I posted this on another forum in June - it may be of interest... needless to say I am still waiting for a guarantee however I was up to the site this week and they are still working away so not too concerned....

The latest response via agent on my issue of attempting to obtain the guarantee...
We have been advised that bank guarantees are purchased from the banks en bloc in millions of euros, in other words strips of bank guarantees are purchased at a time and these are given to those who have requested such guarantees
The bank guarantees are based on land values and as land values change from time to time it does take a while for this land value to be effectively assessed.
The last bloc of guarantees have been used up and I am informed that the next batch will be available on or before September 07 and you are included in this batch for your guarantee.
Personally I suspect that September date mentioned is scheduled to coincide with the next license release and possibly a reduction in cost for SJ in obtaining the guarantee … but who knows

Hi Everyone,
My husband and i have been waiting 3 years for our house to be built at Albatera Golf.Since deciding a few months ago to take our money back out this has been proving very difficult. We purchased from San Jose and they are refusing refusing to give us the 6% interest which apparently we are entitled to by spanish law and they are prepared to go to court which of course they know will take for ever.
We would just like to let everyone know who may be contemplating buying a home through San Jose that our experience of them has been a hellish one they dont care about their customers at all, it appears all they care about is taking peoples money, they took 50% off us.
Not once in 3 years have they even offered us a complimentary holiday and forget trying to communicate with them, they do not want to know, they are treating people like absolute dirt and getting away with it. If anyone in Spain with any authority is reading this then i appeal to you to do something about this company as it is not just their reputation that is at stake as a lot of people worldwide are being put off buying in spain because of companies like them.

Hi I was interested in your message as we want our money back from SA due to delays and other things not happening but will have to wait until contract is breached according to our solicitor. Are you trying to do this on your own or through agent etc. and is it only the interest they are arguing about, and not the deposit? Also have you a Bank Guarantee. They are reluctant to give these out now according to the Forum, one wonders why. I do hope you get all your money off them, even if you have to go to Court, they should be made pay the costs. The Spanish Government should clamp down on these rogue builders hanging on to clients' monies, Albatera hasn't even been started. They should order them to refund all monies immediately. They would listen to them at least. Good luck in getting anything you can out of them.

Interested to read the forums and seeing some not happy with progress. We were taken to Jumilla by an agent called Spanglish homes. I was very impressed by the show homes and the area but completely put off by the agent who informed me that i did not need a solicitor as the Spanish don't use them and by the fact that the builder was unwilling to give a bank guarantee unless we paid for it! I am now pleased that we didn't buy! In the end we bought through a superb spanish agent called Novacasa in a small development in Hurchillo near Orihuela. The appartment was on time and to spec with no problems at all! So not all spanish builders or agents are rogues!
