To respond first of all Maria know me very well and it is refreshing that she is giving advice on this thread as she is one of the most capable lawyers that I know ,that deal with this type of specialised litigation and I actually have referred clients to her
The facts are thay yes I do get people, on a regular basis ask me about completion plus up untill thso post the only way of getting any advice was to join the legal group and surely any comments form somebody like Maria on this forum can only benefit buyers that are unsure about completion.
All I have asked are some simple questions abut timing of cases and the law which I know will HELP PEOPLE, things like when does she expect the first judgement , because there is precious little information coming from other groups or Callidonia
For those of you banging on about self promotion how can asking a lawyer that I know questions, about the law that are relivant to people who are really concerned about their completions be self promotion, please give me a break
Unfortunately some people are choosing to ignore things, do not have access to anoither lawyer and are reluctant to post on here because of the hostile reception that they may get from some people, free advice from a good qualified lawyer

I’m not a Lawyer, but I play one on the Internet !
People aren’t stupid and can tell the difference between “being helpful” and “trying too hard to impress”. Considering that you have a business to run the former is forgivable and quite natural, the latter might lead them to believe you have some to hide, especially since you do not own a property at Corvera.
Ever heard the saying “Give a man enough rope and he will hang himself” ?
Buyers with a financial interest at Corvera are all watching you….and making mental notes, especially as to how objective you really are.

Absolutely nothing to hide as my customers know but I still enjoy the way that certain love to attack me when I post anything on this forum when comments that I make can be proven to help people
Say what you like it doesn´t effect my business or comments from clients and won´t sop my posting and I awit the next interesting installment form the leagl group if you understand me Ash

I have just read quite a few more of your posts and it stands out considerably that you come across as being here to help everybody who has a concern at Corvera when clearly there are hidden agenda`s one being to fill your business bank account up as quicly as possible then move on to the next group of unsuspecting buyer`s on the next resort
Am I not correct........

My busness has benn operating legally in Spain for 5 years now and I cover many sites and have inspected more than 3000 properties, not a bad record in Spain for somebody as you put it, move on to the next group of unsuspecting buyers, but don´t take my word for it have a look at my references form people on various threads
I still have regular contact with people that I helped many years ago and i am still helping them with queries
I only deal with new properties so of course you move around s, which happens a lot with people who neverites as they reach completion, most of my work now is on Corvera Mar Menor 2, Sucina Mirador and 2 developments i n Vera and eventually 3 Moiinos if it ever happens
Perhaps Dincan 4, as a new forum member you were perhaps previously known on this forum as somebody else, quite common when people don´t put any profile on their membership and easy to do but I admit I work to earn money, shoot me

Hi All,
I think its blatantly obvious to see that our good friend inspecta-pileofcrap has far too much time on his hands and therefore has decided to try and stir things up a bit.
Equestrian cenre, dont make me laugh, legal team= a bunch of scumbag fly by night,no win-no fee merchants.
Like Maria we are supremely confident that we will win our case, but we are under no illusions that there is every chance that it will be a long one.
So dont you worry about us inspecta , you just worry about where your next client is going to come from because they clearly are not knocking down your door in a rush. Its actually a shame that you have tried to play this game far too many times because if you did actually stick to your area of expertise then people deciding to complete or coming onto this forum would definitely be swayed to using you but i like many others would rather stick a hot poker where the sun dont shine than give you a call now.
i guess that means your advertising campaign hasnt worked too well? Maybe one of your chums at Calidona will get you a job in their marketing department?? I think that would be a good job for you.

inspectahome , you are clearly misunderstood on this forum and indeed roda and i for one propose you for the spanish equivelent of a knighthood for tirelessly working to help the mainly uk consumer cought in the middle of spanish property lies and decite with no thought of financial reward or remuneration for yourself , such a noble act in these uncertain times !! in fact to come across someone involved in the spanish property market who has a thought for anyone or anything except themselfes is indeed a first in my case .
as your company has been established 5 years perhaps in your unending quest to benefit the consumer you could have been as active in your postings warning people of the corruption and lies that were clearly taking place over the last 5 years and to be very wary of purchasing in the region !!! any particular reason this was not done ??

Thanks Maria for an excellent post, as Roy has said Maria is a very capable lawyer, and I believe she is as honest as she is capable. She is an expert in this field of property law, and the reason she is very confident is simply that our case is very very strong. Personally I have very little doubt that we will win our case, and that's coming from me, someone who is normally called a complete pessimist.
I have no doubt that Corvera will have a trick or 2 up their sleeve, they may well turn up with a horse, cart and portocabin and call it a first class equestrian centre. Miguels place may well be referred to as a 5 star ultimate dining experience, and no doubt there will be further future promises, but I believe the truth will be clear. Corvera's underhand tactics with the Lawdit firm has shown them in their true colours, their scare tactics have served only to strengthen our resolve.
I certainly believe that Corvera have only progressed as they have with the golf course and clubhouse, not because it was in some sense the right thing to do, but in response to the massive number of disappointed customers who they can no longer ignore.
Corvera have come well well short of what they promised, and the right thing to do, would be to offer us the deposits back, but unfortunately Corvera are not into doing the right thing. None of us wanted this, the problem is of Corvera's doing, if they want a fight, that's fine, I know that there are many of us, we have excellent lawyers, we are united, determined and are ready for whatever it takes, time to bring it on.

