 I got a few reactions through PM as owners are unfortunately afraid for the developer so they don´t want to go public with it. This has even costs some votes at the last meeting. 

So I will keep people posted as there clearly is interest in the phase II community. However I suggest to all of you not to be too afraid of the revenge of the developer/president. Real problems are not fixed anyway, whatever behaviour you show and whatever you vote. it are just the small snags which get fixed. Not the important and expensive ones.

Some people even had to sign papers to never hand over pool keys to phase I owners, while others never did. It seems Arrohabitatge combines its two roles: community president AND developer to misuse their power and intimidate people.

The good news is that they have to sell to survive so slowly more votes will trickle down to the owners site. Three more became available for sale as the family tries to cash on apartments they had intended for themselves so their majority will dilute.

The moment the owners take their stance and refuse to pay for backhanders from the developer to their contracted friends and helpers their influence is gone. What is left is difficult enough as they rented out quite a few apartments for long term so the voting rights for these apartements stay with Arrohabitatge for the foreseeable future.

 A much more friendly and cooperative meeting was held. The only important decision to be made there was the choice for a cleaner as the selected one didn´t want to work on the terms set by the committee. 

After a lot of discussion about a lot of new quotes, most of them collected by the neighbours themselves, it was decided that a specific much cheaper company would get a temporary contract to try them out.

There is also a fresh wind blowing from the developer. As opposing every step of the neighbours didn´t fare well and they realized they need to sell apartments urgently to satisfy the bank, they are much more forthcoming now. The president took actively part in the discussions, but no longer insisted on sticking to her original proposal. 

The posts on EOS will have helped them to realize that a negative attitude against current and potential buyers won´t help sales. There have been a few sales in phase II recently, all at exceptionally good prices on the condition of fast completion so liquidy is clearly a major concern. Some of the renters with lease to buy schemes are moving out and the apartments are for sale by the pomoter for the same reason.

This fresh and much more pragmatic approach carries over the president off course so an overall improvement.

The issue about UK television in phase II is now solvable as access to the roofs can be provided. For other Europeans it´s even easier as they can get the same access of course but don´t these large dishes. So that will be cheaper and not dependent on the roof structure (for ´sky´ dishes reinforcements are sometimes needed: all the roofs of Don Juan I have concrete plinths retro fitted by our communal installer).

Hi neighbours,

We're very sorry to hear about the sudden death of the Dutch owner (ruptured aorta) of the Beachbar 2 bees, next to Gavia in Torreblanca.  The family bought the bar September 2009 and had big plans (and great food), unfortunately this disaster disturbed their dreams for a sunny future!

We want to wish his wife and children all the best during this very hard time and a lot of strength for the near future, in Spain or in Holland, whatever they will choose for....

 That´s shocking news Corrie. I know the family well but have been travelling a lot lately so I was not aware of it. What a devastating news. I don´t think they are reading here but I will visit them a.s.a.p.. 

I was aware of the large risk they took in setting up such a large bar on such a convenient spot from Carvajal. A great place to stop for a coffee before getting on to Los Boliches. You can´t prepare for the sudden death of your husband and father. Luckily his wife and daughter are very good in their business so I hope that after this winter of sorrow they can recover and keept their dream of a beautiful bar at the Çosta alive.

Hello Max,

Mum immediately decided to go back to Holland. Their son had already decided to go back in sept. 2011, he is a cook and had higher education in Holland. The beachbar is for sale now.

Dad will be cremated this week in Spain and after selling mum and son will leave Spain.

Their daughter will help her mum for the first month (s?) in Holland and will return to Spain, because her boyfriend lives in Torremolinos (and she too).

For them comes a terrible end of a beautiful dream! A nightmare, a lesson to all of us to enjoy life as long as we can! Carpe Diem!

Our Spanish neighbour gave us the numbers from the colors to paint our balcony:

Emucril 10, color Oscuro: 5011 piedra de garricho (something like that, cannot read it, but number fits)

Emucril 10, color Claro, 5001 azahar

From: Pinturas de Andalucia, on the road from Fuengirola to Mijas, near the garages and furniture shops......

I have not checked it myself, but I think it will be fine.

Hope our french neighbours reads this too, he asked me for the numbers.

The day Nuria left the building. Episode II

Phase II finally got rid of their president, the daughter of the old Don Juan the developer and a woman phase I knows well and kicked out earlier. Hence the episode II.

On yesterday nights evening phase II was freed and got rid of Nuria. It didn´t go smoothly, she put up a lot of arguments when she already knew she had lost. The agenda was rescheduled to get this election of president and vice president to the top and of course she tried to fight that. She even fought after she was already defeated but formally still the president of this meeting as is the case. However somewhere after three hours she really gave and left the building, leaving the meeting without president.

I saw her move so took a small pleasure in making sure that I was just in front of her attempt to storm out. After threatening to kill me and my child we are not the best of friend and she still feels bad about me standing arms crossed with the police next to me before block III where the family had an illegal electric cable running to the penthouse of her sister. She doesn´t like people in general, but hates foreigners who stand in her way. So why not repeat that this time by physically doing so :)

Private fun apart it was a complex meeting which I will not report in detail. It took slightly more than four hours and everything has been discussed. However most of the decisions will be subject to legal advice or appeal as the situation is complex with Arrohabitatge being the developer, but also the president. Motions has passed to annul the outcome of all the former meetings, atttemps have been made to vote for improvements (f.i. one involving phase I) but they were objected against by Nuria, her lawyers who is also a owner in phase II and the now former vice president.

The administrator wanted to get kicked out apparently by siding with Nuria until the end of the meeting. Obstructing decision making, claiming things were not allowed, etc. They were voted out earlier in the meeting but of course they have thirty days notice. Why they would use all their energy after losing the contract to go against the meeting is a mystery to me.

