Hi Debbie,

I asked the question but already knew the answer I guess.
We have arranged flights etc and aircon to be fitted on the basis that we would complete on the 11th.
It is more frustrating than anything.
I take it that PW are picking up the costs of having to postpone completion?
Maybe they thought we would all complete without the necessary documentation in our desperation to own our little bit of Spain. 
They must know what documents are required its not as if they haven't built a few apartments before on different sites is it.
Well I have given up worrying now, we are going back out in September, theoretically to stay in our apartment assuming utilities etc are done.

A few months and this will all be a distant memory for everyone
Till then if you can't beat them join them.

Hi Phil,

Yes PW do pick up the cost of postponed completion, but only in as far as they will pay the for the Power of Attorney.  They will not consider refunding cost of flights, accommodation, hire cars etc etc.  The POA cost 150 euros and our solicitors tried to charge us for that - not sure whether it was a genuine mistake but I quickly pointed out to them that PW were covering that cost!!

As you say it is frustrating when you have plans made but we still enjoyed our completion visit to Spain - got a bit longer to relax in that lovely sunshine as we didn't have to hang around at the Notary's office to complete!  

Not sure who is doing your air conditioning but we have arranged for Polarair to do ours and they have agreed to do it on the 13th August, before we arrive on the 16th August, so that it is all done ready for us.  They have even offered that we can pay them when we get over there and not to worry about sending the money over.  This might help if you are wanting to go over in September.  

You never know, things might have sorted themselves out by it gets to your completion date but if not, it should only be  a couple of weeks before completion can take place.  Good luck!

Hi all,
      Well I think I've finally got everything sorted, Cam bank, forms to Polaris, solicitors, snagging. Got a call from Elisa at Polaris yesterday asking if i was willing to go ahead with completion on Wednesday 2nd July even if they didn't have the certificate of habitation. I asked her if there was any risk to us if we went ahead (just want to get it out of the way now) and she said no risk at all, the certificate will be e-mailed within 2 weeks. I have had an e-mail off our solicitors saying that Elisa has been in touch about completion. My question is has anyone else completed without the certificate and is there any risk if we do complete. Don't really know what's best.

Hi,
As has been said by others earlier, our lawyer has strongly stated that completion should not take place without the certificate. There shouldn't be a problem but if there is...... It is a large amount of money to risk !

I think the answer to that one is, will another 2 weeks make that much difference after all this time?  I am due to complete on 15th July and already decided that without all paperwork and Certificates in place I will hand over to solicitor to do POA, we are all very eager to get our Keys but at the end of the day is it worth risking everything that you have worked so hard towards for the sake of another 14 days.  At this late stage I think its worth waiting the extra few weeks just to be on the safe side... We have all heard and read about how wrong things can go, with the best will in the world ' you just never know' but its up to every individual to make their own choices.  What ever you decide I wish you luck and hope we all get what we want eventually.  Take care and hope all goes well.

I agree I think you should not go ahead without certificate of habitation, my reasons for saying this are that most if not all the lawyers are recommending you shouldn’t complete without it most banks are of the same view and so many other thing should be in place before it is issued and the issuing of this document is the only way you know these should have been done.

Also you would go to the back of the queue as far as PW is concerned I think as it would be in there interest to make sure things are in place for those who will not complete without it.

Our Mortgaging Bank has catagorically stated no certificate and sign off , no completion.

I think if you are using CAM then they have a vested interest in completing ASAP for PW.

The chances are everything would be fine if you go ahead without everything in place but you know the saying "there is always one exception to prove the rule"

Also like the other Phil said If you do complete without , you would almost certainly go to the back of the PW queue,  bearing in mind just how many completions they are trying to do.

One general question ..... I was told by my solicitor, that in Spain,  August virtually shuts down in terms of the lawyers and notary offices as they all take holidays. Have PW made special arrangements or is this not the case in the Murcia region???  I have noticed a lot of people saying they are due to complete in August.

Anyway Good luck Chris and Tracey we are not far behind you and I am sure we will get that beer on our respective patio / sun terrace fairly soon.

      Having read all your comments i've just e-mailed solicitors, polaris and the bank to say that we will not go ahead without the certificate, Elisa from polaris replied straight away and understood completely. Thanks for all the advice, best to be safe than sorry.

Pleased your mortgage etc is sorted out - as you say, it's not without a lot of hard work but things do seem to come together in the end, even though it seems to be at the last minute! 

I think you have made the right decision not to complete without the Certificate - it really isn't worth the risk.  If you go against your lawyer's advice, you have no come back whatsoever.  Our completion was only delayed two weeks and although it was frustrating and a little disappointing, I don't think I could have handled any more stress, wondering when (or if) the Certificate was going to be issued.  I agree that whilst people are refusing to complete without these Certificates, there is far more incentive for PW to get them issued quickly.

Not long now - you're on the final hurdle!

My solictor's English PA said simply 'don't complete without it' coz if you don't get it then you cannot have utilities connected. It's a no-brainer not to complete until it's in the hands of the solicitors.

CAM Bank were quite content to complete. They after all already have the same level of debt against the builders mortgage that you are taking over, and may see me/you as less of a risk than Polaris !........... They may also be charging PW for every partial release of a property from the whole site ..........

I agree.  The forum has been brilliant - it's just a pity that we can't all go over to Spain at the same time and have a big "Condado Completion Celebration" with barbeque, wine and more wine!   It would be great to meet people we have been chatting to over the last year or so.

Look forward to meeting some of you out in sunny Spain - this English summer is depressing!

Well hate to rub it in Debbie but this will definately be the last British Summer I will be spending here......... anyone else completed today?

Next steps aircon , fans and lights to be installed.

Going to Tapas Bar to celebrate  not in Spain though but closest I can get.

Hi all

We are on Jardin 11 and completed on the 30th June but should have completed on the 25th but the paperwork wasn't quite ready so we had to give POT and our solicitor did not let us know until yesterday that we had completed. So our celebration came the day after so congratulations to everyone else that has done the same. Its a great relief when it happens.

Hi David

Well I can see me being landed with being Official Organiser being a resident......I can assure you that once the dust has settled I will arrange something with the ' Watering Hole'  to use as a venue and put my Hostess head on I am good at blagging so If they will let us use the place free of charge I will arrange a BBQ and some Icebreaker  Party Games for you all .  Plenty of Food & Drink and maybe even a Theme for the night........Hmmm brain ticking now .... watch this space
