Has anyone received any facts regarding the beach club from thier solicitor.  For example whether they have the licence yet.  I am concerned that RGBR have not started to build the beach club yet and wonder whether they may or be forced to pull out of the idea. 

Any thoughts?

I am sure there is a part of the contract or some sort of Spanish legislation that says they must provide all the brochure promises.  I might be wrong but I would hope that if they did not go ahead with the Beach Club we could all sue accordingly!  After all they call themselves 'Roda Golf and Beach Resort'.  It would be good to know that they have got the license for the Beach Club though.  As you say it does seem strange that they have not made a start on this project.  We are phase 3 so we might run it by our Solicitor that we will not complete unless the Beach Club is definite 'work in progress'.

I did ask my solicitor whether the building licence was granted for the beach club and he advised that he didn't know as it is not part of the contract.  Maybe it is in the later phase contracts.

I think all the contracts are identical because our Solicitor attempted to change things in ours but Roda were adament they never made changes and we had to finally except the original.  So, thinking about it you are probably right there is little a Solcitor could do to hold completion on this basis.  However, the beach club is part of the promised package and I do think there would be a strong recourse if it did not go ahead.  I am sure we would have some legal rights.  Does anyone know how we can find out if the license for building on the beach club has been granted yet?  This could put our minds at rest.

I think the best place to start would be the town hall as they issue the licences.  However, I'm not sure which one it would be, I assume it would be the town hall on La Manga strip.  I guess we need someone who can speak spanish?

i would imagine that they would have to go ahead with it ...

or else change the name to just roda golf... ;-)

The Beach Club had not been started in October this year.  We found the plot and startled some nude sunbathers making the most of the quiet bit of beach.  It is a nice spot although the sea was full of murky seaweed!  I do not think they will be in a hurry to do this part as it is not going to make them much more money.  Does anyone know if De Vere are going to manage the beach club?  I think I read somewhere that they were going to franchise or let to another source and if they do not get the revenue or expected number of visitors from Roda then they will offer facility to Corvera too.  I think they will have to do this part eventually but it will not be a priority.  However, if De Vere are going to run it then it could be part of their hotel package in which case maybe it will be done in conjunction with hotel.  Keep posting the info and we might work it out.

In February 2005 when we pointed out to our solicitor that the beach club was not mentioned in the contract we were given the reply that although it is not mentioned in the contract The Consumers Protection from Sale Information Act states that where certain facilties, services etc appear in the promotion of sale they will be demandable by the purchaser even when not mentioned in the contract. This Act turns the promotion into a binding clause between purchaser and the vendor, even when not mentioned in the contract.

Hi Hirst

Thanks for this info.  I am sure we were told something similar.  I think they will have to provide the Beach Club but I do not think it will be available for a long time.  I am sure 2009 is mentioned in another link!  Once quite a few of us have completed we could try putting some pressure on for more accurate dates.

What phase are you in?

Hi All, I spoke with Maria at Roda Golf today and she was very adamant that the beach resort would be open in the summer of 2007.We are going over in two weeks, so I will look her in the eyes and ask again. Maybe I will be able to see if she is telling porkies. Good Luck To All. Mike & Linda

When we were over in Oct we were told the same date summer 07.

In the latest glossy brochure there are several pages showing how the finished club will look.

This would suggest there will definately be a beach club, but if its ready Summer 07 then i will be3 very surprised.

Hi everyone

On the 25th november we were told the beach club would be ready may or june of 2007.  Some issue as to what boat they are going to use - either get their own, or use one currently in service - either way there will be a 'nominal charge' for crossing the mar menor.

Fantastic news that the beach club will be open summer 07,  when I asked the same question on the 23rd November in the aftersales office  they gave me an opening date as somewhere in 2009....     Hopefully its the later date that will be wrong  with something lost in translation. ?

Hi I was originally told it would be completed with phase I obviously rubbish but I to have been told summer 07. i think they will have no chance if they have not started yet personally but who knows they may suprise us!!

what i was'nt told was that a fee would be charged to cross also i was told it would not be the local ferry it would be private to Roda.

we were told that there would be a free private transfer to the beach club for owners, and the club would be exclusive to roda.

Hi All,

Just got back last night and have some good news. The hotel is being started this month, and wait for it ……..yes! And the beach club too. We went over to the site at the end of La Manga and no work had been started, so set to and took loads of pics. Went too the office the next day and that’s when one of the guys there told us that De vere are starting both the Hotel and Beach Club this month. Fingers Crossed. We are back out the 11th Feb and will take another drive over to the site then.

 We were told yesterday the beach club would be opening some time this summer. There will only be limited facilities and the transfer by boat will be by regular public service. If later on when the club is fully open Roda intend to buy their own transfer boat.
