Hi all,

It seems things are now moving and people are so fed up they are prepared to take another financal risk to recover their deposits.

It does not have to cost thousands for a legal claim.  I am prepared to go 50/50 with a couple i have met on this site some years ago.  We want our money back so this is the plan.  We will go half on the legal cost and split any money refunded then pursue the other persons claim for their deposit.

once one claim has been won the floodgates should be opened.  Sadam will never be built and Spain is going the way of Greece and Ireland. 

I would like three other people to join our group so we minimise the costs, but would have a chance of some or all of our money back.

If interested send me a pm, I only want 3 people so we will be a group of five.  Who ever is elected will be given the funds to make their claim.  I have time on my hands so I could do it or I will send my cheque to the person elected to chase their claim.

5 people we get on fifth of the deposit recovered by the first claiment, and we then make a claim for all the others.

I will only accept the first 3 people to contact me.

After speaking to Guadelupe I was assurred that 700 euro would be the full cost ( 600e gm, 100e P.o.a).

I could only see  problems with the group proposal.

Retainer is 700 euros. PoA not included. The retainer is requested per buyer (couples Or groups on same contract are considered like just one buyer). But one retainer will apply to every buyer otherwise

Just to let you know that the deadline to join this class action against the Banks terminates next Friday, 17th. Purchasers who has already decided to join it are anxious to start proceedings, and obviously we can't be waiting forever. This doesn't mean that any purchaser could bring an action later on, but it would be a different claim.

Hi All,

I have seen the time scale that has been put forward to get a result and it is several years,that does not include appeals and cost resolved at the end of the legal process.  There has been a recent case  against Polaris world http://www.simplynetworking.es/news-6878-31-long_standing_polaris_world_case_back_in_court.html

and although it is not totally the same it iss worth being aware that results can be problamatic.

For those of you who have decided to spend some more money ,I hope that it works out OK for you and that you do not come to regret it.

 Hi All,

the time estimate for a Court process depends on the appropiate Court to deal with the case. In the example given by ToniMal, appropiate cout was San Javier, which is one of the most delayed and more colapsed Courts I have ever dealt with. But luckily San Javier court is not the appropiate court to deal with this case, and additionally, sentences can be "provisionally" executed" even if there is an appeal from Banks (just delay interest and defense cost can't be executed before the appeal's ruling).

Hi All,

The time frame of several years that I have mentioned is from Gaudelupe's email to some of our members.  Please be aware that in the ruling that I have posted the court deducted money from the payments owed to the purchasers. I have won a court action in the UK which I did not instigate and even though I was supposed to get costs, the court only ruled for the other party to pay £2000 and I ended up with a £10000 bill. Not very amusing.

I think that you are being rather crassly rude as I have been consistent and do not lie nor mislead.

My court case was in the UK in the civil court and was a nieghbour dispute, instigated by a nieghbour and I won but lost £10K! You may not like the example of winning a case but loosing money but it happens all the time. I suggest you check up the Polaris world case that I put on the thread.

As for time frames I quote below is the projected time frame for this legal action and it does not look like a speedy resolution to purchasers problems

1.- Legal letter to claim full copy of the generic policies and the payment: 10 days.

2.- Preliminary Enquire to claim full copy of the generic policies: 3 to 5 months.

3.- Ordinary Civil proceeding in the appropriate First Instance Court (1 to 2 years).

4.- Appeal to the Magistrates’ Court (1 to 2 years)

5.- Appeal in the Regional or High Court (?)

6.- Sentence’s enforcement & execution (?).

I'am sure that we all appreciate your grave misgivings regarding people who want to try another way of getting their money back, i think all of us undersatnd that nothing is guaranteed, however having met guadalupe in person we were more than happy to proceed with this action.

If there is any hope of getting our hard earned money back then i beleive it is worth taking the risk, i'am sorry but i beleive that guadalupe has a better understanding of the workings of spanish law than you do, after all she is spanish and a lawyer, we have to put our hopes and trust in someone, and that someone is not going to be hdt.