Let me refresh your memory I also said your comments about " Your secrets safe with me " When a group of Corvera non-purchasers with there Lawyer were having a private conversation, How you upset the more elderly among that group when you posted on here your findings and when asked by me on about 3/4 further postings .politelty , to at least acknowledge your crass insencertivity , you could not even do that,
Some people have their Life savings in CALIDONA and are in their late 60"s just take a seoind before your " smart " comments and have a think. , What have I got invested in Calidona ??? NOTHING , you move to another Resort these people havemaybe years of Heatache
Oh I nearly forgot as well as Arrogant I would like to add another one you pocess that starts with an a, in your case a capital A

This is not and never has been an advertisng campaign and the questions that I have asked about the result fo the lagal actions against Polaris is very relivent to this case as the circumstances seem very similar and surely it is all abount presenting balanced facts
Maria posted and as I am sure that I am allowed to do I asked some questions because it may surprise you that on soe other developments there are similar problems, so the answers could help number people and certian people,as normal jump all over me accusing me of all sorts of things
Also an honest question which Maria answered well that she was expecting the first judgemnt before the Summer because it is unclear why not a single case, based on the lack of facilities has yet reached court
It is pointless in my view callng me names, typing in caps and telling me that people are watching me as people have the benefit of choice to use me or somebody else, to complete or not to complete, and not to be bullied by Corvera or another other group of people and of course make comments on this forum
As far as my work is concerned there is no real change in the volume of inpections and I still spend at least 3 days per week at Corvea, people are completing most weeks and I get regular new enquires so business is good and you can see form the comments people rate the quality of service
Since the meeting in the situation in Miguels I have actually had a number of converstions with the person that is ill and have been trying to help him with some commonsense advice
May I also say that you should not perhaps have a private meeting in a public facility
KEV2 you are right with your comments but agian my question was a valid one, what happens if when people eventually reach the Supreme Court in 3-4 years time the facilities have been built
Searay please check the articles section on this forum where for the last 3-4 years I have written advice pieces on contract and snagging conditions and highlighted the problems with corruption, lawyers and facilities, specifically if their details and completion dates are not included in the sales contract and little gems like NEVER use the lawyer recomended by an estate agent or lawyer

I am certainly not the biggest fan of Calidonia and the fact is while there are no facilities, renting these properties remains almost impossible, and there will not be a clubhouse till after the Summer.
The properties are probably not worth the agreed contract price and getting snagging work done is a nightmare but I still think that responses to some of the questions would be beneficial to all but i people want to spend their time attacking me fill your boots

I do not believe that it will go all the way to the supreme court but for arguments sake we say that it does, I think that they would consider the delay as unacceptable, even if the facilities are in place (which I certainly do not believe will be the case). If for example the case took another five years and they managed to complete the facilities in that time, that would mean that we would have been waiting 10 years since we paid the deposits, I think anyone would consider that unreasonable (except Corvera of course)

I am not sure if you have been made aware fo the situation at Polaris Hacienda Requelme with the conversion of the Hacienda and the fight that the buyers went through, similar to this one and the press that it got on BBC Watchdog
Eventually the ruling was I understand that because the contracts or publicity materials did not specifiy a start of finish date and they committed to
The Courts that they will build the facility, in fact works have just started again, the buyers lost the case
Agian like Corvera the resort pools gardens etc were finished, the golf course was open and they had a temporary facility, a porta kabin
This was almost 3 years after people first completed and it may be worth asking lawyers to obtain a copy of this judgement for comments
By the ay if anybody is passing the Polaris Head offuce there is an ongoing protest by some buyers outside the front gate

Is that Polaris ruling from an Appeal Court or a First Instance Court? Do you have it? Can I see it?
Again, I do think that a real effort by the developer to compensate clients, by offering the fair and necessary price reductions and a calendar of events regarding amenities, will bring to them more benefits than fighting this.
I am sure many of the dissapointed clients will be up for this and then, the project would be somehow restablished and reinforced.
Unfortunately, if this option if not tried, people will have to follow the litigation route, which, in our opinion is strong enough due to the clear and uncontested doctrine by the Supreme Court ( which needs to be followed by every Court in Spain) regarding the linking character of publicty since 1977, which has also been included in Consumers regulations since then.
I do thruthfully hope that the negotiation route will be at least tried.
