indeed.
I found it mildly reassuring (I'm in a similar predicament to Mr White) but what I find odd is that the authorities in Spain must know that their laws are being broken (BGs not issued) but are doing nout about it!
The laws were introduced to protect the consumers but they don't seem to be enforceable...