Anyway you have an new president which I tippped at day one to all my friend here as the most qualified candidate. I was not the only one to observe that as he and his friend who has also attended alll meeting well prepared and with sensible proposals were unanimously chosen. Although I know doubt if Nuria voted for him....

One funny thing is that when  Nuria left the meeting a new president was needed. A lot of people asked the new president Antonio and another neighbour volunteered as well, but Antonio showed true leadership by suggesting that the oldest person should take that role and so the father of one of the owners who represented her was seated at the table.

Phase II doesn´t know how detailed my report of our meetings used to be but I leave it at this general description of the atmosphere as unfortunately no other foreigner were at the meeting. I was the only non Spanish. There was as far as I know only foreigners represented by a proxy apart from the people who´s proxy I carrried. Strange as these meeting are crucial for the value of your property and your comfort. You should have you´re say they as there are conflicting issues in which it´s important to be part of the decision making.

Positive was that the Spanish came up in reasonably large numbers and most of them carried a proxy for a neighbour. So the participation in phase II is higher than in phase I but it can be improved when the non Spanish get involved.

Thanks Max for keeping us informed.

Let's hope our new president will do a great job, because for us Nuria was fine.

We could ask her for anything and she solved our problems.

Unfortunately for her many neighbours did not like the fact that she was our president.

However as her neighbour we want to thank her for her support during the last years.

It's a democratic decision, so we also welcome our new President.

We hope he will do a good job, for which we are grateful.

Assuming that Max is right  congratulations indeed to Antonio! We wish him well in his new role and hope that now that control of the Phase 2 community is in the hands of the neighbours we can look forward to working together for the benefit of Don Juan as a whole.

We should not pretend that this will be easy but lines of communication are open and with goodwill on both sides we can make Don Juan a better place for all

David, this a public forum and not a place for personal insults! You´re behaving childish but also against the rules of this forum.

You and everyone else know that " Assuming that Max is right (a pretty big assumption)" is an insult without any foundation. . Remember I was already vice-president when I invited you to particpate in meeting without you even being voted in like other members. Just to make sure there would as much participation from all the nationalities as possible to keep everybody happy.

I more or less singlehandedly provided with a stream of intormation for the last six years and I have been rarely wrong and if so due to changed circumstances after my posts. I have tried to inform all three phases as open as I could and not for any personal gain. I put a lot of time daily in the communities, am very well known here and hardly miss a thing that happens over here. I have kept most of the incorrect information in the newsletters off this forum as this doesn´t contribute to the atmosphere. It´s not a thing of you and me but a forum of all owners in Don Juan.

I won´t go into your contributions but remember you already caused a complete thread to be locked and then disappear by you repeatedly calling people names which was too much for the moderators. Don´t let that happen again and certainly not in a thread which belongs to another community and which CC started and actively contributes to.I´m personally not an owner but I represent owners at all meeting, rent in phase II, know a lot of people in phase II and try to contribute to their community as much as I can and on behalf of real owners who support me in doing so. Let´s keep this thread to the people to who it belongs and your personal problems out off this forum.

Good to see the correction at least although it´s still a strange way of commenting on someone who actually spend all these hours on meeting, just assuming I would know who is president. Anyway, thanks for correcting it.

 on a completely seperate note.. 

it was nice to see that all the cars that double park on the road leading up from 'starks' to the train station were being towed away this weekend.

they took loads of cars, vans, jeeps, etc throughout the day and it's about time!! It's ridiculous trying to get up that hill throughout the summer!

That's great, taking the cars away. It's not the first time, most of the time they are active in the weekends.

We cannot get down with our car, because we don't like to go to the right, because our bottom of the car will be damaged! And that's no joke, we've heard it many times at other cars....

I must say the sign of No Parking is not very well situated, I asked the police to replace it, because many people are not aware of it. We also did now know, so I asked them why they took away the cars and he pointed at the sign, it's a bit invisible.....

But I guess we'll have to go to the townhall to have it replaced, it's not a job for the police.

I think it will stop when the sign is visible.....

Just thought of an idea regarding getting the road by the railway line finished. How about if the committee made a sugestion to the townhall that if Adif finish the road now, then parking bays can be installed along it where the money raised from the meters goes back to Adif for the costs involved in finishing the roads. Then maybe any money raised after this can be split so the townhall get a cut, and Adif a cut for maintenance and repair of the road. Seeing as they all park there anyway every Summer, maybe this could be a solution. That way everyone is happy. We get our road, the townhall get us off their backs and make revenue, and Adif get us and the townhall off their backs and get refunded for any costs of finishing the road and future payments towards the maintenance of it.

Good idea Westport but even in today's cash strapped world money is not the problem in this instance. The Town Hall already collected the money from the developers (I guess that includes El Higeron) and has assured us that as soon as there is no legal constraint the road will be built.

 About Phase II Comunity Meeting at 29/07/2011.

I´m Antonio a owner of phase II (Block 5). I support Max in his report of the meeting:

1. Nuria is out

2. Administrator is out.

3. Antonio (Block 1) is the new president, and apparently wants to change things.

4. Antonio is going to meet President of Phase I to share problems and looks for solutions togheter

Examples:

- Ramp between Block 1 Phase I and Block 2 Phase II. (It couldnt be aprovedd, because of Nuria is against it)

- Change Glass/Paper/plastic Rubbish container from Block 2 Phase II to another place in front of Phase iii 

- Tiko (Security Guard), to be assumed for all Don Juan. And a cabin for him in winter. People are very happy and satisfied with him.

- Play ground for childrens where they can play football

 

... ¿Why dont change this forum to facebook, as group?
