We were completing with mortgages (one from CAM and one from Bancaja) and they were going to arrange bank drafts payable to Polaris World on completion. As Mike says, the completion paperwork does say that payment must be made in this way and personal cheques or cash cannot be used.
With regard to the Habitation Certificate, PW told me a couple of weeks ago that the Certificate would probably arrive ten days later (which in our case would be the 13th June - which just happens to be Friday 13th!!!) However, I don't think that the Town Hall would have been that specific as to when they would deal with it. Not really sure whether it is just the first few Certificates that could not be issued for this week or whether they are unlikely to have any of them for another week or so - it's all a bit vague.
When I got back to work today, there was an e-mail from our solicitor saying that she had asked PW to confirm as soon as the Certificate is received and they will then arrange to complete straightaway and let us know that it has been done.
At the Notary's office we used on Tuesday morning, there were eight Polaris completions altogether and the Parador rep told us that we were the only ones not completing without the Certificate!!! I think he might have been trying to make us feel guilty but pointed out to him that you wouldn't pay a solicitor to advise you and then disregard his advice!

The 4 page letter going through the admin process with the Jardines de Alhama logo on the top left hand corner. Also contains prices for polaris to complete, notary and land registry fees, what to do about your water and electric etc. On the back page, which says important, it tells you the documentation that you need to take with you on completion and the final payment details.
If you can't find it let me know and I will email it to you.

Just to let you know that i have spoken to my solicitor and they said bankers draft will be fine as long as it is drawn from a spanish bank account. So no problem there.
So for any of you out there who are not getting mortgages, this sounds like a safer option to me than transferring before completion.
But please check with your own solicitors to make sure you are ok to do this.

We should have completed last Monday as you are aware, and yet the Habitiation Certificate still has not been issued, even though they said Thursday, plus I know there are a lot more completions due even just by our solicitor.
We just keep waiting - glad I did the POA.

Oh dear. Did they say what the hold up is? Is it because we are completing too early? Do we think it will sort itself out as time goes on?

Hi all
I don't know whether I've imagined it or not but I read somewhere that to obtain an Habitation Certificate for your property there also needs to be some facilities i.e. somewhere to buy food etc. Has anyone else heard about this.

Hi Everybody,
My friend who is also buying property in Condado de Alhama, has suggested that a solicitor is 'not' necessary to buy from Polaris World and recommended that I also 'not' employ one. And against my better judgement,I have not yet done so. But I am beginning to question this suggestion more and more, especially after reading about everybody so far signing 'POA' to complete to their solicitors these past weeks!
Can somebody please give me their views on this matter, as I have never been too comfortable with the idea of not having a solicitor and I'd like to hear other people's advice as I'm due to complete on 8th July.

Its quite simple, you don’t have to use a solicitor at home but would you buy at home without one?
If the answer is no then why would you buy in Spain were we know even less about the process and your rights. The one thing that is the same as home, the builders are not looking after your best interests and will tell you anything to achieve their aims.
Solicitors in Spain can be as much of a pain as they are at home but at least they are in the main looking after your best interest, and although there is no guarantees in life that thing wont go wrong, having a solicitor helps limit the risk and hopefully protect your money.
I wouldn’t be without mine.

You wouldn't buy in the UK without one, so why would you buy abroad without one ?
You are paying c£100k for something, so an extra £500 - £1k for a solicitor is well worth protecting your long term £100k investment

Wouldnt buy in the UK from a big building company without a Solicitor so wont buy in Spain from a big building company without a Solicitor- plus dealing with anything in a foriegn language if you are not fluent is a nightmare. Well done to your friend Geoff if she/he gets through without needing any input or support from a Solicitor and no doubt they'll feel smug they didnt pay for one if every thing runs smoothly. But there are no certainties to that are there? Ours has had our NIE numbers since last November, has ensured we can complete during our holiday in August and has answered a ream of incidental questions. They will be there at completion to translate and we do not feel alone during the process and they will act at POA if we need them to and will file all the tax paperwork after completion. If you want the name of ours please pm me, they are based in Mazarron and so far have been 1st class.

Jontee- your comment made me think about what I have read about the habitation license and then try to find out what it was I'd read- so far, through google "a habitation license that confirms that the local council has checked the property complies with planning permission and building regulations. ". I remember reading that every property has to be visited for the habitation licence to be issued for each one.

Thanks JHMurcia. I am due to complete in just over a week so I am kind of caught between a rock and a hard place. I am praying that he seriously ups his game or I will be without an apartment. Probably too late to chance changing lawyers now but I am sorely tempted. Fingers crossed though.

I've just been asked by my Lawyer to send our original NIE numbers across to them so they can sign on our behalf using POA on the 27th of June, has anyone else had to do this who is using there Lawyer to sign on there behalf.
I thought as we had taken the originals across to the Notarys when signing for POA and they had taken copys that copys where ok to use when signing.
I was also told when we got our NIE that never to send the originals as if they get lost its very hard to get new ones issued.

They are a very important document, which you will have difficulty replacing. ours are held by our solicitor in case we do completion by POA. I would ask your solisiter if you have to send them as the Notary has already seen and taken copies.
If you have to post them I would use something like DHL, which is tracked all the way (recorder doesn’t, its only tracked until it leaves the UK?) or if possible I would ask if you can have them notarised by a UK solicitor and then faxed by the UK solicitor (I think solicitors have a system for doing this, but I don’t know if its relevant in this case). Which ever you use make sure they are safe as getting them replaced at this late stage would be a nightmare.

I have just posted our original NIE numbers to our solicitors in Spain - using Registered Post - our solicitors told me they had to have them when doing POA!
Now I have something else to worry about - these going missing!!!!

Just remembered that we never had our NIE numbers until a week after we did the signing of POA, it was our Passports that they took copys of, with so much going on just now my head is getting sore.
Better get them posted offf quick as we complete in 15 days.
