Hi All
Just arrived back Sunday and we have been on the site ,actually knocked on our door ,daft buggers there was nobody in.Well to start there is activity on site electricians wireing gates up etc .We strolled around blocks 12 13 5 6 7 and in our opinion there is a lot of cosmetic work to be done before we can consider completion.We did notice a crack in one wall and what looked to be rising damp on one of the blocks on vial D which will need to be investigated.The large gates are in place around these areas but need a coat of paint urgently ,already showing a little rust.The gardens are all fully stocked but the weeds are taking over in some parts .There is a gardener seeing to these bit by bit.The walls to the apartments are looking a little grubby with staining from the wood preserve running down the walls,this is not bad but something you do not want on a new apartment.They still look great after saying all that and we still will be going ahead with the purchase.
On a more positive note,what was once the original show house has just been opened by reps from Gerens and the lady we spoke to was very positive that our solicitors would be getting emails in the next week 19/11/07 to confirm the contracts and that completion could be starting very soon.

We will not be completing now untill mid January ourselves even if contracts come through next week let them wait for us for a change.If we all stick out for then or latter there is not much they can do.Or is there?
Anyway thats how we see it and sorry if some of it is a tad negative but that is what we think

What levels of compensation are we all thinking about?, as completion could be in the next few months should we all be requesting the same?

We are just happy that our monies have returned to our bank accounts in England today, after a lot of false promises.
For all those still waiting on a date to complete, good luck, you deserve it.

Owners should take occupation of the development in good condition. Maintenance is something that the Management committee take control of after full occupation. It is a legal obligation for everything to be in good and working order before occupation and the ten year warranty should also be in place for apartments and communal areas.

PS Are we really any closer to completion than a month ago when we were told December for the first lot?

Thanks for the update - things keep moving along albeit slowly - I think completions will begin on 8 December as I'm being positive and it's my birthday!!

It is my understanding that when we snag we not only snag our own apartments but the exterior as well. If the complex is not up to standard then it will have to be put right before we sign at the notary. Staining of exterior walls, rising damp, rusting gates etc are not to be overlooked in the rush to complete. A common snagging problem in Spain is that the property or communal areas are not complete when the buyer arrives to check them. Communal areas such as pools, gardens, street lighting are often delayed as they are not a priority.
As you say Alan recent changes in Spanish Law requires developers to provide a new build warranty for the first 10 years after completion, similar to NHBC, however, this only has to cover major defects, structural defects, affecting the safety of the owners. It is common for Spanish builders to provide an insurance policy that covers minor defects for the first year and more serious defects that do not present a risk to the occupants for the first three years. We need to check that the policy Prienesur has covers more than the statutory minimum. Remember that this is an insurance backed warranty requiring that you claim against the policy and the original builder. A copy of the policy has to be included with our deeds and should be checked by the Notary. I personally shall insist that Prienesur confirm in writing before I make any travel arrangements the property is complete fully inside and out and that it has been cleaned internally ready for me to move into. The joys of buying abroad!!

Alan I feel that you are becoming down beat, is it all these months sitting near bottom of the league that is bringing about this discord? Why don't you speak to Prienesur about swapping your block to one of the blocks that has the licence and is finished properly? You know that you want to complete with the rest of us.

Aaah Tracy your barbed words have cut me to shreds! Actually I would settle for just having a DEFINITE completion date, something I can work towards whether it's next month or next year.
As for the league well I prefer to support a British team in Britain rather than a foreign one. Also do you not feel your lot are a South London club squatting in North London albeit in an expensive property?
Only thing is I seem to remember that new build finishing on time!!

Thanks Kennylynn, for taking the time to post. Feel a bit relieved to hear you still want to be on board, having recently viewed. Very positive. Must say though, that we won't complete until those apartments are in spanking condition. After all, we are buying new here. It's not our fault the building has been sitting around unoccupied. Margo
