Hi all,
We are going to see the solicitor next Monday to draw up the wills for this apartment,  she said it will cost 170euros each person which seems an awful lot.
Does anyone know if this is the going price?

Hi

We paid 177.07 euros each. 42.07 of that was for the notary fee. Not sure if this is expensive or not, but our solicitor, who has dealt with everything else, sorted it out for us and it was all fairly painless.

I don't think there is any way around the notary fee as the will is not legally recognised unless notarised but different solicitors may charge different fees.

HTH.

Hi Ruth

You've done well!

Our solicitor quoted 220 euros each! Haven't taken them up on it.

The Will was massively expensive we paid 350 EU for the two of us - so you quote sounds about right - the bulk of the fee goes to the Notary who swans in like the almighty,  flourishs a pen on you document and swans out again - never ceases to amaze how powerful the notary seems to be in Spain !!

You could try  Carmen Mendez Garcia  cmendezgarcia@terra.es she's a lawyer based in Mazarron town.  Really nice person to deal with.  Also acts as gestor for your taxes, property and business.  She's Spanish and speaks perfect english.

Regards,

Steve.

We had not thought about it either, but apprently if both of you were to die and you DONT have a Spanish will (it ONLY relates to Spanish goods / property AND any cash in a Spanish bank acount) the Spanish government takes it all  !!

My wife and I are not planning to pop off just jet,  but I aint going to them pearly gates knowing that my place in the sun will revert to being a Spanish govermnet asset - your Solicitor will/should advise you to get a will - better safe than sorry !!

Ironically we now have now Spanish will but no English one !

The problem is that Spain agreed a long time ago that for non-residents they would abide by UK law regarding inheritance laws.  The problem is that the UK law states that they will abide by the law of the particular EU country concerned.  Hence the slight chance of confusion and catch 22 situation.

It is not compulsory, but advisable and in the scheme of things a small cost for peace of mind.  The other thing is that if you don't have a will it would cost a small fortune in lawyers fees should something happen.

The only difference in Spain is that the remaining partner pays inheritance tax, and  you have 3 months to make the claim from what I can remember.

Check this out with your lawyer as things/laws do change regularly in Spain.

Steve.

Hi All,

We will pay our solicitor €580 for 2 wills - including the legal fees.  Sounds as if he is on the expensive side.  It will be sorted at the same time as completion (2 weeks time).  It was painless enough, the proof copies were generated quickly etc, but based on this thread, it sounds as if we have been ripped off a bit.

After all the losses on Exchange rate, Completion pull forward, Lost Foro etc etc it's relativeley small fry in the grand scheme of things I guess.

May need to deduct some dosh from Deb's furniture buget to compensate!!  (Not)

Skell

Hi all,
Haven't a clue how much our wills cost, all my hubby was interested in was the Notary. She was beautiful and he couldn't keep his eyes off her and sat with a stupid grin on his face and noddied at everything  she read out even though it was in  spanish.  I am sure in thinks he got value for money no matter what he paid, just for sitting next to and looking at her.

Doesnt sound like the notary we had. Ours had a beard and wasnt good looking. Anyway, we had our wills done back in June through our solicitor and the charge for both wills was 240 euros and he picked up the notary cost. Felt a bit odd giving him the money in the street afterwards and no reciept, but all is fine as I now have hard copies of the wills that are in both Spanish and English. Hope mine wasnt too expensive as I lost out on the eye candy...
