You will find the courts will only accept documents in Spanish, also unless you can file yourself in the proper manner (forms, stationary etc) and attend if needed you will need someone with power of attorney, effectively letting them be your legal representative.
If you can get a copy of the creditors list and understand it, and agree with the amount on there then you may be ok for the first phase. But what comes next and who corresponds with you, does anyone know yet?
If you find anything at all wrong, you may need to challenge it, which would involve the proper forms, in Spanish etc.
As the process goes on i guess you will need to be kept up to date, think about how you can do that without representation. It will be fairly hard unless you know the system and can speak and write in very good Spanish.

i appreciate all of the replys, but it seems the bottom line is no one really knows what is happening or what the outcome will be. the only people giving the advice seems to be the lawyers who charging for there services.
there are many people out there who have purchsed these retirment homes that may not have access to the internet so would not know any of what is going on and are just sitting there waiting for there houses to be completed. what position would they currently be in ??
how have the lawyers been advising them ?? as san jose certainly have not.

i know that you read these threads perhaps you would be so kind to let us know what happens after the administrators have finished there investigation. then perhaps we could all decide what the best way forward is rather than a lot of IFS AND BUTS AND MAYBE OR I WAS TOLD ON THIS SITE.

dave with all due respect what do you expect. In this life, with the exception of san jose, you get what you pay for. As we have all seen the spanish property system is incredibly complex and these "lawyers" have studied for years to gain the qualifications to assist. It should be expected that we pay for their expertise. So long as you choose not to pay for someone with excessive fees who sole purpose it so make lots of money. I have paid £150 so far and I am fully happy with the advice I have been given. I know that my case has been registered with the court have evidence and have been updated on what the courts have asked and deadlines in which Herrada del Tollo have to meet it.
I will inform everyone as to the feedback. But you are right - no-one knows what the outcom will be as the process depends on assessing the financial situation and that can only happen when the court has all the relevant information.
You are rigt though you should not be relying on the advice of people on the forum you should be sourcing the relevant information dependent upon your exact circumstance with a legal person who can answer your exact questions. You cannot expect this all for free though

i am fully aware of the spanish property system as it took me 2 years to purchase another property i have in calasparra just down the road fro jumilla, and yes it was a headache. i just dont want to spend money that i dont have to if it is not required. which i am sure is the same for everyone.
If you have requested the info from tony i am sure he will forward it, as i have received this info from him tonight

Oh I have not been quiet as I have posted before, I can not post on this site whilst at work.
Sarah as dave R said we will be posting the Q& A had with the solicitor but there are others who come first and it they will also be posted on the SARC site first before this forum. I tend to go with the idea that if I am spending money I want to get a few quotes and decide who I beleive is good value ( expertise,cost, communication etc)
Regarding POA that does not have to be given to the solicitor prior to presenting your relevant information to the Court and that is from the abagado not me.
As for the loaves and fishes not something I am into. Alergic to fish....migraine. loaves....not really I would prefere a tortilla and a corinita.
I really do think it is better that we all work together and those of us who want our house are!

I would suggest if not that your contact may be cutting corners and leaving himself wide open. Any lawyer would not do this and leave themselves open to allegations of abuse.The only way you would not grant POA is if you speak and write fluent spanish.

Hi Tony
When you have the full details and are able to place them on here it may be usefull for people wanting to source a lawyer, to include the ones you have talked to. Its another thread to list it on after all.
Im afraid i am not sufficiently well up on the Spanish law, concerning administration and licences and fees and the like. So it would be hard to recommend anyone, but the more choice there is the better it could be.
Im sure you will make the details available as soon as you can, we are all here to help each other arnt we.

We all have different agendas and points of view on this site and it really is a mine of information, but can I ask that when we disagree that we try and have an intelligent debate without resorting to name calling and referring to people as foolish etc. There is no need for it and achieves nothing except to generate bad feeling.

Yeah my story is the same sad story as everyone else, put down a deposit in may 06 , hoping to get it back. I don't believe SADM will ever go ahead but then again what do I know. I've been wrong before. I have legal representation, I am using a Lawyer along with some other Irish buyers and hoping for the best.

If you have info regarding a problem please do not just plant a seed of fear, kindly say what the problem is, then people can check if it is true or not. It may be that in a thread somewhere someone has said something that may be or not be true but how can it be checked up on if this problem has not been identified.

no no such thing just mentioned that another forum was saying that memebrs with bank guarantees had hit a stumbling block relating to reclaiming. I also put the web address and the mobile of the admin if people wanted to chat with a note that, under the circumstances I hoped the amin on here wouldnt mind.
